Tyler Robinson Court Case: Death Penalty, Evidence, Gag Order

The Tyler Robinson court case is a Utah capital prosecution in which 23-year-old Tyler James Robinson faces seven charges, including aggravated murder, for the September 10, 2025 shooting death of conservative activist Charlie Kirk at Utah Valley University. Utah County Attorney Jeff Gray is seeking the death penalty. As of late June 2026, Robinson had not entered a plea, and a preliminary hearing was set for July 6–10, 2026 in Fourth District Court in Provo before Judge Tony Graf Jr.¹²

The Charges and Why the Death Penalty Is on the Table

On September 16, 2025, Gray filed seven counts in Fourth District Court under case number 251403576.¹³

Aggravated murder, a capital felony. The state alleges Robinson “knowingly created a great risk of death to another individual other than Charlie Kirk,” and that allegation is the aggravator making him death-eligible.
Felony discharge of a firearm causing serious bodily injury, a first-degree felony.
Two counts of obstruction of justice, second-degree felonies, for allegedly concealing the rifle and his clothing.
Two counts of tampering with a witness, third-degree felonies, for allegedly directing his roommate to delete text messages and stay silent if questioned.
One count of committing a violent offense in the presence of a child, a class A misdemeanor.

On the aggravated murder, firearm discharge, and presence-of-a-child counts, prosecutors have also filed a “victim targeting” enhancement, arguing Robinson chose Kirk because of Kirk’s political expression.¹ Gray said the decision to seek death was made “independently as county attorney based solely on the available evidence and circumstances and nature of the crime” and was not influenced by the Trump or Cox administrations.⁴

The Evidence Prosecutors Are Relying On

The state’s case combines forensic evidence, surveillance video, and statements attributed to Robinson.

DNA, the Rifle, and Statements

Prosecutors say DNA consistent with Robinson’s was found on the trigger of a Mauser Model 98 bolt-action rifle recovered in a wooded area near the scene, as well as on a fired cartridge casing, two unfired cartridges, and a towel used to wrap the weapon.⁵⁶⁷⁸

Prosecutors also point to a handwritten note Robinson allegedly left under his keyboard for his romantic partner: “I had the opportunity to take out Charlie Kirk and I’m going to take it.” In text messages afterward, he allegedly wrote, “I had enough of his hatred. Some hate can’t be negotiated out.”⁹ The FBI has said Robinson told a roommate he had been planning the attack for “a little over a week” and had discussed it in at least two Discord group chats.¹⁰ Investigators recovered four shell casings near the scene bearing engravings that mixed political references and internet humor, including “Hey fascist! Catch!”; Robinson himself dismissed the engravings as “mostly a big meme.”¹¹

The Ballistics Dispute

A central forensic fight is whether the fatal bullet can be tied to the Mauser. An ATF report dated September 17, 2025 used light comparison microscopy to compare a bullet jacket fragment recovered during Kirk’s autopsy with the rifle. The result was “inconclusive”: examiners could neither link the fragment to the rifle nor rule it out. The same report did confirm that a cartridge casing found at the scene had been fired from the rifle.¹²

The defense has framed the inconclusive finding as potentially exculpatory and filed a motion to block further FBI testing, arguing proposed methods could destroy the fragment.¹² Forensic experts told Poynter that “inconclusive” does not mean the rifle did not fire the bullet; it means the fragment was too deformed for a definitive match, a common result with high-velocity rifle rounds.¹³ This dispute became the trigger for the pretrial publicity fight that dominated the case through mid-2026.

The Defense Team and the Cost

After the court found Robinson could not afford private counsel, three attorneys were appointed. Utah County allocated $750,000 for his defense. Lead counsel Kathryn N. Nester, based in Salt Lake City, has 33 years of criminal defense experience and has worked on nine capital or aggravated murder cases. Co-counsel Michael N. Burt, based in San Francisco, has 47 years of experience and previously defended Lyle Menendez in 1993. Co-counsel Richard G. Novak, based in Pasadena, has focused on capital work for 20 years and has handled more than 25 death-eligible homicide cases.¹⁴ The prosecution team, chosen by Gray, includes Deputy County Attorneys Chad Grunander, Ryan McBride, Lauren Hunt, David Sturgill, and Chris Ballard.⁴

Pretrial Fights That Have Shaped the Case

Motion to Disqualify the Prosecutors

In late 2025, the defense moved to disqualify the entire Utah County Attorney’s Office, arguing Grunander had a conflict because his adult daughter was in the audience when Kirk was shot.¹⁵ On February 24, 2026, Judge Graf denied the motion. He found the daughter had been roughly 85 feet from the shooting, was facing away, did not realize Kirk had been shot until she fled, and was not a state witness. Gray testified the death-penalty decision was his alone and that her presence “in no way influenced” it. Graf wrote that “prosecutors need not be immune to the emotional response of others to prosecute a case.”¹⁶

The Gag Order and the Contempt Finding

Judge Graf entered a pretrial publicity order requiring attorneys to comply with Rule 3.6 of the Utah Rules of Professional Conduct, which prohibits extrajudicial statements likely to materially prejudice a criminal case. The order was meant to protect Robinson’s fair-trial right and presumption of innocence.¹⁷

After the defense filed a motion in March 2026 citing the inconclusive ATF report, Deputy County Attorney Christopher Ballard spoke to multiple outlets, including TMZ, Fox News, and USA Today, to counter what he called misinformation about the testing. The court accepted that Ballard had some latitude to correct factual misunderstandings, but Graf found he crossed the line when he told TMZ the state had “ample evidence to demonstrate beyond a reasonable doubt that Tyler Robinson committed this murder.”¹⁸

On June 26, 2026, Graf held Ballard in civil contempt, finding his comments about the overall strength of the case had a “substantial likelihood” of prejudicing potential jurors. The judge wrote that Ballard “knew of the order, possessed the ability to comply, and intentionally made the volitional statements in question.”¹⁷ The defense asked the court to strip the death penalty as a sanction. Graf denied that, calling the request “grossly disproportionate to the misconduct and legally unavailable in this civil contempt framework.”¹⁹ Instead he ordered expanded jury selection procedures, including additional questionnaires and a possible larger jury pool, and required the prosecution to pay Robinson’s legal fees tied to the contempt motion, warning that future violations could bring further sanctions.¹⁸

Where the Case Stands Now

The preliminary hearing, where prosecutors must show probable cause to send the case to trial, was originally set for May 2026 but was pushed to July 6–10, 2026 after Graf granted a defense continuance to review a large volume of evidence.² Ahead of that hearing, the judge ruled that prosecutors may present hearsay evidence, including the medical examiner’s report and federal DNA and ballistics reports, over defense objections. He also denied a defense subpoena that would have required Robinson’s former roommate to testify live, allowing the state to proceed with a video deposition instead.²⁰

Separately, Graf denied a defense request to close the preliminary hearing to the public, but barred the media from inspecting or copying exhibits introduced during the proceeding, and ruled that cameras and microphones would be permitted in the courtroom.²¹²

As of late June 2026, Robinson had not entered a plea to any of the seven counts. The death penalty remained a potential sentence. No trial date had been set. The FBI’s investigation into other people connected to the Discord chats where Robinson allegedly discussed the killing remained open, and no additional people had been charged.²²

Who Charlie Kirk Was

Kirk, 31, co-founded Turning Point USA in 2012 at age 18 and built it into one of the country’s most influential conservative youth organizations. He was a close ally of Donald Trump and played a significant role in youth voter mobilization for the 2024 election. He was shot in the neck by a single rifle round roughly twenty minutes into his “American Comeback Tour” appearance at Utah Valley University and later died from the wound.²³²⁴ Robinson was arrested on September 12, 2025 after a 33-hour manhunt, when his father recognized him from FBI-released photographs and persuaded him to surrender to the Washington County Sheriff’s Office.²⁵²⁶
