No one has been charged over the Signal chat leak. Legal scholars flagged two serious exposures when the story broke in March 2025: the Espionage Act’s gross-negligence provision and federal recordkeeping laws. The Justice Department did not open an investigation, and the Pentagon Inspector General’s December 2025 report found that Defense Secretary Pete Hegseth violated department policy and created operational risk without recommending any discipline against him. The practical penalties so far have been political, not criminal.
What the Signal Chat Leak Involved
On March 13, 2025, National Security Adviser Michael Waltz created a Signal group he called “Houthi PC small group” to coordinate a U.S. military strike in Yemen. Waltz inadvertently added Jeffrey Goldberg, the editor-in-chief of The Atlantic, who then watched senior officials discuss the operation for several days.1CNN. Yemen War Plans Signal Chat Annotated
On March 15 at 11:44 a.m. Eastern, Hegseth posted a “TEAM UPDATE” with weapons packages, targets, attack sequencing, and the timing of F-18 launches, drone strikes, and Tomahawk missile launches. The update correctly predicted the start of the bombing at 1:45 p.m. ET.2The Atlantic. A separate Signal group Hegseth created in January 2025, called “Defense | Team Huddle,” received the same operational details on March 15. That chat included his wife Jennifer Rauchet (not a Defense Department employee), his brother Phil Hegseth, his personal attorney Tim Parlatore, and about ten others from his personal and professional circle.4The New York Times. The sharing happened on Signal despite a Defense Department Chief Information Officer memorandum from October 6, 2023, that explicitly barred Signal, iMessage, and WhatsApp from being used to transmit nonpublic DoD information, including Controlled Unclassified Information.5Department of Defense CIO. Which Laws the Leak Potentially Violated
The Espionage Act
The most serious statute in play was 18 U.S.C. § 793, part of the Espionage Act. It penalizes anyone who, through “gross negligence,” permits information “relating to the national defense” to be delivered to someone unauthorized to receive it. The maximum sentence is ten years.7FactCheck.org. Was the Signal Chat Illegal
Former CIA officer Kevin Carroll told reporters the chat was “100%” a violation. Stanford law professor David Alan Sklansky said there were “grounds for suspecting that gross negligence was involved,” while cautioning that whether the conduct crossed the “egregious” threshold would be a jury question.7FactCheck.org. Was the Signal Chat Illegal
One point matters for anyone reading the administration’s defense that nothing was marked “classified.” The statute does not require formal classification. It covers “national defense information” that could help an adversary and is closely held by the government. Timing and sequencing of a live air operation fit that category whether or not a classification stamp was ever applied.
Federal Records Laws
Signal’s auto-delete feature triggered a second set of concerns under the Federal Records Act and the Presidential Records Act. Messages in the “Houthi PC small group” were set to disappear after one and four weeks.8House Oversight Democrats. Oversight Democrats Demand Investigation Into Purposeful Deletion Under a 2014 update to the Federal Records Act, federal employees using non-official messaging accounts must forward a complete copy of official communications to an official account within 20 days.9National Archives. AC 23-2025 Memorandum There is no indication that was done.
George Washington Law professor Anne Weismann told The New York Times that when a defense secretary participates in a conversation about planning an attack, “I think it’s hard to argue there’s any circumstance in which that would not be appropriate for preservation.”10The New York Times. Signal Messages Disappear
Why No Charges Were Filed
Prosecution requires a prosecutor, and the Department of Justice under Attorney General Pam Bondi did not open an inquiry. The administration showed no interest in investigating itself.11PBS NewsHour. Bipartisan Senators Request Pentagon Investigation Into Use of Signal App
The closest historical comparison is the FBI’s 2016 investigation of Hillary Clinton’s private email server. That inquiry ended without charges after then-FBI Director James Comey concluded there was no clear evidence of criminal intent and that “no reasonable prosecutor” would bring a case.12KCRA. Trump Clinton Email Probe Classified Records Case Differences The gross-negligence standard in § 793 does not require intent, but the Comey precedent set a high practical bar for charging senior officials over mishandled defense information.
Hegseth also had a structural defense available to no ordinary leaker: as Secretary of Defense, he is an Original Classification Authority, with legal power to decide what is and is not classified. He used that authority in his written response to investigators, saying the material he shared was either unclassified or something he could “safely declassify.”13Lawfare. What the Pentagon Inspector General Found
The Defense Department Inspector General delivered its final report (DODIG-2026-021) to Hegseth on December 2, 2025. Investigators found that the information Hegseth sent via Signal on March 15 matched operational details that CENTCOM had classified as SECRET//NOFORN in an email to the Secretary the day before.14Department of Defense Inspector General. DODIG-2026-021 Report The report concluded that using Signal on a personal phone to transmit the quantity and timing of manned U.S. aircraft strikes over hostile territory “created a risk to operational security that could have resulted in failed U.S. mission objectives and potential harm to U.S. pilots.”15FactCheck.org. Pentagon Inspector General Report Not Total Exoneration for Hegseth
The IG accepted Hegseth’s claim of classification authority, which neutralized the formal classified-information question, while noting that no documentation of any declassification decision existed.16CNN. Report Hegseth Signal The report separately found that neither Hegseth nor the Office of the Secretary of Defense retained records of the Signal conversations, violating federal recordkeeping requirements.17Breaking Defense. Signalgate IG Report: Hegseth Risked Harm to Mission With Texts
Despite those findings, the IG made no recommendations specific to Hegseth’s conduct. The only formal recommendation was that CENTCOM review its classification procedures. Pentagon chief spokesperson Sean Parnell called the report a “TOTAL exoneration” and said the “case is closed.”17Breaking Defense. Signalgate IG Report: Hegseth Risked Harm to Mission With Texts
Consequences for the Officials Involved
Mike Waltz
Waltz took “full responsibility” for creating the chat and adding Goldberg. He was removed as national security adviser in May 2025, though Politico reported the firing was driven mainly by his hawkish Iran posture and his tendency to act as a principal rather than a staffer, not by Signalgate directly.18Politico. Pete Hegseth
Hegseth faced no formal disciplinary action. Trump publicly backed him, and the IG report’s December 2025 release produced no further consequences.16CNN. Fired Pentagon Aides
Three officials in Hegseth’s orbit were fired on April 15, 2025, during a broader Pentagon leak investigation: senior adviser Dan Caldwell, deputy chief of staff Darin Selnick, and Colin Carroll, chief of staff to the deputy defense secretary. All three denied leaking. Caldwell called the firings a “purge” driven by “personal vendettas,” saying he was never told the reason, never polygraphed, and never asked to surrender his phone.22Politico. Fired Pentagon Adviser Threatened Established Interests Hegseth’s chief of staff Joe Kasper also departed around that time, and former Pentagon spokesperson John Ullyot resigned, describing a “full-blown meltdown.”23New York Magazine. The Air Force Office of Special Investigations opened a separate inquiry into whether Ricky Buria, a senior Hegseth aide, acted as a source for unauthorized disclosures. OSI investigators also questioned witnesses about whether Buria or attorney Tim Parlatore had asked for Signal messages to be deleted from phones, which could itself violate federal records laws.24Politico. The Records-Preservation Lawsuit
The watchdog group American Oversight sued Hegseth, Director of National Intelligence Tulsi Gabbard, CIA Director John Ratcliffe, Treasury Secretary Scott Bessent, Secretary Rubio, and the National Archives in the U.S. District Court for the District of Columbia (Case No. 25-0883), seeking to force preservation of Signal messages used for official business.25American Oversight. Judge James Boasberg issued a temporary restraining order on March 27, 2025, requiring the named officials to make best efforts to preserve Signal communications from March 11 through March 15.26ABC News. Messages Yemen War Plans Inadvertently Shared Reporter Timeline In June 2025, Boasberg issued a partial ruling ordering officials to notify the acting archivist of any messages still at risk of deletion. He declined to order recovery of messages already lost to auto-delete, finding that American Oversight had not shown the court could provide a remedy for what was already gone.27NPR. The administration’s position throughout was that no classified information was shared. Hegseth described the exchanges as “informal, unclassified coordinations.” White House spokesperson Karoline Leavitt declared the case “closed” on March 31, 2025, saying “steps had been taken” to prevent a recurrence without specifying what those steps were.29Al Jazeera.
