Tracey Richter: Self-Defense or Premeditated Murder?

The Tracey Richter murder case is the decade-long Iowa prosecution of a mother who shot her 20-year-old neighbor Dustin Wehde nine times in her home in December 2001, told a self-defense story on national television, and was ultimately convicted of first-degree murder in November 2011 after prosecutors proved the killing was staged to frame her ex-husband and win a custody fight. She is serving life without parole.

The Night of December 13, 2001

Richter shot Wehde nine times with two different guns inside her home in Early, a small town in Sac County, Iowa. Three of the rounds struck the back of his head and neck.¹

Her account to police: two or three men had broken in, one choked her with pantyhose until she lost consciousness, she broke free, reached a gun safe in the bedroom, and fired “blindly over her shoulder.” The others, she said, fled.²

Her 11-year-old son Bert was home. When the first deputy arrived, Bert identified the dead man as Dustin Wehde. Richter cut him off, saying they “did not know that yet.”³ Wehde was a neighbor Bert already knew.¹

Within weeks Richter was on The Montel Williams Show presenting herself as a mother who had defended her children from home invaders. Investigators, however, found no forced entry and never located a second intruder.⁴

Who Dustin Wehde Was

Wehde was 20, a neighbor, and had been described as a former special education student.⁵⁴ Sac County prosecutor Ben Smith later told jurors Richter picked him because she saw him as vulnerable and “disposable.”⁶

The killing devastated the Wehde family. Dustin’s mother, Mona, filed a wrongful death suit but dropped it after investigators told her civil discovery could interfere with the criminal investigation. His father, Brett Wehde, killed himself at his son’s grave in November 2002.⁴

Why the Case Sat for Nearly a Decade

Richter was not charged in 2001. Investigative attention shifted after September 11. Her television appearances gave her narrative reach. And investigators were sitting on a piece of evidence they had decided to keep quiet: a pink spiral notebook recovered from Wehde’s car.⁶

The notebook contained entries, purportedly in Wehde’s hand, claiming Richter’s first ex-husband John Pitman III had hired him to stalk and attack her and her son. Detectives kept its existence a secret on the theory that only someone involved in the crime would know it existed.²

What Broke the Case Open

The case moved again after Richter’s second marriage collapsed. Her second husband, Michael Roberts, contacted police and said her account of the shooting was a lie.⁶

In 2009, the Sac County Sheriff’s Office and the Iowa Division of Criminal Investigation reopened the file. A crime scene reconstruction using bullet trajectory and blood spatter analysis concluded that Wehde’s head had been on the ground when the last shots were fired.⁷⁶

Then came Mary Higgins, a friend of Richter’s. Prosecutor Ben Smith had become church friends with Higgins’ husband, and during a conversation about the case Higgins referred to a “stupid notebook.” When DCI agents formally interviewed her, she said Richter had told her about the pink notebook in the months after the shooting, had warned her to “forget about it,” and had predicted John Pitman would be arrested because of what it contained.² Since the notebook’s existence had been kept from the public, Richter’s knowledge of it pointed at her as its author.

She was arrested in Omaha in July 2011 and charged with first-degree murder in Sac County.⁸

The Trial

The case was tried in Webster County before Judge Kurt L. Wilke, with prosecutors Ben Smith and Doug Hammerand presenting the state’s case with support from the Iowa Attorney General’s office.⁸

The Prosecution’s Theory

Prosecutors argued Richter lured Wehde to her home, forced him to write the notebook entries implicating Pitman, then killed him to silence him and planted the notebook in his car. The motive was a coming custody hearing: Richter feared losing physical custody of her son with Pitman and the $1,000 a month in child support that came with it.⁹

The Forensic Evidence

The autopsy showed three shots entered the back of Wehde’s head and neck on trajectories indicating they were fired from above. Crime scene reconstructionist Rodney Englert testified that the final shot was fired into congealed blood, meaning Wehde was already dead or incapacitated when it was delivered.¹

Medical examiners testified that the marks on Richter’s neck were friction burns rather than ligature marks, and that their position made it impossible for them to have caused the unconsciousness she described. There was no sign of forced entry.¹

Key Witnesses

Mary Higgins testified that Richter told her about the notebook months after the shooting and later told her to “forget about it.” She described how Richter recounted the killing without emotion, “like she was telling me her grocery list,” and said Richter had told her she stood over Wehde and threatened to “blow your head off” before firing until he stopped moving.⁵¹

John Pitman III testified he had never met Wehde, knew nothing of the notebook, and had no involvement in any plot against Richter. He pointed out that the notebook contained private details about his life that only Richter would have known.²

The Defense

Richter pleaded not guilty and raised the affirmative defense of justification. Her son Bert Pitman, then 21, testified for her, describing choking sounds, a bedroom-door threat from Wehde, and his mother standing over Wehde with a gun in each hand warning him not to move before firing again.¹

On cross-examination, Bert conceded that his 2001 police interview at age 11 was his “most accurate recall of the incident.” That original account contained none of the dramatic details he added a decade later.¹ Jurors later told an NBC documentary they “never believed” him.¹⁰

One line in particular cut against Richter. In the days after the shooting, as she recounted the killing, her 11-year-old son interrupted her: “Why did you go back up there? You didn’t have to shoot him. You didn’t have to kill him.”²

Verdict

The jury convicted Richter of first-degree murder on November 7, 2011. On December 5, 2011, she was sentenced to life in prison without the possibility of parole.⁹

The Appeals

Richter appealed, arguing the evidence could not overcome her self-defense claim, that the trial court wrongly excluded a psychologist’s testimony diagnosing her with PTSD, and that her attorney was ineffective for failing to move for a new trial. On January 9, 2013, the Iowa Court of Appeals rejected all three arguments and affirmed, finding “substantial evidence” supported the verdict.¹

She then sought post-conviction relief in Sac County District Court, which Judge Michael J. Moon denied. On March 8, 2017, the Iowa Court of Appeals unanimously affirmed a second time, finding her ineffective-counsel claims “ring hollow.”¹¹¹²

Where the Case Stands

Richter is serving her life sentence at the Iowa Correctional Institution for Women in Mitchellville.¹³¹⁴
