If you developed thyroid cancer after long-term exposure to PFAS — the “forever chemicals” found in firefighting foam, contaminated drinking water, and some consumer products — you may be able to file a PFAS thyroid cancer lawsuit as part of the federal multidistrict litigation in South Carolina. Roughly 15,200 personal injury claims are pending in that MDL as of early 2026, no bellwether trial has yet been held, and no global settlement covers individual cancer victims. A court-appointed special master is working with both sides on a settlement framework, and thyroid cancer claims are on a dedicated causation track that moved through expert reports in late 2025.
Who Can File a PFAS Thyroid Cancer Claim
Two things are generally needed: a diagnosed thyroid cancer and a documented connection to PFAS exposure. The forms of thyroid cancer associated with PFAS in the scientific literature include papillary, follicular, and medullary.
Recognized exposure pathways in the litigation include:
- Living for at least six to twelve months in an area with PFAS-contaminated drinking water, especially near military bases, industrial plants, or airports where aqueous film-forming foam (AFFF) was used.
- Occupational exposure through AFFF firefighting foam or through work in facilities that produced or used PFAS-containing products.
- Significant contact with PFAS-containing consumer products such as nonstick cookware or water-resistant textiles.
To back a claim, you generally need medical records confirming the diagnosis and documentation tying you to a contaminated area or exposure source — residency records, military service records, or employment history.1TruLaw. PFAS Thyroid Cancer Lawsuit
Deadlines You Need to Know
A major filing cutoff has already passed. In August 2025, Judge Richard M. Gergel, who oversees the AFFF MDL, ordered all unfiled claims to be submitted by September 5, 2025. Claims filed after that date are put on an accelerated pretrial track: full medical records and a fact sheet within 90 days, and expert disclosures within 120 days.2About Lawsuits. State statutes of limitations still apply separately. These typically run one to six years from the date the injury is discovered, depending on the state.3Goldwater Law Firm. Statute of Limitations for PFAS Lawsuits Missing either the MDL filing schedule or your state’s limitations period can extinguish a claim, so timing is often the first question a lawyer will ask.
Where the Litigation Stands
Individual PFAS personal injury cases have been consolidated since December 2018 in MDL No. 2873, formally titled In re: Aqueous Film-Forming Foams Products Liability Litigation, in the United States District Court for the District of South Carolina.4U.S. District Court, District of South Carolina. MDL 2873 Defendants include 3M, DuPont, Chemours, Corteva, BASF, and Johnson Controls, among others.
This is a mass tort, not a class action. Each plaintiff files their own suit and, if compensation is awarded, receives an amount based on their individual injury and exposure history rather than an equal share of a single pool.5ClassAction.org. PFAS Water Cancer Thyroid Lawsuit
The Thyroid Cancer Track
The court has grouped claims by condition. Thyroid disease and hypothyroidism sit in “Group B” alongside ulcerative colitis, with discovery governed by Case Management Order 26F and completed on April 16, 2026.6U.S. District Court, District of South Carolina. Case Management Order 26FPFAS Lawsuits
Thyroid cancer and liver cancer are moving through a separate, second bellwether process focused on causation. Judge Gergel ordered a “Science Day” in March 2025, and both sides presented scientific evidence on June 20, 2025. Plaintiffs submitted expert medical reports ahead of a November 2025 deadline, defendants responded by late October 2025, and plaintiffs filed rebuttals by late November. The next stages are expert depositions and Daubert briefing, the legal test that decides whether the scientific testimony can go before a jury.7Keefe Law Firm. Bellwether Trials Are Delayed
Bellwether trials are test cases whose outcomes shape settlement talks for the rest of the pool. The first AFFF bellwether — a kidney cancer case — was scheduled for October 2025, but Judge Gergel postponed it after a surge of new filings strained the court’s schedule.8Union Law Firm. Firefighting Foam AFFF Lawyer As of April 2026, no bellwether has been completed and no new trial date has been publicly confirmed. Rescheduling is expected for mid-2026 or later, and the thyroid cancer trials sit behind that, on a schedule the court is still resetting.9CallFOB. AFFF Lawsuit Update
Settlements: What Has and Has Not Happened
Billions of PFAS dollars have already changed hands, but none of it has gone to individual cancer victims. The finalized deals — including a roughly $10.3 billion 3M settlement and separate agreements with DuPont, Chemours, Tyco, and BASF — resolved claims by public water systems seeking money to filter PFAS out of drinking water.10PFAS Water Settlement. Aqueous Film-Forming Foam Products Liability Litigation Settlement Those water-utility settlements are entirely separate from the personal injury cases and do not compensate individuals who developed cancer.
For personal injury claims, no global settlement exists. A court-appointed special master is working with plaintiffs’ attorneys and defendants on a “settlement matrix,” a framework that would assign values to claims based on injury type, exposure severity, and other factors.9CallFOB. AFFF Lawsuit Update Legal observers see a resolution for certain cancer claims as possible in 2026, partly because defendants in this litigation have shown a pattern of settling rather than trying cases.11Lawsuit Information Center. Estimated individual payouts vary by source, with ranges cited in legal analyses running from $75,000 to $500,000. The higher end reflects severe cases, such as long-term occupational exposure combined with high-risk cancers.12Drugwatch. AFFF Lawsuits These figures are speculative. No individual personal injury payouts have been finalized in the MDL, and the only jury verdict to date in PFAS health litigation, a $40 million award in Swartz v. DuPont, involved kidney cancer rather than thyroid cancer.13Lawsuit Tracker. PFAS Lawsuit
Why the Science Supports These Claims
The scientific case linking PFAS to thyroid harm has strengthened considerably. A 2022 report from the National Academies of Sciences, Engineering, and Medicine identified thyroid dysfunction as an adverse health effect linked to PFAS and recommended regular screening for people with elevated exposure.14National Academies of Sciences, Engineering, and Medicine. Guidance on PFAS Exposure, Testing, and Clinical Follow-Up A 2023 study in eBioMedicine found that each doubling of one form of PFOS in blood plasma was associated with a 56 percent increase in the rate of thyroid cancer diagnosis, with even stronger associations for patients diagnosed at least a year after their blood was drawn.15National Library of Medicine. Nested Case-Control Study of PFAS and Thyroid Cancer
In February 2026, Vanderbilt University researchers published a study in the Journal of the Endocrine Society that offered direct mechanistic evidence. Mice exposed to a combination of PFOA, PFOS, and GenX over eight weeks showed altered thyroid cellular structure, elevated thyroid-stimulating hormone, and disrupted signaling pathways involved in cancer development, along with downregulation of a gene called Klhl23.16Oxford University Press. PFAS Alter Thyroid Histology and Cellular Signaling In Vitro and In Vivo17Vanderbilt University School of Medicine. PFAS Forever Chemicals Directly Shown to Alter Thyroid Structure and Function In late 2023, the International Agency for Research on Cancer reclassified PFOA as “carcinogenic to humans” (Group 1), its highest designation, though the specific human cancer evidence cited was for kidney and testicular cancer.18IARC. IARC Monographs Evaluate the Carcinogenicity of PFOA and PFOS Not all research points the same direction: a National Cancer Institute study using the Finnish Maternity Cohort found no overall association between PFAS and papillary thyroid cancer, though it noted “suggestive but imprecise increased risks” for women diagnosed before age 40.19National Cancer Institute. Firefighters Face the Highest Exposure
Firefighters carry an especially heavy PFAS burden. They contact the chemicals through AFFF, through turnout gear that often contains fluorinated compounds in multiple layers, and through station dust — one study found PFOS levels in fire station living areas fifteen times higher than the general population median. In 2022, IARC classified the firefighting occupation itself as a Group 1 carcinogen, and research has identified elevated rates of thyroid, testicular, prostate, and kidney cancer among firefighters, with PFAS blood serum levels a suspected contributor.20National Library of Medicine. Firefighter PFAS Exposure and Cancer Risk
For military firefighters, the VA acknowledges possible PFAS exposure through AFFF, which the Department of Defense has used since the 1970s and plans to phase out by late 2025. There are no formal presumptions connecting PFAS to specific cancers for VA disability purposes, though the agency evaluates claims case-by-case and is reviewing kidney cancer evidence under the PACT Act process.21VA Public Health. PFAS Exposure
Congress is considering a separate path. The Firefighter PFAS Injury Compensation Act of 2024 (S. 4013), introduced by Senator Cory Booker, would create a no-fault compensation program funded by an excise tax on PFAS products. A firefighter diagnosed with thyroid cancer would be eligible for a base award of $250,000; a firefighter with a non-cancer thyroid condition would qualify for $50,000.22U.S. Congress. What This Lawsuit Is Not
Two adjacent programs are often confused with the PFAS thyroid cancer litigation, and neither is a substitute.
Camp Lejeune claims are separate. The Camp Lejeune Justice Act, signed in August 2022 as part of the PACT Act, allowed people exposed to contaminated water at the North Carolina Marine base between 1953 and 1987 to file administrative claims with the Navy or sue in federal court.24U.S. Navy. Camp Lejeune Justice Act Thyroid cancer is not among the presumptive conditions that automatically qualify for VA disability benefits under Camp Lejeune provisions, and it is not listed in the Navy’s Elective Option settlement tiers, which cover kidney cancer, liver cancer, and non-Hodgkin’s lymphoma.25Triage Cancer. Camp Lejeune Act Quick Guide The filing deadline for new Camp Lejeune claims was August 10, 2024, and the Navy is no longer accepting submissions.
Thyroid cancer claims tied to GLP-1 weight-loss and diabetes drugs, such as Ozempic, Wegovy, Rybelsus, Victoza, and Saxenda, are a different litigation entirely. Those cases sit in MDL 3094 before Judge Karen Spencer Marston in the Eastern District of Pennsylvania, and while thyroid tumors are a qualifying injury there, the bulk of that MDL focuses on gastrointestinal injuries.26Wisner Baum. Rybelsus Lawsuit If your thyroid cancer is linked to a GLP-1 drug rather than PFAS exposure, that is where the claim belongs.
What Happens Next
The immediate turning points are the Daubert proceedings on the thyroid and liver cancer expert evidence and the rescheduling of the first personal injury bellwether trial. A strong showing for plaintiffs at those stages would pressure defendants toward a global settlement; setbacks would slow things down. The special master’s negotiations continue in parallel, and the first personal injury trial is expected to be rescheduled for sometime in 2026 or beyond.9CallFOB.
