Vape Lawsuit: Juul Settlements, Battery Cases, and AG Actions

A vape lawsuit can mean several very different things: a personal injury claim over lung disease, nicotine addiction, or a battery explosion; a state attorney general action against distributors of unauthorized flavored products; a federal seizure case; or a consumer class action over pricing. The largest wave, aimed at Juul Labs, has mostly settled, with Juul and its investor Altria agreeing to pay more than $2 billion.1Coram AI. What Kinds of Vape Lawsuits Exist

Claims against vaping companies fall into a few recognizable groups, and which one fits your situation determines what, if anything, you can still do.

Lung injury cases center on EVALI — e-cigarette or vaping use-associated lung injury — which the CDC first recognized in August 2019. By January 2020, at least 60 deaths had been attributed to the condition, and vitamin E acetate was found in the lung fluid of 94% of EVALI patients examined. Between 75% and 80% of patients had used THC-containing products, most obtained from illicit sources, which makes suing anyone recoverable difficult for people who bought on the black market.3TorHoerman Law. Nicotine addiction and youth-targeted marketing cases, usually brought by minors or their parents, allege that companies used candy and fruit flavors, social media campaigns, and sleek device designs to attract young users while hiding how addictive their high-nicotine formulations were.4Courthouse News Service. Battery Explosion Cases

Battery explosion suits predate the Juul wave and continue to produce individual verdicts. A South Florida jury in Ortego v. Vapor Life LLC is no longer an active company, which complicates collection.5Enjuris. Exploding E-Cigarette Verdict A New Mexico court in Snelling v. State Attorneys General Are Now Going After Distributors

With Juul mostly resolved, state attorneys general have shifted focus to the distributors and retailers moving flavored disposable vapes that lack FDA authorization.

In February 2025, New York Attorney General Letitia James filed a nearly 200-page complaint in Manhattan federal court against 16 corporate and individual defendants, including distributors Demand Vape, Evo Brands, Safa Goods, and Midwest Goods, along with manufacturers Puff Bar and MYLE Vape.14New York Attorney General. Attorney General James Sues Nation’s Largest Vape Distributors Fueling Youth The suit alleges the defendants pushed fruit- and candy-flavored products with names like “Baja Slushie” and “Strawberry Cereal Donut Milk” into hundreds of New York convenience stores and gas stations in violation of the state’s 2020 flavored vapor ban, and that the products were shipped into the U.S. mislabeled as batteries or cell phones.15Reuters. One obstacle has emerged for these state cases. In December 2025, the Ohio Court of Appeals ruled in State ex rel. Yost v. Elevate Smoke, LLC that state consumer-protection claims against a vaping retailer were impliedly preempted by the federal Tobacco Control Act, reasoning the state was effectively trying to enforce federal premarket-authorization rules that under the Buckman doctrine fall exclusively to the FDA.19Ohio Court of Appeals. State ex rel. Yost v. Elevate Smoke LLC If other courts follow Ohio’s lead, state consumer-protection suits against unauthorized-vape retailers may become harder to sustain.

Federal Seizures and Why Most Vapes on Shelves Are Illegal

Under federal law, every electronic nicotine delivery system needs FDA premarket authorization before it can be sold. As of mid-2025, only 39 e-cigarette products from four manufacturers had received that authorization, which means the vast majority of products on store shelves are technically illegal.20U.S. Food and Drug Administration. Advisory and Enforcement Actions Against Industry – Unauthorized Tobacco Products

Federal enforcement has moved from warning letters to physical seizures. The Juul Antitrust Class Action Still Open to Consumers

One consumer-facing case against Juul remains live. In In re: Juul Labs, Inc. Antitrust Litigation (Case No. 20-cv-02345) in the Northern District of California, plaintiffs allege Altria and Juul conspired to restrain competition in the closed-system e-cigarette market. The court certified a nationwide class of consumers who bought e-cigarette products directly from Juul between October 5, 2018, and February 26, 2026, with trial set for September 28, 2026. A separate proceeding covers indirect purchasers who bought Juul products at retail stores.27PR Newswire. Juul Labs Antitrust Class Action Notice

On April 27, 2026, the Ninth Circuit granted Altria leave to appeal the class certification order, with critics arguing the district court wrongly applied California’s Cartwright Act to nationwide transactions.28Washington Legal Foundation. Two 2025 Supreme Court Rulings That Shape What Can Succeed

In FDA v. Wages and White Lion Investments, LLC (No. 23-1038), decided April 2, 2025, the Court unanimously held that the FDA did not act arbitrarily when it denied marketing authorization for flavored e-cigarette products, finding the agency had broad discretion over what scientific evidence to require. The case was remanded for the Fifth Circuit to consider one remaining issue about whether the FDA should have evaluated certain marketing plans the companies submitted.29SCOTUSblog. Justices Let FDA Denial of Vape Flavorings Stand

In FDA v. R.J. Reynolds Vapor Co. (No. 23-1187), decided June 20, 2025, the Court held that retailers “adversely affected” by an FDA marketing denial order have standing to seek judicial review, not just the manufacturers, because retailers face lost profits and potential criminal penalties from selling unauthorized products.30U.S. Supreme Court. FDA v. R.J. Reynolds Vapor Co.

Together those decisions mean the FDA’s denials of flavored-vape applications are hard to overturn in court, but retailers now have their own route to challenge specific denials. For anyone considering a personal injury or product claim, the practical path runs through a plaintiffs’ attorney who handles vaping cases, who can assess which theories still have a timely cause of action and which defendants are reachable given the overseas manufacturing picture.
