USA Insulation Lawsuit: Kumar Ruling, Arbitration, and Your Claim

The work was performed in March 2017. Kumar was unhappy with its effectiveness, and USA Insulation asked to return to the home to address possible shrinkage or missed areas. According to the appeals court, Kumar resisted or refused those return visits until after she had already filed suit. The practical lesson from the decision: a homeowner who refuses to let the installer come back and inspect or correct the work can lose the case on that fact alone.

Electrical wiring damage. A New Hampshire homeowner alleged that crews used reciprocating saws to cut through foam and damaged newly installed second-floor wiring. Air quality and health concerns. Several complaints describe overwhelming chemical or toxic odors after spray foam installation, alleging poorly mixed or applied product. A Michigan homeowner described a 2023 installation that allegedly overfilled walls and caused bowing, cracked interior trim and drywall, cracked and bulged exterior brick around windows, and later water damage. How the Company Typically Responds

The Arbitration Clause and Class Action Waiver

The severability language is worth reading carefully. If some part of the arbitration clause is found unenforceable, the rest stays in effect. But if the class action waiver specifically is struck down, the entire arbitration provision becomes void.5USA Insulation Franchise. What This Means If You Have a Claim

If your contract postdates August 2023 and incorporates the current Terms of Use, a court lawsuit is likely off the table and a class action is barred; your options narrow to individual JAMS arbitration or small claims court for a qualifying amount. If the company asks to come back and inspect or repair the work, the Kumar decision suggests that refusing those visits can undercut a later breach of contract claim. Document the condition of the home, keep every invoice from any remediation or repair contractor you hire, and preserve written communications with both USA Insulation and any project financier before deciding which forum to use.
