Tobacco Lawsuit Attorneys: Engle Progeny, Juul, and Fees

Tobacco lawsuit attorneys are the plaintiff and defense lawyers who litigate claims against cigarette, smokeless tobacco, and e-cigarette manufacturers, and on the plaintiff side they typically work on contingency, meaning you pay nothing unless the case recovers money. The field grew out of decades of litigation that produced the largest civil settlement in U.S. history, and a handful of firms now dominate the work on both sides. If you are considering a claim, what matters is which theories still work, what you have to prove, who the experienced firms are, and how fees are structured.

What Tobacco Lawsuit Attorneys Handle Today

Individuals can still sue tobacco companies, and cases continue to be filed and tried. Plaintiff attorneys build claims around a few core legal theories:1FindLaw. Can I Still Sue Big Tobacco or a Nicotine Product Company

  • Product liability, alleging that cigarettes are unreasonably dangerous or were sold with inadequate warnings.
  • Fraud and concealment, arguing that manufacturers hid what they knew about nicotine addiction and cancer risks.
  • Wrongful death, brought by families of smokers who died from tobacco-related disease.
  • Consumer protection violations, claiming that marketing practices broke state laws against deceptive business practices.

Smoking alone is not enough. A plaintiff must prove a specific injury caused by tobacco products, and successful claims typically rest on evidence that manufacturers knew about health risks internally and deliberately suppressed what they knew.1FindLaw. Can I Still Sue Big Tobacco or a Nicotine Product Company Cases require extensive investigation, expert testimony, and detailed medical records showing diagnosis and treatment history. Most tobacco cases settle rather than reach a verdict.2Nolo. Tobacco Litigation: History and Development

Statutes of limitations vary by state and impose strict deadlines for filing. Defense firms routinely raise limitations arguments contending that the plaintiff knew or should have known about the claim years earlier, so timing is a threshold question any attorney will evaluate first.

How Fees Work

Plaintiff tobacco attorneys almost always work on contingency. You pay nothing up front, and the firm takes an agreed percentage of any recovery; if the case loses, you owe no fee. That structure was essential to the field’s development because few individual plaintiffs could afford the discovery costs and expert fees needed to litigate against the tobacco industry.

The scale of fees in historic state cases gives a sense of what contingency work has produced. During the state attorney general campaign in the 1990s, state fee agreements with private counsel ranged widely: Connecticut, Florida, Massachusetts, Maryland, Minnesota, and Utah agreed to 25%; Hawaii 20%; Oklahoma and Texas 15%; and Illinois 10%.3Every CRS Report. Tobacco Litigation: Special Assistant Attorneys General An arbitration panel created in 1998 to resolve fee disputes awarded $10.7 billion to private counsel across 15 states and Puerto Rico. In Texas, five firms received $3.3 billion from the state’s $15.3 billion settlement. In Mississippi, the Scruggs firm was awarded $1.4 billion, representing 35% of the state’s $4 billion recovery. In Florida, a judge called the attorneys’ initial fee request of $2.8 billion “patently ridiculous,” but an arbitration panel awarded $3.4 billion.4Cato Institute. Great Tobacco Robbery: Lawyers Grab Billions Dissenting arbitrator Judge Richard Renfrew called the fees “incomprehensible.”

The field has also produced cautionary cases on the fee side. Former Texas Attorney General Dan Morales was indicted in 2003 on charges including mail fraud, conspiracy, and tax evasion over a scheme to funnel tobacco litigation fees to a friend, Houston lawyer Marc Murr, who had done little or no actual work on the case. Morales allegedly backdated contracts and forged government records. He pleaded guilty in July 2003 and faced a four-year federal prison sentence; Murr pleaded guilty to mail fraud and was sentenced to six months.5U.S. Department of Justice. Leading Plaintiff Firms

A small number of firms carry most of the national plaintiff work in tobacco litigation. Their experience, document libraries, and relationships with expert witnesses are difficult for newer entrants to match.

Lieff Cabraser Heimann & Bernstein

Lieff Cabraser served as private counsel to the attorneys general of Massachusetts, Illinois, Louisiana, Indiana, Rhode Island, Maine, and New Hampshire, along with 18 California cities and counties. The firm’s clients received $42 billion in Master Settlement Agreement payments over 25 years. During California discovery, Lieff Cabraser compelled production of R.J. Reynolds’ internal “Project SCUM” documents, which revealed a marketing strategy targeting gay and homeless communities in San Francisco as well as “rebellious” youth.7Lieff Cabraser. Hagens Berman Sobol Shapiro

Hagens Berman served as Special Assistant Attorney General for 13 states, including Washington, New York, and Arizona. The firm was instrumental in securing the cooperation of Liggett Group CEO Bennet LeBow, who provided documents and admissions about nicotine addiction and the targeting of children. The firm characterized the resulting settlement as the largest civil settlement in history and built a database of more than 30 million documents for use by attorneys general.8Hagens Berman. Stanley and Susan Rosenblatt

Stanley and Susan Rosenblatt, a husband-and-wife team working from a four-lawyer Miami firm, filed two of the most consequential individual tobacco cases ever. In 1991, they sued on behalf of nearly 60,000 nonsmoking flight attendants who developed cancers from secondhand smoke exposure, producing a $350 million settlement in 1997. They then filed the Engle class action for hundreds of thousands of Florida smokers, which produced a $145 billion jury verdict. Other firms have earned national reputations in specific pieces of this work. Who the Defense Is

If you file a tobacco case, you will likely face one of a few large firms that have defended cigarette manufacturers for decades. Knowing who they are is useful because their consistency is itself a defense strategy: the same lawyers see the same arguments across thousands of cases.

Shook, Hardy & Bacon, based in Kansas City, serves as national litigation and regulatory counsel for Philip Morris USA and Philip Morris International. The firm has defended more than 6,000 tobacco cases across all 50 states, tried over 150 of them, and continues to manage more than 3,000 active cases, including the defense of Philip Morris in Florida’s Engle progeny litigation.13Shook, Hardy & Bacon. Defense strategy centers on statute-of-limitations arguments and personal-choice theories contending that smoking was voluntary rather than the product of addiction.

Engle Progeny Cases in Florida

If you were a Florida smoker or are the family of one, Engle progeny litigation is a specific track that still produces verdicts, and attorneys who work it have a procedural advantage no other tobacco plaintiff gets.

The Engle v. Liggett Group, Inc. case, filed in 1994 by the Rosenblatts, went to a Miami-Dade jury that awarded $145 billion in punitive damages in 2000. The Florida Supreme Court vacated that award in December 2006 as “excessive as a matter of law” and ruled that individualized causation made class treatment unworkable.17Tobacco Control Laws. Engle v. Liggett Group, Inc. But the court upheld the jury’s core liability findings, that nicotine is addictive, that cigarettes are defective and unreasonably dangerous, that the defendants were negligent, and that they engaged in concealment and fraud, and gave those findings binding legal effect in individual follow-on suits. Former class members had one year to file their own cases and could rely on those findings without reproving them.

More than 8,000 individual Engle progeny lawsuits were filed in Florida state and federal courts between 2007 and 2008.18HHS.gov. History of Tobacco Litigation As of June 2015, plaintiffs had won 90 of 141 trials that reached a verdict. Notable awards include $67.65 million in Calloway v. R.J. Reynolds and Philip Morris, $46 million in Ryan v. R.J. Reynolds, and $41.1 million in Boersma v. R.J. Reynolds.19Public Health Law Center. Engle Progeny Fact Sheet In 2014, a jury in Robinson v. R.J. Reynolds awarded $23 billion in punitive damages; the trial judge reduced it to $16.9 million as “clearly constitutionally excessive.”20The National Trial Lawyers. $23 Billion Engle Verdict A $100 million settlement in February 2015 resolved the remaining 400 federal Engle progeny cases.

Appellate activity continues. In July 2025, a Florida appeals panel overturned an $8.1 million Engle progeny verdict against R.J. Reynolds, ruling that the trial court improperly instructed the jury on findings not at issue in that case.21Law360. RJR Gets New Trial Undoing $8.1M Engle Progeny Verdict Between 1995 and September 2024, 142 tobacco cases nationwide resulted in punitive damage awards, with Engle progeny actions accounting for more than 80% of them. In nearly one-third, the verdict was reversed or reduced on appeal.22University of Pittsburgh Law Review. Tobacco Litigation Damages Study

Vaping and Juul Cases

The same plaintiff playbook has moved to e-cigarettes. If your claim involves youth nicotine addiction or injury from a vape product, the active litigation is largely consolidated.

Thousands of lawsuits allege that Juul Labs marketed high-nicotine products to teenagers through social media, flavors, and free samples. Cases are consolidated in MDL No. 2913 in the U.S. District Court for the Northern District of California, encompassing more than 8,500 personal injury cases, a nationwide class action, and over 1,500 cases brought by cities, counties, and school districts.23Keller Rohrback. Juul Labs E-Cigarette Litigation In December 2022, Juul reached a global resolution covering more than 5,000 cases involving approximately 10,000 plaintiffs.24Juul Labs. A $235 million settlement with Altria, Juul’s former corporate stakeholder, was announced in May 2023 after the first bellwether trial brought by the San Francisco Unified School District, and received final approval in March 2024. A separate $1.2 billion settlement with approximately 1,400 school districts was announced in April 2023.26Consumer Notice. Juul Lawsuits

What Damages Have Looked Like

Tobacco verdicts have produced some of the largest damage awards in American legal history, though many are reduced or overturned. The original Engle verdict of $145 billion is the most extreme example of a punitive award that was vacated. In Williams v. Philip Morris, the U.S. Supreme Court ultimately upheld a $79.5 million punitive damages award.27HHS.gov. Tobacco Litigation Case Studies Other notable awards include $3 billion initially assessed in Boeken v. Philip Morris (later reduced to $50 million) and $28 billion in Bullock v. Philip Morris (reduced to $13.8 million after multiple proceedings).

The pattern across decades is consistent. Juries sometimes return enormous punitive verdicts, but courts regularly trim them on constitutional grounds. Compensatory awards for actual losses like medical expenses and lost income tend to be more durable. The first tobacco case to result in a paid verdict was Carter v. Brown & Williamson in 1996, a $750,000 award that was not collected until 2001.27HHS.gov. Tobacco Litigation Case Studies A realistic conversation with any tobacco attorney will distinguish between potential verdict size and likely collected recovery.

A Note on Menthol Litigation

If you are looking for an attorney because of concerns about menthol cigarettes, the active case on that front has been about FDA regulation, not private injury recovery. In April 2024, a coalition of public health organizations sued in federal court in California to force the FDA to finalize a menthol ban.28WUSF. Lawsuit Seeks to Force Ban on Menthol Cigarettes The court issued a 180-day stay in February 2025, and plaintiffs filed a notice of voluntary dismissal in October 2025. The Public Health Law Center noted that the dismissal does not foreclose future legal action.29Public Health Law Center. FDA Menthol Rule Litigation Update Individual menthol-related injury claims would proceed under the same product liability and fraud theories that apply to other cigarette cases.

Choosing an Attorney

Experience with the specific track your case belongs to matters more than general personal injury credentials. An Engle progeny case in Florida demands familiarity with the preserved liability findings and the appellate record that has grown around them. A Juul case belongs in or near the MDL in the Northern District of California. A traditional smoker injury case anywhere else turns on product liability law in your state, your medical record, and your ability to establish when the injury was discovered for limitations purposes.

Ask any firm you consult how many tobacco or nicotine cases it has handled, whether fees are purely contingent, who covers litigation costs if the case loses, and how it evaluates the statute of limitations on your specific facts. Those four questions separate firms with real tobacco experience from firms taking the case because it sounds valuable.
