UpEquity, the Austin-based mortgage technology company, is a party to several active lawsuits, including a Texas contract dispute now on appeal, a federal default judgment out of Florida, and mortgage foreclosure actions filed by its subsidiary entities. Most of the UpEquity lawsuit activity in public records traces back to the company’s “Buy Before You Sell” program and the network of special purpose vehicles it uses to purchase and hold homes.
The Program Behind the Disputes
UpEquity markets its flagship product under names like “Trade Up” and “Equity Advance.” The company makes a guaranteed offer on a homeowner’s existing property at what it calls full market value, pays out in two installments, and steps in to actually buy the old home only if no third-party buyer emerges within six months.1UpEquity.
