The Spilsbury Charge: Crippen, Spilsburyism, and Reassessment

Sir Bernard Spilsbury was the Home Office pathologist whose testimony decided the outcome of many of England’s most notorious murder trials between 1910 and the mid-1940s, and whose reputation for infallibility is now regarded as a cautionary example of what happens when a single expert witness is allowed to dominate a capital case. He performed an estimated 20,000 autopsies, was knighted in 1923, and for decades the phrase “Spilsbury Called In” in a newspaper headline was treated as a signal that a case was as good as solved.1National Center for Biotechnology Information. Who He Was

Bernard Henry Spilsbury was born on May 16, 1877, in Leamington Spa, Warwickshire.3Hektoen International. Forensic Medicine and Sir Bernard Spilsbury He read natural science at Magdalen College, Oxford, took his BA in 1899, and qualified in medicine at St. Mary’s Hospital, Paddington, in 1905, studying under A.J. Pepper, a pathologist who worked with the Home Office.4Royal College of Physicians. Sir Bernard Henry Spilsbury By 1908 he had succeeded Pepper at St. Mary’s and been appointed Home Office Pathologist, the position that defined his career. He was elected a Fellow of the Royal College of Physicians in 1931 and served as president of the Medico-Legal Society from 1933 to 1935.

The Case That Made Him: Crippen, 1910

Spilsbury’s fame began with the 1910 murder trial of Dr. Hawley Harvey Crippen, accused of poisoning his wife Cora with hyoscine and burying dismembered remains in the cellar of their London home. The prosecution needed to identify a partial set of remains as Cora. Spilsbury performed a microscopic analysis and identified what he said was a fragment of a hysterectomy scar on the tissue, consistent with her known medical history.3Hektoen International. Convictions That Rested on His Word

Over the next two decades Spilsbury appeared as the prosecution’s principal forensic witness in a run of capital trials.

In 1912, Frederick Seddon was convicted of murdering his lodger Eliza Barrow by arsenic poisoning, on testimony that included Spilsbury’s, and executed.3Hektoen International. In 1922, the Welsh solicitor Herbert Rowse Armstrong was convicted of poisoning his wife Kitty with arsenic. Spilsbury told the court that the arsenic in her intestines showed she had ingested a large dose within twenty-four hours of death and could not have been up and about during that period.7BBC. Not every case ran his way. In the two unrelated 1934 Brighton trunk murders, Spilsbury was unable to identify the first victim or determine cause of death, and the jury returned an open verdict. In the second, he admitted he was “unable to reach any conclusion” about how the dancer Violette Kaye had died, and the accused, Toni Mancini, was acquitted.8TIME. Brighton’s No. 1, No. 2

Norman Thorne and the Birth of “Spilsburyism”

The 1925 trial of Norman Thorne became the pivot point of Spilsbury’s reputation. Thorne, a chicken farmer in East Sussex, was accused of murdering his fiancée Elsie Cameron, whose body was found buried under a chicken run on his property. He said she had hanged herself.

Spilsbury’s first autopsy on January 17, 1925, found no surface trauma. By cutting into the body he identified eight internal bruises and concluded they had occurred shortly before death. On the neck he found what he called natural skin creases and no signs of hanging, and he chose not to take tissue sections from the neck.1National Center for Biotechnology Information. An exhumation followed. On February 24, Dr. Robert Matthew Brontë and Dr. John Gibson performed a second autopsy with Spilsbury observing. The coffin was full of water and the body had deteriorated over the five weeks since burial. Brontë saw marks on the neck he considered significant; Spilsbury dismissed them as natural creases. Brontë also argued that if Cameron had been beaten with an Indian club, as Spilsbury suggested, there should have been fractures and lacerations, and that prolonged submersion made bruise interpretation unreliable.1National Center for Biotechnology Information. The jury sided with Spilsbury. Thorne was convicted and hanged. Before his execution he wrote to his father: “Never mind, Dad, don’t worry. I am a martyr to Spilsburyism.”9The Guardian. Law and Forensic Science Arthur Conan Doyle said publicly that the case had not been clearly proved on the medical evidence, and the Law Journal questioned whether Spilsbury’s reputation had been given undue weight.3Hektoen International. Why Courts Deferred to Him

What made Spilsbury unusual was not the science but the deference. Jurors seldom questioned his conclusions, and defense barristers rarely landed a blow against him in cross-examination. His courtroom manner was concise, authoritative, and polished enough that he was often the decisive factor before the rest of the evidence had been weighed.3Hektoen International. The crime writer Edgar Lustgarten wrote that Spilsbury “stood for pathology as Dempsey stood for boxing or Capablanca for chess” and “achieved a status merited by none, not even by himself.”10The New York Times. Modern Reassessment

The most damaging posthumous challenge came in the case that built him. Researchers located one of the original microscope slides used at the 1910 Crippen trial in the Royal London Hospital Archives, bearing Spilsbury’s own handwriting: “Crippen” and “Scar in skin.”12The Scientist. Who Killed Cora Crippen Forensic biologist David Foran of Michigan State University extracted mitochondrial DNA from tissue on the slide and compared it against samples from three of Cora Crippen’s female relatives. It did not match. “That body cannot be Cora Crippen, we’re certain of that,” Foran said.13The Guardian. The Armstrong testimony has been questioned on similar grounds. Forensic toxicologist Professor Atholl Johnston said it was “impossible” for Spilsbury to have ruled out that the arsenic was administered three or four days before Kitty Armstrong’s death rather than within the final twenty-four hours, calling the original testimony subjective opinion rather than established science.7BBC. How the Field Moved Past Him

A new generation of forensic pathologists, including Sydney Smith, Keith Simpson, and Francis Camps, was, in one account’s words, “not intimidated by his reputation and prepared to challenge him on every point,” and lawyers, judges, and juries gradually stopped accepting his assertions without question.2MedCrave Online. The Fallible Inflexibility of Bernard Spilsbury Simpson set out a principle in direct contrast to how Spilsbury had worked: a forensic witness should have no concern about whether the accused hangs or a guilty person walks free, and the pathologist’s sole duty is to give the best evidence to the court so the court can decide. That standard, together with controlled protocols and peer review, replaced the model of the lone, all-powerful pathologist.

Death

Spilsbury suffered a stroke in 1940 and a second in 1945. His wife Edith had left him in 1940, his son Peter, a house surgeon, was killed in a German bombing raid on St. Thomas’ Hospital that same year, and his son Alan died of tuberculosis in 1945.3Hektoen International.
