What Does a Stay of Proceedings Mean in Court?

A stay of proceedings is a court order that pauses a lawsuit, either for a set time or indefinitely, blocking any further action in the case until the stay is lifted. Courts issue stays for all kinds of reasons: a pending appeal, a bankruptcy filing, an arbitration agreement, a parallel criminal investigation, or a party’s active military service. The pause can cover the entire case or just a specific part of it. Whether that pause helps or hurts you depends on which side of the case you’re on.

What Happens to Your Case During a Stay

Once a stay takes effect, the case freezes. Filing deadlines are suspended. Discovery stops, meaning no depositions, document requests, or interrogatories move forward. Scheduled hearings and trial dates come off the calendar. The stay binds every party in the case, and trying to push the case forward anyway can bring sanctions from the court. In the bankruptcy context, violating a stay can trigger a damages award against the violator.

The case itself doesn’t go away. It stays on the court’s docket in a suspended state, more like a bookmark than a deletion. When the stay is eventually lifted, the case picks up where it left off.

Why a Court Would Pause a Case

Courts don’t pause cases without a reason. The underlying question is always some version of the same thing: would it be wasteful, unfair, or legally problematic to let this case move forward right now? A few situations come up repeatedly.

An Arbitration Agreement Covers the Dispute

If you signed a contract with an arbitration clause and the other side files a lawsuit anyway, you can ask the court to stay the case. Under federal law, a court that finds the dispute falls within a written arbitration agreement must stay the lawsuit until arbitration is completed, as long as the party asking for the stay isn’t dragging their feet on starting arbitration.1Office of the Law Revision Counsel. 9 USC 3 – Stay of Proceedings Where Issue Therein Referable to Arbitration The statute uses “shall,” which means the court doesn’t have discretion to refuse once the conditions are met.

A Related Case Could Resolve the Issues

When two cases involve overlapping parties or legal questions, a court may stay one while the other finishes. If a ruling in the first case would effectively decide the second, there’s no reason to litigate both at the same time. The party asking for the stay has to show real hardship in going forward, and the court won’t grant the pause if it would unfairly damage the other side.

A Parallel Criminal Investigation

Civil cases sometimes overlap with ongoing criminal investigations into the same conduct. A defendant in that situation faces a bind: anything they say or produce in civil discovery could be used against them in the criminal case, putting their Fifth Amendment rights at risk. Courts weigh several factors before granting a stay here, including how much the civil and criminal issues overlap, how far along the criminal case is, the burden on both sides from the delay, and how directly the defendant’s Fifth Amendment rights are at stake. There’s no automatic right to a stay in this situation.

Active Military Service

The Servicemembers Civil Relief Act provides a mandatory stay for qualifying military members involved in civil litigation, including custody cases. If you’re on active duty or within 90 days of release, and your military duties keep you from appearing in court, the court must grant a stay of at least 90 days when you request one. You can ask for additional stays if your service continues to interfere with the case.2Office of the Law Revision Counsel. 50 USC 3932 – Stay of Proceedings When Servicemember Has Notice

A Pending Appeal

Losing at trial doesn’t always mean immediate consequences. If you plan to appeal, you can ask the court to stay enforcement of the judgment while the appeal plays out. When money is involved, courts typically require the losing party to post a supersedeas bond covering the full judgment plus anticipated interest and costs. That way the winning party can actually collect if the appeal fails. Federal government entities are exempt from posting bonds when they appeal.3Legal Information Institute. Automatic Stays vs. Stays You Have to Ask For

Stays fall into two broad categories, and the difference matters because it determines how you get one and how much control the court has.

A discretionary stay is what it sounds like: the judge decides whether to grant it. There’s no formula that guarantees one. The court weighs the competing interests and uses its judgment. Most of the situations above fall into this category, and the party asking for the stay carries the burden of showing why the pause is necessary.

An automatic stay takes effect the moment a triggering event happens, without anyone needing to request it. Bankruptcy is the biggest example. Another one lives in the Federal Rules of Civil Procedure: after a court enters a judgment, enforcement is automatically stayed for 30 days, giving the losing party a window to decide whether to appeal or post a bond.3Legal Information Institute. The Bankruptcy Automatic Stay

The bankruptcy stay affects more people than any other kind. The moment you file a bankruptcy petition, nearly all collection activity against you stops. Creditors can’t continue lawsuits, pursue foreclosures, repossess property, garnish wages, or call demanding payment. The stay also blocks creditors from enforcing judgments obtained before the filing and prevents new liens from attaching to property of the bankruptcy estate.4Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

The stay is broad, but there are notable exceptions. Criminal proceedings against the debtor continue. Family law matters including paternity actions, child support and domestic support modifications, custody disputes, and domestic violence cases also fall outside the stay. Tax audits and notices of tax deficiency can proceed as well.4Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

Violating the stay is costly. A creditor who knowingly violates it can be ordered to pay actual damages, including costs and attorney’s fees, to an individual harmed by the violation. In egregious cases, courts can also award punitive damages. A limited good-faith exception exists for creditors who believed the stay didn’t apply under certain repeat-filing provisions, capping recovery at actual damages in that narrow situation.4Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

Asking for a Stay

For any discretionary stay, you start by filing a motion with the court. The motion has to explain the legal basis for the request and set out the specific facts supporting it. You serve the motion on all other parties, and they get a chance to respond. The judge reviews both sides and may hold a hearing before ruling. If the stay is granted, the order lays out its scope, what actions are paused, and any conditions or time limits.

The trial court is the first place to ask. If the trial court denies the motion, you can go to the appellate court, but you generally have to show you tried the trial court first.5United States Court of Appeals for the Fourth Circuit. Federal Rules of Appellate Procedure – Rule 8 Stay or Injunction Pending Appeal

Some situations can’t wait for normal briefing. If enforcement of a judgment or order would cause immediate, irreparable harm before a standard motion could be decided, courts allow emergency motions for a stay. The bar is higher: you have to show genuine urgency, explain the specific harm that will result from delay, and typically give the opposing side advance notice by phone before filing. Routine extensions and procedural motions don’t qualify.

How and When a Stay Ends

A stay ends in one of three ways: the triggering condition is satisfied, a set time period expires, or the court lifts it on motion. A stay pending appeal ends when the appellate court issues its decision. A stay granted for arbitration ends when arbitration concludes. A stay tied to a parallel criminal case ends when the criminal proceedings wrap up, or when the court decides the delay has become unreasonable.

Any party can ask the court to lift a discretionary stay by filing a motion showing that circumstances have changed. For the bankruptcy automatic stay, creditors can seek relief under specific statutory grounds, including showing “cause” such as the debtor lacking equity in a particular piece of property and the property not being necessary for an effective reorganization. In those hearings, the creditor bears the burden of proving the debtor lacks equity, and the debtor bears the burden on all other issues.4Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

How long a stay lasts varies widely. A bankruptcy stay might run for months. A stay pending appeal can stretch a year or more while the appellate court works through its docket. A military stay starts at a 90-day minimum but can be extended. Courts are generally reluctant to let stays run indefinitely, and the longer one lasts, the stronger the argument for lifting it becomes.
