What the Lawsuit Was About
The claim centered on Walgreens’ Prescription Savings Club, a $20-a-year membership program launched in 2007 that gave cash-paying customers deep discounts on generic drugs — $5, $10, or $15 for a 30-day supply and $10, $20, or $30 for a 90-day supply.2News10. Plaintiffs alleged that when insured customers filled the same generics, Walgreens reported a higher price to their insurance as the “usual and customary” price, rather than the lower Savings Club rate. Because copays, coinsurance, and deductibles are often calculated off that reported price, insured customers ended up paying more out of pocket than cash-paying club members did for identical drugs.3Legal Newsline. Who Was Included in the Class
The settlement class covered all individuals and entities in the United States who paid for at least one prescription drug at Walgreens between January 1, 2007, and November 18, 2024, using prescription insurance benefits. Several groups were excluded:
- Walgreens itself, its affiliates, management, and employees.
- Pharmacy benefit managers.
- Cash-only customers who paid without insurance.
- Federal and state government entities, other than government-funded employee benefit plans.
- Anyone who had already sued or settled with Walgreens over the same pricing issue, unless they voluntarily dismissed those claims without prejudice.
If you paid cash the whole time, you were not part of this case. The suit was specifically about people whose insurance was billed.
Was There Still Time to File a Claim?
No. The standard claim deadline was April 17, 2025. An extended deadline of June 16, 2025, applied only to class members who had requested their drug purchase history from Walgreens on or before April 12, 2025. People who filed on time and received a notice with an identification number did not have to submit documentation if their claim was under $10,000. When Payments Will Arrive
The court entered final judgment approving the settlement on March 31, 2026.1Savings Club Settlement. Payments will be sent digitally. Claimants will be contacted by email or text to pick a delivery method, with options including PayPal, Venmo, Apple Pay, Amazon, or direct deposit.9Savings Club Settlement. Consumer Claim Form
How Much Each Person Gets
There is no fixed per-person amount. The $100 million fund pays attorneys’ fees of up to $40 million, litigation costs of up to $3 million, service awards of up to $5,000 for individual plaintiffs and $15,000 for the union funds, and notice and administration expenses.7ClaimDepot. What’s left, the Net Settlement Fund, is split into two pools:
- 80% goes to third-party payors such as insurance companies and union health funds that covered prescription costs during the class period.
- 20% goes to individual consumers who paid out-of-pocket costs on insured prescriptions.

Who Brought the Case
The original complaint was filed on March 23, 2017, in the U.S. District Court for the Northern District of Illinois. The named plaintiffs were Cynthia Russo, Dorothy Forth, and Troy Termine, together with two union benefit funds: International Brotherhood of Electrical Workers Local 38 and International Union of Operating Engineers Local 295-295C.10CourtListener.
