Walmart has resolved several major lawsuits in 2025 and 2026, and the Walmart lawsuit settlements now paying out or finalized include a $45 million class action over overcharged weighted groceries, a $100 million federal judgment covering Spark delivery drivers, a $10 million Federal Trade Commission money-transfer fraud settlement, a $5.6 million California overcharging deal, and two smaller EEOC disability discrimination consent decrees. Most claim windows have already closed. Here is what each settlement covers, who gets paid, and where things stand.
Weighted Groceries Class Action: $45 Million
The largest consumer settlement currently distributing money is Kukorinis v. Walmart Inc., filed in October 2022 in the U.S. District Court for the Middle District of Florida. The suit alleged Walmart inflated the weights of meat, seafood, poultry, and pork sold by the pound so the register price exceeded the advertised or “rollback” price, and that bagged citrus labels showed less weight than the shelf tags.1The New York Times. Walmart denied wrongdoing but agreed to a $45 million settlement in November 2023. Judge Virginia M. Hernandez Covington granted final approval on June 28, 2024.2ClaimDepot. Walmart Inc. Payout Amount and Status
The court approved distribution on August 8, 2025, and the claims administrator began issuing payments on September 30, 2025. The average payout for approved claimants is about $25.97.2ClaimDepot. If you filed a claim, watch for a digital Mastercard notification. Spark Driver Deceptive Earnings: $100 Million
On February 26, 2026, the FTC and attorneys general from eleven states announced a $100 million judgment against Walmart over its Spark Driver delivery program. The states involved were Arizona, California, Colorado, Illinois, Michigan, North Carolina, Oklahoma, Pennsylvania, South Carolina, Utah, and Wisconsin.4FTC. The complaint alleged Walmart misled gig drivers about their earnings in several ways: showing estimated tips that were not preauthorized and could vanish if a customer’s payment failed; quietly cutting base pay and tips when individual orders were removed from a batch; failing to fully disclose the conditions for bonuses and referral incentives, then denying them to some drivers who met the stated requirements; and, despite telling customers “100% of tips go to the driver,” sometimes failing to pass tips through and not refunding customers either.4FTC. How the $100 Million Is Divided
Up to $79 million is earmarked for direct payments to Spark Drivers. Another $11 million goes to the participating states as penalties, and $10 million goes to the FTC for consumer refunds.6Michigan Attorney General. The file does not describe a public claim form for Spark Drivers; payments to affected drivers are being administered through the FTC and state process rather than an open filing window.
FTC Money Transfer Fraud: $10 Million
On June 20, 2025, the FTC announced a $10 million stipulated final order resolving its June 2022 lawsuit accusing Walmart of allowing scammers to exploit its in-store money transfer services between 2013 and 2018. The FTC said Walmart failed to implement effective anti-fraud policies, train employees adequately, or warn customers about fraud risks while processing transfers through MoneyGram, Western Union, and Ria, and that consumers lost hundreds of millions of dollars to those scams.7FTC. Walmart did not admit the allegations, agreed to continue its anti-fraud program for money transfer services, and the case was dismissed with prejudice. The FTC voted 3-0 to approve the deal.7FTC. California Overcharging: $5.6 Million
On August 8, 2025, district attorneys from Santa Clara, San Diego, San Bernardino, and Sonoma counties announced a $5.6 million settlement with Walmart covering its 280 California stores. The complaint alleged Walmart charged customers more than the lowest posted price at the register and sold produce, baked goods, and other prepared items at weights less than what was stated on the label, in violation of California’s False Advertising and Unfair Competition Laws.8Santa Clara County District Attorney. Of the total, $5.5 million covered civil penalties and about $140,000 went to investigation costs; Santa Clara County’s $1.375 million share was designated for its consumer protection fund. This is a civil penalty settlement paid to the counties, not a consumer refund fund; individual California shoppers are not receiving payments through it. Walmart is court-ordered to appoint regional compliance associates to oversee price accuracy at California locations and is prohibited from false or misleading advertising.9Sonoma County District Attorney. EEOC Disability Discrimination Settlements
Two EEOC lawsuits over disability discrimination resolved in favor of individual workers. These are single-employee settlements, not class funds.
Farmingdale, New York: $60,000
Donna Livermore, a customer availability associate with hearing, speech, and cognitive impairments at Walmart’s Farmingdale, New York, store, had her longstanding workplace accommodations discontinued by new managers in January 2020 and was fired in January 2021 for “insubordination.” Walmart had previously described her as “very dedicated to her position.”10Newsday. Decatur, Illinois: $230,000
A deaf applicant applied online for a stocking position at a Decatur, Illinois, Walmart. When a screener contacted him to set up an interview, he requested an ASL interpreter. The screener agreed to arrange one but never followed through, and three hearing applicants were hired for the same position.12EEOC. Walmart to Pay $230,000 to Deaf Applicant in EEOC Disability Hiring Discrimination Suit After the court rejected Walmart’s motion for summary judgment and the case was set for trial in June 2026, a settlement announced on May 13, 2026, required Walmart to pay $230,000. A two-year consent decree requires the Decatur store to maintain a posted contact list of ASL interpreters and to train hiring personnel on accommodating deaf applicants and employees.13HR Dive. Gift Card Tampering Cases Still Pending
If you bought a Walmart or Walmart-sold prepaid gift card that turned out to be drained, no settlement money is available yet. Two class actions accuse Walmart of failing to protect customers from tampering schemes where scammers copy card numbers and PINs off in-store cards, then drain the balance once a shopper loads money onto them.
Foster v. Walmart Inc. (No. 4:19-cv-00571, E.D. Ark.), filed in August 2019, alleges negligence, failure to disclose the tampering risk, and refusal to refund drained cards, with consumer losses “in the millions of dollars.”14Top Class Actions.
