Vons Price Overcharge Settlement: Allegations, Reforms, and Reporting

Vons, along with sister chains Safeway and Albertsons, agreed in October 2024 to pay nearly $4 million to settle a Vons price overcharge lawsuit brought by seven California district attorneys. The case alleged the stores charged higher prices at the register than they advertised on the shelf, and mislabeled the weight of meat, produce, and baked goods by including packaging in the weight. Individual shoppers do not receive money from the settlement, but every Vons, Albertsons, and Safeway store in California is now required to give an overcharged customer the item free (if it costs $5 or less) or a $5 gift card plus the corrected price (if it costs more).

What The Stores Were Accused Of

Prosecutors from Sonoma, Alameda, Los Angeles, Marin, Riverside, San Diego, and Ventura counties filed the complaint in Marin County Superior Court against Albertsons Companies, Safeway Inc., and The Vons Companies, covering 589 California stores.¹

The complaint described two main problems. Shoppers were charged prices at the register that exceeded the lowest advertised or posted price on the shelf. And items sold by weight carried labels overstating how much product was inside, because the stores were improperly including the weight of packaging in the price. California law requires grocers to charge only for the actual weight of the product itself, and Business and Professions Code sections 12023 and 12024 make it a misdemeanor to sell a commodity by gross weight or in less quantity than represented.²³

Prosecutors also alleged the companies failed to clearly disclose exclusions in their “Just for U” and “Club Card” loyalty programs, leaving customers unaware that certain deals did not apply to all advertised products.⁴

What The Settlement Requires

Marin County Superior Court Judge Sheila Lichtblau signed the stipulated judgment in September 2024. It was announced publicly on October 3, 2024. The total payment is $3,962,500: $3,213,000 in civil penalties and $749,500 for investigation costs and future consumer protection enforcement in the seven participating counties.² None of that money goes to individual shoppers.⁵

The judgment includes an injunction prohibiting fourteen specific unfair business practices, including false or misleading advertising, selling short-weight products, and failing to disclose loyalty program exclusions.⁴ Albertsons must also hire an independent auditor to monitor compliance for three years and provide additional employee training on price accuracy. Albertsons did not admit wrongdoing.⁶

The Price Accuracy Guarantee At The Register

The relief for shoppers comes at checkout, not through a claims form. Under the Price Accuracy Program the settlement puts in place:

If the item that rings up wrong is $5 or less, you get it for free.
If the item costs more than $5, you get a $5 gift card and pay the corrected price.
When several different items are overcharged in the same trip, the guarantee applies to the highest-priced one.
When several units of the same item are overcharged, the benefit is limited to one unit.

Stores must post signage about this policy at their entrances.⁷

If you notice a mismatch between the shelf price and the register price, or a package that seems lighter than its label, raise it before you leave the store. That is where the remedy lives.

How To Report An Overcharge Or A Weight Problem

Complaints can go to the store directly or to your county’s Weights and Measures department. San Diego County takes reports at 1-888-TRUE-SCAN (878-3722) or through the county website. Sonoma County’s Weights and Measures office can be reached at (707) 565-2371.⁸ Every California county has an equivalent office.

Company spokeswoman Courtney Carranza said Albertsons “takes this matter seriously and remains committed to ensuring that our customers can shop with confidence,” and pointed to more prominent price accuracy signage, additional employee training, and upgrades to real-time price tracking.⁹

Why This Sounds Familiar

The 2024 case is not the first time these chains faced California enforcement over pricing. On March 6, 2014, Safeway agreed to an injunction and paid $2,250,000 in fines, restitution, and other costs to settle an earlier consumer protection action. That injunction already required a price accuracy policy giving overcharged customers the item for free or a $5 gift card, whichever was greater.¹⁰

Prosecutors in the 2024 case alleged Safeway had failed to consistently honor that earlier policy or train employees on it, which is part of why the new judgment adds the three-year independent auditor and mandatory entrance signage.¹⁰ The practical takeaway for shoppers is the same as before, only enforced more closely this time: check your receipt, and if the price is wrong, ask for the guarantee at the store.
