Trevor Noah Lawsuit: HSS Malpractice Case and Trump’s Grammys Threat

Trevor Noah is connected to two lawsuits, and only one of them has actually been filed. In November 2021, Noah sued the Hospital for Special Surgery and orthopedic surgeon Dr. Riley J. Williams III in New York State Supreme Court, alleging medical malpractice tied to care he received in 2020. In February 2026, President Donald Trump publicly threatened to sue Noah for defamation over a joke about Jeffrey Epstein delivered at the Grammy Awards, but as of mid-2026 no such suit had been filed in any court.¹

The Medical Malpractice Suit Against Hospital for Special Surgery

Noah filed the 14-page verified complaint on November 29, 2021.² The defendants are Dr. Riley J. Williams III, a prominent sports medicine surgeon at the Hospital for Special Surgery in Manhattan, and HSS itself. The complaint covers care Noah received between August 25, 2020, and December 17, 2020, and states that he underwent surgery on November 23, 2020. It does not disclose the nature of the injury or the specific procedure, and federal health privacy law kept those details out of the public filing.³

What Noah Alleged

The complaint accuses Dr. Williams and HSS of a broad set of failures: failing to properly diagnose his condition, failing to refer him to appropriately skilled specialists, negligently performing examinations and surgery, failing to provide appropriate treatment, and failing to obtain proper informed consent by not advising him of the risks, hazards, and alternatives to treatment.⁴ It also alleges failures in prescribing proper medications or discontinuing certain prescriptions, and failures in using proper tests and examinations.² Against the hospital directly, the suit alleges negligence in investigating the qualifications and competence of staff before granting employment or clinical privileges.

Claimed Injuries and Damages

Noah says the alleged negligence caused him “permanent, severe, and grievous injuries,” along with physical pain, severe nervous shock, mental anguish, emotional distress, and a “loss of enjoyment of life.”⁵ The complaint states he was confined to bed and home for a long period and kept from working for an extended period. Because some injuries are described as permanent, it asserts continuing future damages. The filing does not name a dollar figure.

The Hospital’s Response and Case Status

HSS publicly called the allegations “meritless” and said it had sent Noah’s attorney a “detailed rebuttal,” while noting that federal privacy law barred it from addressing specifics of a patient’s care.³ The hospital filed its verified answer on January 6, 2022.⁶ No public reporting has emerged about a resolution. New York malpractice cases are frequently settled out of court under confidential terms, particularly for high-profile plaintiffs, and the suit was filed within the state’s two-and-a-half-year statute of limitations for such claims.

Trump’s Defamation Threat Over the 2026 Grammys Joke

Noah hosted the 68th Grammy Awards on February 1, 2026. During the show he said: “That is a Grammy that every artist wants almost as much as Trump wants Greenland, which makes sense, because Epstein’s island is gone, he needs a new one to hang out with Bill Clinton.”⁷

The next day, Trump responded on Truth Social. He called the Grammys “the WORST, virtually unwatchable,” described Noah as a “total loser,” and called the remark “false and defamatory,” insisting he had “never been to Epstein Island, nor anywhere close.” He then wrote: “It looks like I’ll be sending my lawyers to sue this poor, pathetic, talentless, dope of an M.C., and suing him for plenty$.” He added: “Get ready Noah, I’m going to have some fun with you!”⁸

Why Legal Scholars Said the Suit Would Lose

Legal experts contacted after the post agreed that any defamation claim would face steep problems. Geoffrey Stone of the University of Chicago Law School called a successful libel judgment “utterly implausible,” saying Noah’s comments were clearly understood as jokes rather than factual assertions.⁹ Laura Little of Temple University said “no reasonable listener would take this as an assertion of fact,” given the context of a comedian delivering a satirical monologue at an awards show.¹⁰

As a public figure, Trump would also have to meet the “actual malice” standard from New York Times Co. v. Sullivan (1964), which requires proof that a statement was made with knowledge of its falsity or with reckless disregard for the truth. Hustler Magazine, Inc. v. Falwell (1988) further shields satire, holding unanimously that public figures cannot recover for emotional distress caused by parody unless it contains a false statement of fact made with actual malice, and specifically noting that “outrageousness” alone cannot support liability.¹¹ Analysts also noted a practical point: unlike media corporations that have sometimes settled Trump suits to avoid business disruption, Noah would have little incentive to settle and would almost certainly prevail on the merits.¹⁰

Whether Trump Actually Sued

He did not. As of mid-2026, no formal lawsuit against Noah has been filed in any federal or state court.¹

Noah’s Response

Noah addressed the whole episode in his Netflix special Joy in the Trenches, released April 14, 2026 and filmed at the Warner Theatre in Washington, D.C.¹ He said he learned about Trump’s post on a flight without Wi-Fi, only when a stranger told him, “Trevor, you fight.” He called the Truth Social tirade a “Google review of my performance” and mocked Trump for dismissing him as “whoever he may be” while naming him and threatening to sue him in the same post.¹² On Trump’s closing line about having “fun” with him, Noah said: “If you’re not trying to sound like a sexual deviant, this is not the line I would recommend.” He also acknowledged real uncertainty: “I don’t know how to feel, because I don’t know how this will play out. With him, there is no knowing — just ask Nicolás Maduro.” He later told the Brown Daily Herald that Trump’s threats had forced him to change his original plans for the special.¹³
