Travis Scott’s Astroworld Lawsuit: Liability, Settlements, Trials

The Travis Scott Astroworld lawsuit is not a single case but hundreds of civil claims filed by more than 4,000 plaintiffs after the November 5, 2021 crowd crush at NRG Park in Houston killed 10 people and injured many more. All 10 wrongful death suits have been settled confidentially, and Live Nation disclosed $280 million in total Astroworld settlement costs in its second-quarter 2024 earnings report.¹ Hundreds of personal injury cases have also settled through a bellwether process, with more still pending. No Astroworld case has gone before a jury.²

What the Lawsuits Claim

The suits name Travis Scott, Live Nation, Apple (which livestreamed the concert on Apple Music), and dozens of other companies and individuals connected to the festival. Plaintiffs allege negligent planning, inadequate security, insufficient emergency medical response, and failure to monitor crowd size, among other claims.³

The cases were consolidated in Harris County District Court under Judge Kristen Hawkins in December 2021. She has overseen all pretrial matters since.⁴

Is Travis Scott Personally Liable

Whether Scott himself bears responsibility, as opposed to the promoters and security contractors around him, has been the central legal fight. His attorneys argued that a performer should not be held liable for safety and security failures that fell to event organizers.⁵ Plaintiffs answered that Scott was not a guest act but a “central figure in both performing and promoting the festival” through his Cactus Jack and LaFlame enterprises, and that he showed a “conscious disregard for safety” by encouraging fans to bypass security and by continuing to perform as the crisis unfolded.⁶

Plaintiffs also pointed to Scott’s history at earlier shows. He was arrested at Lollapalooza in Chicago in 2015 and pleaded guilty to reckless conduct after urging fans to jump security barricades. In 2017, he pleaded guilty to disorderly conduct following a concert in Rogers, Arkansas, where several people were injured, including a security guard.⁷ Scott was deposed for about eight hours in October 2023.

In April 2024, Judge Hawkins denied Scott’s motion to be dismissed from the litigation, though she issued no written explanation.⁵ The same month, she dismissed Drake, who had appeared as a guest performer and whose attorneys argued he played no role in planning the event. Epic Records and ParaDocs Worldwide were also dismissed, while Apple, Cactus Jack Enterprises, and others remained defendants.⁸

The Wrongful Death Settlements

The first wrongful death case to settle was that of 21-year-old Axel Acosta, whose family reached a confidential agreement in October 2022 with Live Nation, Scott, and others. Attorney Tony Buzbee, who had filed a $750 million suit on behalf of the Acosta family and more than 120 other plaintiffs, confirmed the resolution but disclosed no financial terms.⁹ A source told People that Live Nation funded that settlement.¹⁰

By early May 2024, nine of the 10 wrongful death cases had been settled on the eve of what would have been the first trial.⁶ The final case, brought by the family of 9-year-old Ezra Blount, settled later that month. Ezra had been on his father’s shoulders when the crowd surge knocked them down; he died of compression asphyxia after being removed from life support. A trial had been scheduled for September 10, 2024.¹¹

All wrongful death settlement terms are protected by a gag order, and no family or attorney has publicly disclosed a dollar amount.¹²

How Much Live Nation Has Paid

Individual settlement amounts are confidential, but Live Nation’s second-quarter 2024 earnings report disclosed $280 million in total Astroworld settlement costs. The figure included an additional $94 million in accruals recognized during the quarter, which the company said it expected to cover remaining settlements.¹ Live Nation classified these costs as “significant and non-recurring” and excluded them from adjusted operating income.¹³ The same quarter’s report showed record revenue above $6 billion.

Apple’s Attempted Exit

Apple fought to be removed from the litigation, arguing that its livestream of the concert was news-gathering activity protected by the First Amendment.¹⁴ After Judge Hawkins denied Apple’s summary judgment motion, the company appealed, and the appeal placed an indefinite hold on the first wrongful death trial scheduled for May 2024. Plaintiffs’ attorneys accused Apple of bad-faith delay. Apple later paused its appeal and reached a settlement in principle with the plaintiffs.¹⁵

The Injury Cases and the Bellwether Trials

Beyond the 10 wrongful death suits, thousands of injured concertgoers filed claims. To move that mass of litigation, the court selected three bellwether cases, meant to test the strength of similar claims before a jury and guide resolution of the rest.

By October 2024, more than 300 plaintiffs had settled with Scott and Live Nation. Two of the three bellwether plaintiffs, Angel Dominguez and Elizabeth Martinez, settled before trial, and those resolutions swept in at least 300 additional cases.¹⁶ The third bellwether trial, for plaintiff Henry Nguyen, was rescheduled for late 2025, and attorneys are preparing further bellwether selections to represent the remaining claims.¹⁷

Why There Were No Criminal Charges

The civil lawsuits are separate from any criminal case, and there is no criminal case. On June 29, 2023, a Harris County grand jury declined to indict Travis Scott or five other individuals connected to the festival, including festival manager Brent Silberstein, Live Nation’s John Junell, security officials Shawna and Seyth Boardman, and BWG’s Emily Ockenden.¹⁸ Harris County District Attorney Kim Ogg said the grand jury “found that no crime did occur, that no single individual was criminally responsible.”¹⁹

Prosecutors explained that potential charges were limited to crimes of omission such as child endangerment, because manslaughter or criminally negligent homicide would have required proof of a specific act of causation, a standard the evidence did not meet.¹⁸ Ogg noted that the grand jury’s decision had no bearing on the civil lawsuits, where victims could still seek accountability through money damages.²⁰

What Is Still Pending

The wrongful death docket is closed. What remains is the injury litigation: hundreds of plaintiffs who have not yet settled, the Nguyen bellwether trial reset for late 2025, and additional bellwether selections that will shape any future group resolutions.¹⁷ Live Nation has told investors it expects its existing $280 million accrual to cover what remains.¹³ Whether a jury ever hears an Astroworld case will depend on whether the Nguyen trial proceeds or, like the ones scheduled before it, settles on the courthouse steps.
