How Much Claimants Are Getting
Individual amounts vary widely based on how many surcharges each person reported. Claimants posting on online forums have described receiving anywhere from under $4 to more than $2,400, with payouts estimated at roughly 23% to 38% of claimed ATM overcharges.4Open Class Actions. Payouts came out larger than a typical class action for a specific reason. Around 63.5 million claims were filed. After A.B. Data’s fraud analysis, only 296,877 survived as valid, meaning more than 99.5% of submissions were rejected.1LawNews. What the Lawsuit Was About
The case, Mackmin v. Visa Inc. (Case No. 1:11-cv-01831-RJL-MAU), was filed on October 17, 2011, in the U.S. District Court for the District of Columbia.5Hagens Berman. Visa and Mastercard ATM Fees Lawsuit Plaintiffs alleged that Visa and Mastercard violated federal antitrust law through “Access Fee Rules” that required ATM operators to charge the same surcharge no matter which network processed the transaction, blocking operators from offering lower fees on cheaper rival networks like Star or NYCE.6SCOTUSblog. Visa and Mastercard agreed in May 2024 to pay $197.5 million to end the case, with Visa contributing $104.675 million and Mastercard $92.825 million.7ClassAction.org. Who Was Eligible
The class covered anyone who paid an unreimbursed ATM surcharge on a “foreign” ATM transaction — using an ATM owned by an entity other than the one that issued the card — between October 1, 2007, and July 26, 2024. Anyone who received payment from the earlier bank settlement was carried into the Visa/Mastercard settlement automatically, unless they had paid additional surcharges after that prior claim.7ClassAction.org. What This Settlement Is Not
Two other Visa/Mastercard-related cases regularly get mistaken for this one. The $5.5 billion merchant interchange fee settlement resolves claims by businesses that accepted Visa or Mastercard between 2004 and 2019 over “swipe fees” — a separate case with its own claim process for merchants, not consumers.10Payment Card Settlement.
