Tesla Odometer Lawsuit: Claims, Class, and Case Status

The Tesla odometer lawsuit is a proposed California class action accusing Tesla of inflating the mileage its vehicles report, allegedly pushing cars past their warranty limits faster than actual driving would and shifting repair costs to owners. The case, Nyree Hinton v. Tesla, Inc., was filed in early 2025 and moved to federal court, where a judge granted Tesla’s motion to dismiss in 2026.¹

What the Lawsuit Claims

The complaint alleges Tesla odometers do not measure physical distance the way traditional odometers do. Instead, according to the filing, the system relies on “predictive algorithms, energy consumption metrics, and driver behavior multipliers” that estimate mileage in ways that consistently overstate how far a vehicle has actually traveled.² The plaintiffs allege Tesla “knowingly overstates the distances traveled… or at minimum tolerates substantial inaccuracy” to cut warranty obligations and generate repair revenue.³

Lead plaintiff Nyree Hinton, a California owner of a 2020 Model Y, illustrates the pattern the complaint describes. He bought the car pre-owned at 36,772 miles. During his first six months of ownership it logged an average of 2,217 miles per month, then dropped to about 1,415 miles per month over the following year even though his commute had increased.⁴ In one six-month window the car recorded 13,228 miles, while Hinton’s three previous vehicles, driven under comparable conditions, averaged 6,086 miles over similar periods, a 117% discrepancy.²

After Hinton brought the Model Y to a Tesla repair center in February 2023, the vehicle’s reported daily average allegedly surged from about 20 miles per day to 72.35 miles per day between late March and late June 2023.⁵ The 50,000-mile basic warranty expired by July 7, 2023. When Hinton returned for a sixth service visit in January 2024 to address ongoing suspension problems, Tesla classified the work as “customer pay service” rather than a warranty repair because the mileage threshold had been crossed.⁶

The complaint also references discussions in the r/TeslaModel3 subreddit describing “unexplained surges in odometer readings,” with spikes reported most frequently as vehicles approached their warranty expiration thresholds.²

Who the Proposed Class Covers

The suit was filed by the law firm Singleton Schreiber on behalf of all California residents who purchased a new or used Tesla for personal, family, or household purposes.⁵ The complaint names Models 3, Y, S, X, and the Cybertruck as affected vehicles. The defendants are Tesla, Inc. and Tesla Finance, LLC.⁷ No additional named plaintiffs have been reported as joining the case beyond Hinton, and no parallel lawsuits regarding Tesla odometer accuracy have surfaced in other jurisdictions.⁸

How Owners Say They Were Harmed

The complaint identifies several financial consequences flowing from the alleged inflation:

Premature warranty expiration. Tesla’s basic vehicle warranty runs 4 years or 50,000 miles, whichever comes first, so inflated mileage pushes cars past the 50,000-mile mark faster than actual driving warrants.⁹
Excess mileage charges on leases, since mileage caps in lease agreements can trigger end-of-lease penalties for miles the vehicle never actually drove.¹⁰
Pressure to buy extended warranty coverage sooner than owners otherwise would.¹⁰
Reduced resale value, since higher recorded mileage lowers a vehicle’s market price whether it is sold privately or traded in.⁷

The Legal Claims

The complaint invokes three California statutes: Business and Professions Code Section 17200, which prohibits unlawful business practices; Section 17500, which addresses false advertising; and Vehicle Code Section 28050, which makes it illegal to use or install any device that causes an odometer to “register any mileage other than the true mileage driven,” with “true mileage” defined as the distance registered “within the manufacturer’s designed tolerance.”¹¹⁷

Tesla’s Response

Tesla denied the allegations in court filings.⁶ CEO Elon Musk called the allegations “idiotic” in a post on X on April 19, 2025.¹²

On February 19, 2026, Tesla filed a motion to dismiss. The company argued that its odometers function the same way as those used across the auto industry and do not rely on the software-based predictive algorithms described in the complaint. Tesla also noted that the plaintiffs had originally cited a specific Tesla patent to support their algorithmic-manipulation theory but later removed those references after the patent turned out to relate to trip planning and battery charging rather than odometer calculations. Tesla pointed to a joint vehicle inspection conducted during the litigation that, it said, showed independent mileage measurements were within a “fraction of a percent” of the displayed odometer reading. And Tesla contended the plaintiffs had not shown they were actually denied warranty coverage for qualifying defects.¹³ Tesla’s counsel added that intentional odometer manipulation would be a “severe state and federal offense,” making it illogical for the company to risk its business for marginal warranty savings.¹

Where the Case Stands

According to reporting from Not a Tesla App, the U.S. District Court for the Central District of California granted Tesla’s motion to dismiss.¹ Other mid-2026 reporting noted that a judge would “ultimately decide whether the case moves forward or is dismissed with prejudice,” which suggests the question of whether the plaintiffs can refile or amend their claims may not yet be fully settled.¹³

What Independent Testing Has Shown

No independent testing comparing Tesla odometer readings against GPS-tracked distances has been published in the available reporting. The owner accounts cited in the complaint and in press coverage rely on comparisons to prior vehicles and driving habits, or to third-party tracking tools like TeslaFi, rather than controlled measurements.² The only technical measurement in the record so far is the joint inspection Tesla cited in its dismissal motion, which the company said found the odometer accurate to within a fraction of a percent.¹³
