Vegas Dave Lawsuit: $30M Judgment, Countersuit, and Appeal

The Vegas Dave lawsuit ended in a July 30, 2025 judgment ordering sports betting influencer David Oancea to pay luxury villa rental company Cabo Platinum more than $30.2 million after a Clark County judge found he sabotaged the company’s business, canceled dozens of prepaid guest bookings, and ran a public campaign of false accusations against its owners. Oancea has appealed and denies owning the assets the court has ordered him to surrender. Cabo Platinum’s attorneys call that a “con game,” and a contempt hearing is now pending.

What Oancea Did to Cabo Platinum

Cabo Platinum is a Los Cabos luxury villa rental and concierge company founded in 2017 by Mishan Andre and Danette Reid, managing close to 100 properties.¹ The relationship with Oancea began in 2016, when the company started renting a villa he owned and later took on additional properties he acquired in the area.²

In April 2024, Oancea abruptly fired Cabo Platinum as the rental agency for his properties. According to the company’s lawsuit, he then canceled 24 confirmed and prepaid bookings, including reservations for weddings and major events, while keeping the deposits guests had already paid.²¹ He blocked guests from accessing his properties, then contacted them directly and told them to cancel their Cabo Platinum reservations, demand refunds, and rebook through him.³ Cabo Platinum scrambled to find last-minute alternative villas for international guests and absorbed the refund and replacement costs.

The lawsuit also alleged that Oancea used Cabo Platinum’s confidential homeowner contact list to send emails accusing Andre and Reid of fraud, embezzlement, theft, and failing to keep proper financial records.³ He publicly claimed the FBI was investigating Andre and, according to the court, ran a social media campaign that included obscene attacks on Andre and advertisements dressed up as news articles aimed at the Los Cabos tourism market.¹ Cabo Platinum’s owners denied all of the accusations.

How the Court Ruled

Both sides sued in Clark County District Court in May 2024. In Cabo Platinum’s case (No. A-24-892991-B), District Judge Timothy Williams granted a preliminary injunction ordering Oancea to stop blocking property access, followed by a permanent injunction in October 2024 barring him from possessing or using the company’s confidential homeowners list. The court later found Oancea had repeatedly ignored both orders and falsely claimed to have destroyed the misappropriated information.¹

On June 30, 2025, Judge Williams ruled in favor of Cabo Platinum on claims of intentional interference with contractual relations, misappropriation of trade secrets, business disparagement, and breach of contract.¹ A 19-page judgment issued on July 30, 2025 ordered Oancea to pay Andre and Reid more than $30.2 million: roughly $10 million in actual damages plus punitive damages and interest.³

Judge Williams wrote that Oancea acted with “the intent to harm Cabo Platinum and its reputation” and that his conduct was “despicable,” subjecting the company to “cruel and unjust hardship.”³ Andre later estimated he and Reid spent $2.5 million in legal fees.¹

Oancea’s Countersuit Was Dismissed

Oancea filed his own suit alleging breach of contract, fraud, and unjust enrichment, claiming he had not received profits from his properties since 2021. District Judge Maria Gall dismissed all of his claims.³

The Fight Over Collecting the Money

On September 9, 2025, Judge Williams ordered Oancea to surrender specific assets within two weeks to begin satisfying the judgment: three Mexican villas in San Jose del Cabo and Cabo San Lucas that Oancea had previously valued at approximately $40 million; a Richard Mille watch he had valued at around $400,000; a Hermès Birkin bag collection he had claimed was worth $1.3 million; and cryptocurrency holdings.⁴

Oancea told the court he no longer owned any of it. His attorneys said the three Mexican properties had been transferred to his 83-year-old father in December 2023, the Birkin bags were sold before the lawsuit was filed, the Richard Mille watch was lost or stolen in March or April 2025, and his cryptocurrency accounts were liquidated after he lost roughly $3 million in what he called a “fraudulent scheme.” He did not file a police report about the watch. In a court declaration, he said his social media posts showing cryptocurrency purchases were made “for enhancing my image,” and that he sometimes reposted old photos from 2019 to appear wealthier than he was.⁴

Cabo Platinum’s attorney, Daniel McNutt, called the defense a “con game.” He noted that Oancea had declared under oath in June 2024 that he still owned the Mexican properties, and only later claimed to have forgotten transferring $40 million in real estate to his father just before the litigation began. McNutt’s team alleged the property transfer documents Oancea produced were “altered/forged,” and on the watch he asked the court: “Who loses a $400,000 watch and does not submit a police report?”⁴

In November 2025, Judge Williams granted Cabo Platinum’s request for an order to show cause, requiring Oancea to appear and explain why he should not be held in contempt and potentially jailed for failing to comply with the asset turnover orders.⁴

Appeal and Current Status

Oancea’s attorney filed a notice of appeal of the $30.2 million judgment in August 2025.³ As of late November 2025 reporting, the appeal had not been briefed or decided, and the trial court proceedings over subpoenas, garnishment, and the contempt motion remained active.¹

Who Vegas Dave Is

Oancea built a large Instagram following that projects wealth through luxury cars, designer accessories, and courtside NBA seats. He sells sports betting picks as a “sports information consultant,” with packages ranging from a $199 daily card to a $995 game of the week.⁵ He gained wider notoriety through long-shot bets, including a claimed $2.3 million payout on a Denver Broncos wager.⁶

The image and the finances have not always matched. Oancea filed for bankruptcy in 2002 with $820 in assets and had a home foreclosed in 2010, and he later admitted to a gambling addiction and losing all his income over a five-to-eight-year stretch.⁵ That gap between the persona and the balance sheet is now the central question in whether Cabo Platinum ever collects on its $30 million judgment.
