UAE Court System: Tiers, Jurisdiction, and Free Zone Courts

The UAE court system is a civil law structure built on three tiers of ordinary courts — Court of First Instance, Court of Appeal, and Court of Cassation — with a Federal Supreme Court sitting above them for constitutional and inter-emirate matters. Alongside this federal judiciary, Abu Dhabi, Dubai, and Ras Al Khaimah run their own local courts, and two financial free zones operate independent English common law courts. All of it is anchored in federal legislation and shaped by Islamic Sharia principles, with a separate civil track available to non-Muslims since 2022.

The Three Tiers of Ordinary Courts

Civil, commercial, criminal, labor, and personal status disputes all move through the same three-level ladder. Each tier has a distinct job, and knowing which one you are in tells you what the court can and cannot do with your case.

Court of First Instance

Every case starts here. Under the Civil Procedure Code (Federal Decree-Law No. 42 of 2022, which replaced Federal Law No. 11 of 1992), the Court of First Instance hears all first-instance claims unless a specific law sends them somewhere else.1UAE Legislation. Federal Decree by Law on Promulgating the Civil Procedure Code – Section: Chapter Two: Subject-Matter Jurisdiction of Courts

The composition of the bench depends on what the case is worth and how serious it is. Minor circuits, run by a single judge, handle civil, commercial, and labor claims valued at AED 500,000 or less. Major circuits of three judges take everything above that threshold.2The Official Platform of the UAE Government. The Federal Judiciary – Section: Court circuits On the criminal side, three judges hear charges carrying the death penalty or life imprisonment, and a single judge handles lesser prosecutions.

The trial judge builds the factual record that everything above depends on. Witnesses are heard, documents are admitted, court-appointed experts weigh in on technical questions, and the ruling that comes out of this stage sets the baseline for any appeal.

Court of Appeal

A party unhappy with the first-instance judgment can take it to the Court of Appeal. In civil and commercial matters, the deadline to file is thirty days from the date of the judgment. The appellate bench reviews the trial record in full and can challenge findings of both fact and law, with authority to overturn or amend the lower ruling.

Court of Cassation

The Court of Cassation is the top of the ordinary hierarchy. It does not reexamine facts or hear new evidence. The question before it is narrower: did the lower courts interpret and apply the law correctly?3Abu Dhabi Judicial Department. Court of Cassation A cassation ruling is final for the parties and helps keep legal standards consistent across the system. Filing a cassation appeal requires a security deposit of AED 2,000 with the court’s treasury, forfeited if the appeal is dismissed and refunded if the appellant wins.4UAE Legislation. The Federal Supreme Court

The Federal Supreme Court is the highest judicial body in the country. It sits in Abu Dhabi and is composed of a Chief Justice and up to five judges, appointed by presidential decree after approval from the Supreme Council.5UAE Legislation. The Constitution of the United Arab Emirates – Section: Article 96

Its jurisdiction covers matters no ordinary court can reach: disputes between emirates or between an emirate and the federal government, the constitutionality of federal and emirate-level legislation, binding interpretation of constitutional provisions, and crimes that directly threaten federal interests such as counterfeiting or offenses against national security.6UAE Legislation. The Constitution of the United Arab Emirates – Section: Article 99 It also decides jurisdictional conflicts between federal and local courts and between courts of different emirates. Any constitutional interpretation it issues binds every government authority.7UAE Legislation. Federal Decree by Law Concerning the Supreme Federal Court – Section: Article 4

The court also acts as a cassation forum for appeals against judgments from federal courts of appeal, and when it does, it can resolve the underlying dispute itself rather than sending it back down.7UAE Legislation. Federal Decree by Law Concerning the Supreme Federal Court – Section: Article 4 That dual role makes it both constitutional guardian and final check on the ordinary federal courts.

Federal Courts and Local Emirate Courts

Articles 94 through 109 of the UAE Constitution give every emirate the choice: join the federal judiciary or run its own independent court system.8The Official Platform of the UAE Government. The Federal Judiciary Federal courts handle civil, commercial, and administrative disputes involving the federal government, crimes committed in the federal capital, and personal status cases arising there.9UAE Legislation. The Constitution of the United Arab Emirates – Section: Article 102 Local courts in each emirate take everything else.

Abu Dhabi, Dubai, and Ras Al Khaimah run their own independent judicial departments. The remaining emirates participate in the federal system.8The Official Platform of the UAE Government. The Federal Judiciary The split is administrative, not substantive. All of these courts apply the same federal legislation. A contract dispute governed by the UAE Civil Code plays out under the same rules in a Dubai courtroom as in a Sharjah one. The separation is really about who hires the judges, manages the court buildings, and processes the files.

Common Law Courts in the Financial Free Zones

Two financial free zones sit outside the civil law system entirely. The Dubai International Financial Centre and the Abu Dhabi Global Market operate their own independent common law courts. They apply English common law, conduct proceedings in English, and recruit judges largely from the UK and other common law jurisdictions.10Abu Dhabi Global Market. The English Common Law System The point is to give international business a predictable, familiar forum for commercial disputes.

The ADGM Courts apply English common law and equity directly through the Application of English Law Regulations 2015, along with established English civil statutes adapted to the zone.10Abu Dhabi Global Market. The English Common Law System The ADGM court is organized into commercial and civil, real property, employment, and small claims divisions. The DIFC Courts have broader reach in some respects, including the power to grant worldwide freezing orders in support of foreign litigation and to serve as a conduit for recognizing and enforcing foreign judgments in onshore Dubai.

Having two legal traditions in one country produces jurisdictional friction. A Conflicts of Jurisdiction Tribunal decides which system has authority when a dispute straddles the boundary between a free zone court and an onshore court. For anyone contracting through these zones, opting in means playing by procedural rules unlike those used across the rest of the country.

Specialized Divisions Within Each Court

Inside each court level, cases are routed to subject-matter divisions. Civil divisions handle contracts, property, and tort claims. Criminal divisions take penal code violations. Commercial divisions cover corporate governance, trade disputes, and insolvency. Labor divisions apply employment law to disputes over wages, termination, and working conditions.

Personal status courts handle marriage, divorce, custody, alimony, wills, and inheritance. For Muslim litigants, these courts apply Sharia principles.

The Non-Muslim Civil Personal Status Track

Federal Decree-Law No. 41 of 2022 created a separate personal status framework for non-Muslims. It applies automatically to non-Muslim UAE citizens and non-Muslim foreign residents unless they specifically choose the law of their home country instead.11UAE Legislation. Federal Decree-Law On Civil Personal Status – Section: Article 1

Civil marriage under this law requires both spouses to be at least 21 and to consent before an authentication judge. Either spouse can request divorce without proving fault, and the court grants it at the first hearing with no mandatory referral to family guidance committees. Custody after divorce is shared equally as a joint right until the child turns 18, when the child chooses.12UAE Legislation. Federal Decree-Law On Civil Personal Status – Section: Article 10

Inheritance also looks different. Where someone dies without a will, half the estate goes to the surviving spouse and the other half is divided equally among the children regardless of gender. If there are no children, the estate passes to parents, then siblings, in a defined order.13UAE Legislation. Federal Decree-Law On Civil Personal Status – Section: Article 11 Non-Muslim foreign heirs can also ask for their home country’s inheritance law to apply instead. The default rules take over automatically if no will or home-country election exists, which catches more people than you would expect.

How Proceedings Actually Work

Arabic is the official language of the standard court system. Every document filed must be translated into Arabic by a licensed legal translator to be valid evidence. In criminal cases the court bears the cost of translation assistance, and unregistered translators can be used when necessity demands, provided they take a legal oath.14UAE Legislation. Federal Decree by Law No. (22) of 2022 Regulating the Translation Profession

Procedure follows an inquisitorial model, not the adversarial system familiar to US and UK lawyers. The judge actively directs the investigation, questions witnesses, and works to establish the facts rather than refereeing between counsel. There are no juries. Judges decide both fact and law, whether sitting alone or in panels of three.2The Official Platform of the UAE Government. The Federal Judiciary – Section: Court circuits

Courts routinely appoint neutral experts on technical, financial, or scientific questions. These experts work for the court, not either party. In practice their findings often decide the outcome, as courts tend to adopt their conclusions unless procedural defects or methodological errors are shown. The party requesting the expert deposits the estimated fees with the court, and failing to pay can forfeit the appointment.

One point surprises common law lawyers: the UAE does not follow binding precedent. A lower court is not formally required to apply a higher court’s earlier ruling on the same legal question. Higher court decisions still carry weight in practice, and judges rarely depart from established positions of the Court of Cassation or the Federal Supreme Court without good reason.

Who Can Represent You, and What It Costs

Only lawyers on the Roll of Practicing Lawyers maintained by the Ministry of Justice can represent clients before UAE courts. Admission requires UAE citizenship, a law degree, completion of a training period, written exams and an interview, professional liability insurance, and a clean criminal record. Appearance before the Federal Supreme Court requires a separate, specific admission.15UAE Legislation. Federal Decree-Law No. 34 of 2022 Concerning the Regulation of the Legal Profession and Legal Consultation Profession – Section: Article 7

Non-UAE nationals can practice only under restrictive conditions. They must have at least fifteen years of experience, remain registered as a practicing lawyer in their home country, and be a partner of a foreign law firm licensed in the UAE. Even then, they cannot appear in criminal, administrative, family, or Muslim personal status proceedings. A spouse, in-law, or blood relative up to the fourth degree can represent you without being a licensed lawyer.16UAE Legislation. Federal Decree-Law No. 34 of 2022 Concerning the Regulation of the Legal Profession and Legal Consultation Profession – Section: Article 8 Powers of attorney for court use must be in writing, signed before a public notary, and clearly scoped. Open-ended authorizations will not be accepted.

Court fees in the federal system follow a schedule attached to Federal Law No. 13 of 2016 on judicial fees, with the Cabinet authorized to adjust fees by up to 50 percent from the schedule.4UAE Legislation. Federal Law No. (13) of 2016 Concerning Judicial Fees Before Federal Courts Claim value is calculated from the demands stated at filing, and claims in foreign currency are converted to dirhams at the exchange rate on the date of filing.

Several categories of litigants are exempt from court fees entirely: federal and local government agencies, public utility institutions, workers filing labor claims, persons with disabilities, and parties in certain personal status matters such as alimony disputes.4UAE Legislation. Federal Law No. (13) of 2016 Concerning Judicial Fees Before Federal Courts The worker exemption is worth flagging. Many employees assume they need to budget filing fees before pursuing an unpaid wages claim, and they do not.
