The Makena Class Action Claim Form: Payment, Denials, and Taxes

The Makena class action claim form was the document used to request a share of the $7.5 million settlement in Maher v. AMAG Pharmaceuticals, Inc., covering people who paid out of pocket for the injectable drug Makena between March 8, 2019 and July 11, 2025.¹ The filing deadline was November 10, 2025. The court gave final approval on January 12, 2026, and payments to approved claimants are expected by the end of May 2026. If you already filed, what matters now is whether your documentation supports the tier you claimed, whether the administrator flags your submission, and how your payment will reach you.

What the Claim Form Asked For

The form was short and had five working parts.²

Name, address, phone, and email.
Treatment and purchase details: the number of Makena doses you received during the class period, the pharmacy or location, the approximate date range, the amount you paid out of pocket after insurance and any copay assistance, and whether you were enrolled in a government healthcare program such as Medicaid or Medicare at the time.
Proof of treatment and proof of payment: how many treatments you could support with records and how many with receipts, along with any pharmacy records, receipts, or explanation-of-benefits statements you attached.
Payment method: PayPal, Venmo, Zelle, a virtual prepaid card, or a mailed check.
A signature under penalty of perjury.

Only people with actual out-of-pocket costs qualify. If your insurer covered everything and you paid nothing personally, there is no loss to reimburse. The class definition on the settlement website refers to “Makena” and does not specifically name generic hydroxyprogesterone caproate, so anyone who used a generic version and filed should confirm eligibility with the administrator.

How Your Payment Is Calculated

Payment depends on the documentation you provided. The settlement agreement sets four tiers, and the gap between them is large.³

Full documentation, meaning both proof of treatment and proof of out-of-pocket cost: you receive the full amount of your documented costs for each injection during the class period.
No personal documentation, but Class Counsel already has reliable records confirming your treatments and costs: you receive the full amount without attaching your own proof.
Proof of treatment only, without proof of cost: $22 per injection, dropping to $4 per injection if you were enrolled in a government healthcare program at the time.
No proof of treatment and no proof of cost: $1 per injection, capped at $40 total.

Every payment is then adjusted proportionally, up or down, so the total distributed equals what remains in the fund after attorney fees, litigation expenses, administrative costs, and service awards to the named plaintiffs. Light claim volume can push individual payments above the base amounts; heavy volume can pull them below.

If Your Claim Is Flagged or Denied

The administrator reviews every claim for completeness, accuracy, and possible fraud. If yours is rejected, you get a notice with a general reason, and you have 10 days from that notice to fix the problem and resubmit.⁴ That window is short. Treat any deficiency notice as time-sensitive and gather your pharmacy records, receipts, or explanation-of-benefits statements right away.

The administrator can also ask for additional information, such as the pharmacy name or the city and state where you filled the prescription, to verify claims or catch duplicates. Once you have responded to any requests and cured any defects, the administrator’s determination is final. The only path further is if Class Counsel and the defendant jointly agree to challenge it, or if either takes the issue to the court.

One category of claim is rejected outright with no chance to cure: a claim filed by anyone who is not the class member or a legally authorized representative. A parent or guardian may file for a minor, an executor or administrator may file for a deceased class member’s estate, and a court-appointed representative may file for someone incapacitated. Anyone else is not eligible to submit on another person’s behalf.⁴

When and How You Get Paid

The court approved the settlement on January 12, 2026. Distribution to approved claimants is expected by the end of May 2026.¹

If you chose PayPal, Venmo, Zelle, or a virtual prepaid card, watch the email address and phone number you listed on the form. If you chose a check, it will be mailed to the address on file. Moved since you filed? Changed your email or phone? Update your contact information through the settlement website as soon as possible. A payment that bounces back or a check that goes to an old address can take weeks to reissue, and in some cases the funds can be forfeited if the administrator cannot reach you.

The full fund is $7,500,000. Attorney fees, litigation expenses, administrative costs, and service awards to the named plaintiffs come off the top before claimant payments are calculated.⁵

Is the Payment Taxable

Whether your Makena payment is taxable depends on how the IRS characterizes it. The settlement reimburses out-of-pocket costs for a product that turned out to be ineffective, which is closer to a refund than to compensation for a physical injury. The IRS generally does not tax amounts that simply restore you to where you were financially before a purchase. If you previously deducted your Makena costs as a medical expense on your tax return and got a tax benefit from that deduction, the settlement money could be taxable to the extent of that prior benefit.

For tax years beginning after 2025, settlement administrators must issue a Form 1099 only for payments of $2,000 or more, up from the previous $600 threshold.⁶ Given how the Makena fund is split, individual payments are unlikely to hit that threshold for most people. You are still responsible for reporting the income whether or not you receive a 1099. A tax professional can address your specific situation if you deducted Makena costs in an earlier year.

If You Never Filed

The claim deadline was November 10, 2025, and late claims are generally rejected unless the administrator finds good cause.⁴ The deadline to opt out or file a written objection was the same date, and the court has since granted final approval. Class members who did not opt out are bound by the settlement and have released their claims against AMAG and the other released parties, whether or not they submitted a claim form.
