The Blind Side Lawsuit Settlement: Conservatorship, Claims, and Outcome

The Blind Side lawsuit settlement ended nearly three years of litigation between former NFL offensive lineman Michael Oher and Sean and Leigh Anne Tuohy through a confidential mediated agreement reached in March 2026. No trial took place, and no judge ruled on the merits of Oher’s claims that the Tuohys had exploited him through a 2004 conservatorship. Three outcomes were publicly established: the conservatorship was terminated, it was legally recognized that the Tuohys had never adopted Oher, and Oher received an undisclosed financial payment.¹

What the Settlement Resolved

The case was closed in April 2026 after private mediation produced a signed agreement governed by a non-disclosure agreement. Financial terms are sealed. The agreement included mutual releases barring either side from refiling claims tied to the conservatorship or to profits from the 2009 film.¹

Because the settlement is confidential, several questions the case originally raised were never answered on the record. There is no judicial finding on whether the Tuohys breached a fiduciary duty as conservators. There is no accounting entered as fact by the court showing how much each side actually earned from The Blind Side. And there is no ruling on the disputed 2007 contract that purportedly granted Oher’s life rights to 20th Century Fox without payment.²

The Conservatorship Was Ended Before Settlement

The one part of the dispute decided in open court came early. On September 29, 2023, Shelby County Probate Court Judge Kathleen Gomes ordered the 2004 conservatorship terminated. Both sides had signaled they wanted it ended, but Gomes’s remarks from the bench were pointed. She said she had never in her 43-year career “seen such a conservatorship used for someone who is not disabled,” that the arrangement “should have been dissolved a long time ago,” and added, “I cannot believe it got done.”³

Gomes made clear she was “not dismissing the case.” Ending the conservatorship removed the Tuohys’ legal authority over Oher’s contracts but left his financial claims alive to be litigated or, as it turned out, settled.⁴

What Oher Had Been Seeking

Oher filed his 14-page petition in Shelby County Probate Court on August 14, 2023. He alleged that he had believed the Tuohys adopted him when he signed papers shortly after turning 18, and that he only learned in February 2023, through his attorney J. Gerard Stranch IV, that the arrangement had been a conservatorship.⁵

The petition asked the court for:

Termination of the conservatorship in place since 2004.
An injunction against the Tuohys using his name, image, and likeness.
A full financial accounting of money earned using his name, including proceeds from the film, speaking appearances, and the books In a Heartbeat (2010) and Turn Around (2015).
Disgorgement of profits along with compensatory and punitive damages.⁶

The petition alleged that the Tuohys and their two biological children each received $225,000 plus 2.5 percent of “defined net proceeds” from the film, while Oher received nothing. The Blind Side grossed over $300 million worldwide.⁶

In an August 2024 interview with The New York Times Magazine, Oher said money was not the driver. “I’ve got millions of dollars. I’m fine,” he said, describing the case as an effort to “reclaim my story.”⁷

What the Tuohys Argued

The Tuohys, through attorney Martin Singer, called the lawsuit a “shakedown.” Singer said the family had “insisted that any money received be divided equally” and pointed to “profit participation checks and studio accounting statements” as proof.⁸ Sean Tuohy told the Daily Memphian the family “didn’t make any money off the movie” and said their income came from Michael Lewis’s book, split five ways including Oher’s share. Alcon Entertainment, which produced the film, said in August 2023 it had paid approximately $767,000 to the talent agency representing both the Tuohys and Oher, and that the contracts “did not include significant payouts in the event of the film’s success.”⁹

In November 2023, the Tuohys filed a financial statement documenting ten payments totaling $138,311.01 to Oher or his son between June 2007 and April 2023. They said that after Oher stopped cashing profit checks, they deposited his share into a trust for his son. Checks from 2021 and 2022 totaling more than $8,000 had not cleared.¹⁰ Oher’s lawyers rejected the accounting on November 28, 2023 as “contradictory, confusing, fake in material ways, and wholly inadequate,” and demanded an accounting of a further $2.5 million they said Sean Tuohy took from Oher in 2011 for investment purposes without court permission.¹¹

On December 4, 2023, the Tuohys filed court documents alleging Oher had tried to extort $15 million from them before going public. The filing quoted text messages attributed to Oher, including: “It was 10 million now I want 15 million after taxes” and a demand that if things were not “resolve this Friday, I’m going to go ahead and tell the world, how I was robbed by my suppose to be parents.”¹² The Tuohys used those allegations to oppose Oher’s request for a temporary injunction.¹³ Oher responded that he had “faith in the court system.”⁷

Why There Was No Verdict

Because the parties resolved the dispute through mediation rather than trial, no fact-finder ever weighed the competing accounts of who earned what from the film, whether the Tuohys breached their duties as conservators, or whether Oher’s texts amounted to extortion. The confidentiality clause means the settlement amount, any admissions, and any ongoing obligations between the parties are not part of the public record. What the public docket reflects is narrow: the conservatorship is over, the Tuohys were never Oher’s adoptive parents as a matter of law, and the case is closed with mutual releases.¹
