Vantage Travel Lawsuit: Bankruptcy, Refunds, and Hank Lewis

The Vantage Travel lawsuit story is really several lawsuits: Pennsylvania and New York both sued the Boston-based tour operator and its owner Henry “Hank” Lewis in 2023 over a refund scheme that relabeled canceled trips as “postponements,” and the company filed for Chapter 11 bankruptcy that June owing roughly $110 million to nearly 10,000 customers. Those customers did not get cash back. Under the bankruptcy sale, they received travel credits toward a successor company, with caps and an expiration date that leave most of the money unrecoverable.

The Refund Tactic That Triggered the Lawsuits

Vantage’s own Tour Participation Agreement required a full cash refund when the company canceled a trip. A postponed trip carried no such obligation. So when Vantage could not deliver, it announced postponements instead of cancellations. Between March 2020 and August 2021, the company issued ten formal announcements postponing or suspending tours, many signed personally by Lewis.

Customers who then tried to cancel the rescheduled trips themselves ran into Vantage’s standard cancellation fee schedule, which could claim up to 100% of the purchase price. Many had paid $10,000 or more per package. The company also marketed a “risk-free cancellation policy” and a Travel Protection Plan advertised as offering “100% coverage” with “no restrictions or fine print.” According to the state lawsuits, claims under the plan were routinely denied, with Vantage citing the postponement status of the trip or arguing that pandemic safety concerns fell outside the plan’s terms.

The Pennsylvania Lawsuit

Pennsylvania sued first. Attorney General Michelle A. Henry filed on June 8, 2023, in the Court of Common Pleas of Allegheny County, naming both Vantage Travel Services, Inc. and Henry Roland Lewis individually.1Pennsylvania Attorney General. Henry said in a statement that “Vantage took advantage of older Pennsylvanians by continuing to hold their refunds hostage.” Many of the affected customers were 60 or older. The state sought permanent injunctive relief, consumer restitution, civil penalties, and legal costs.

The New York Lawsuit

New York Attorney General Letitia James filed on September 12, 2023, in the Supreme Court of New York County, bringing claims under Executive Law § 63(12) and General Business Law § 349.3New York Attorney General. Lewis The complaint represented more than 100 consumers, many seniors who had paid $10,000 or more per tour, and alleged that Lewis was personally aware of refund complaints from July 2020 through February 2021 but failed to offer either a rescheduling date or a refund.

The proceedings against the corporate entity resolved on July 25, 2024, through a Stipulated Order for Permanent Injunction, Monetary Judgment, and Other Relief. The bankruptcy court had limited the AG’s ability to seek restitution directly from Vantage but allowed the pursuit of injunctive relief and civil penalties. Why Massachusetts Never Sued

Vantage was headquartered in Massachusetts, and the Massachusetts AG’s office received the highest volume of complaints, at least 793 since January 2020 and 156 in 2023 alone.5Boston.com. Complaints Mount Against Mass-Based Travel Company Before the bankruptcy filing, the office’s Consumer Advocacy and Response Division recovered more than $1.2 million in refunds for consumers, though only $78,000 of that was secured for six individuals in 2023.6WCVB. Despite that volume, the state did not file suit. Attorney General Andrea Campbell said in September 2023 that her office’s “hands” were tied by the bankruptcy and that the “best avenue” was to help customers navigate the bankruptcy case rather than file a separate action. New York took the opposite view, arguing it could exercise its “police powers” to sue despite the bankruptcy.

The Collapse and Bankruptcy Sale

Vantage abruptly ceased operations on June 12, 2023. Its ships were docked in Europe, employees reportedly went unpaid, and Allianz terminated the relationship, saying Vantage was “no longer authorized to offer our insurance products.”7Travel Agent Central. At an August 2023 auction, Pacific Travel Partners, Inc., a subsidiary of Aurora Expeditions created for the acquisition, won with a $2 million bid for Vantage’s intellectual property, customer lists, and prospecting data. What Former Customers Actually Got Back

Under the bankruptcy sale, former Vantage customers received travel credits equal to 100% of what they were owed, but only as credits toward future trips with Vantage Explorations or Aurora Expeditions. No cash. The credits carry sharp restrictions:11Vantage Explorations. Terms and Conditions

  • On ocean voyages, credits can cover up to 50% of the list price of the cruise component.
  • On river cruises and land tours, credits can cover up to 20% of list price.
  • All credits must be used for trips departing before November 30, 2028.
  • Credit holders are not entitled to a cash refund under any circumstances.
  • Credits cannot be applied to airfares, pre- or post-trip activities, or bookings made through travel agents.

The usage caps do the real work here. A customer owed $10,000 has to book enough new trips to absorb the credit and pay the remaining 50% to 80% of each trip’s price out of pocket. Customers who had already recovered their money through credit card chargebacks or travel insurance were excluded from the credit program entirely.10Consumer Rescue. Where the Case Against Hank Lewis Stands

Lewis held every meaningful title at Vantage. According to the Massachusetts Corporations Division, he served simultaneously as president, treasurer, secretary, CEO, CFO, and director, and owned 100% of the company’s stock.1Pennsylvania Attorney General. Vantage Travel Services, Inc. and Henry Roland Lewis — Complaint Both state complaints alleged that he personally “approved, endorsed, directed, ratified, controlled and/or otherwise participated” in the deceptive practices.

The New York case against Lewis individually remains active. On May 8, 2025, the court denied his motion to dismiss and granted the AG leave to conduct limited jurisdictional discovery. Inside the bankruptcy, the Creditor Trustee filed a motion in April 2024 seeking authority to conduct Rule 2004 examinations and formal document discovery against Lewis and entities he controls. The trustee described the financial dealings between Lewis and Vantage as a “hodge podge of transactions” and sought bank statements, communications, and records of payments, salary, dividends, and benefits Lewis received from the company, with the stated goal of determining whether claims such as piercing the corporate veil or disgorgement could be pursued.12Stretto.
