What Happened to Robert Durst’s Wife Kathie Durst?

Kathleen “Kathie” McCormack Durst, the wife of New York real estate heir Robert Durst, disappeared on January 31, 1982, from the couple’s weekend cottage in South Salem, New York, and has never been seen since. She was 29, a fourth-year medical student, and by multiple accounts afraid of her husband. Her body has never been found. Robert Durst was finally indicted for her murder in November 2021, nearly forty years later, but he died in a California prison hospital in January 2022 before he could be tried. What happened to Robert Durst’s wife Kathie Durst is, in the eyes of prosecutors, her family, and a Los Angeles judge who heard related evidence, a homicide committed by her husband and covered up for decades.

The Night She Disappeared

Kathie was last seen on the evening of January 31, 1982, at the stone cottage she and Robert owned on Lake Truesdale in South Salem. Robert told police he drove her to the Katonah train station that night so she could return to their Manhattan apartment for a Monday morning class at Albert Einstein College of Medicine, where she was training to become a pediatrician.¹² He did not report her missing for five days.³

The morning after she vanished, someone called Kathie’s medical school claiming to be her, saying she would miss a scheduled rotation because of an upset stomach and headaches. The caller’s identity was never confirmed. Prosecutors later suggested the call was placed by Susan Berman, a close friend of Robert Durst.⁴ Decades later, in the HBO documentary The Jinx, Robert Durst admitted he had lied to police about aspects of that night.⁵

Signs of Abuse Before She Vanished

By the time she disappeared, Kathie had told friends and family she was unhappy in her marriage and afraid of her husband.² After she vanished, her sister Mary found a journal in which Kathie had documented years of abuse, including being punched to the ground and being humiliated in public.⁵ Her brother Jim McCormack described seeing Robert grab Kathie by the hair at a family gathering. Neighbors at the couple’s Manhattan residence later reported that Kathie had knocked on their windows seeking help, saying Robert had beaten her and threatened to shoot her.⁶

Medical records showed she was treated at Jacobi Hospital for facial injuries less than a month before she disappeared. She told friends Robert had inflicted them.⁷

Why the Original Investigation Failed

The 1982 investigation was shaped almost entirely by Robert Durst’s account. Police concentrated their search in Manhattan, where he claimed Kathie had gone that night. A 2022 report by the Westchester County District Attorney’s office found investigators suffered from “tunnel vision,” accepting his narrative despite obvious warning signs and failing to verify supposed sightings of Kathie in the city.⁸ Building employees who initially said they had seen Kathie later recanted or could not confirm it was her. The elevator operator at the couple’s apartment said she never returned home.

Physical evidence at the South Salem cottage went unpursued. A cleaning woman reported seeing what she believed was blood on a dishwasher and a wood panel out of place shortly after the disappearance, but those observations were not documented in the original police reports.⁸ The domestic violence allegations against Robert went unchecked.⁹ Meanwhile, Susan Berman acted as an informal spokesperson for Durst, telling investigators Kathie had voluntarily run off with another man. The DA’s report concluded that investigators “cannot ignore the wealth, status and resources available to Durst” as factors that allowed the case to stall.

The Case That Reopened Everything

Kathie’s case sat dormant for seventeen years. In the summer of 1999, New York State Police Investigator Joseph Becerra formally reopened it.⁷ In late 2000, Westchester County District Attorney Jeanine Pirro announced the reopened investigation publicly, and investigators searched Truesdale Lake and the couple’s former cottage for forensic evidence.¹ Becerra debunked the Manhattan sighting theory that had guided the original investigation and shifted the focus toward Robert Durst himself.¹⁰

Investigators wanted to interview Susan Berman about what she knew. They never got the chance. On Christmas Eve 2000, Berman was found shot to death at point-blank range in her Los Angeles home.¹ The day before her body was found, Beverly Hills police received an anonymous handwritten note giving Berman’s address and the single word “CADAVER.”

Fifteen years later, filmmaker Andrew Jarecki’s HBO documentary The Jinx: The Life and Deaths of Robert Durst obtained a letter Durst had sent Berman. Its handwriting, and a distinctive misspelling of “Beverly” as “Beverley,” closely matched the anonymous cadaver note.¹ Confronted on camera, Durst went into a bathroom where a still-live microphone recorded him muttering, “There it is. You’re caught. What the hell did I do? Killed them all, of course.”¹¹

Los Angeles prosecutors charged Durst with Berman’s murder. At his 2021 trial, they argued he had killed her at point-blank range in her home to prevent her from telling police what she knew about Kathie’s disappearance. On September 17, 2021, a jury convicted him of first-degree murder.¹² At sentencing on October 14, 2021, Deputy District Attorney John Lewin told the court, “Everything starts with Kathie Durst’s disappearance and death at the hands of Mr. Durst.” Judge Mark Windham imposed life in prison without parole and called the evidence “overwhelming.”¹³

The 2021 Indictment That Came Too Late

Days after the Berman sentencing, prosecutors moved to charge Durst for Kathie. Fearing he might die before an indictment could be secured, Investigator Becerra filed a criminal complaint in Lewisboro Town Court on October 19, 2021, charging Durst with second-degree murder.¹⁴ On November 1, 2021, a Westchester County grand jury formally indicted him.¹⁵

He never faced a jury on that charge. Robert Durst died on January 10, 2022, at 6:44 a.m. at a state prison hospital facility in Stockton, California, at age 78. His attorney said the cause was natural, related to esophageal and bladder cancers, chronic kidney disease, and COPD.¹⁶ His Berman conviction was later vacated under California’s abatement doctrine, which voids a conviction when a defendant dies while an appeal is pending. LA Superior Court Judge Kathryn Solorzano ruled all proceedings in the case “permanently abated.”¹⁷

Where the Case Stands Now

Kathie’s body has never been recovered. She was declared legally dead in 2017, thirty-five years after she disappeared, on a petition filed by her family.¹⁸ In an affidavit filed with that petition, her sister Carol Bamonte wrote that there was “a strong probability that Durst killed Kathie.”¹⁹ Robert Durst himself had tried in 2013 to claim $82,000 from her estate.²

With criminal proceedings cut short by Durst’s death, Kathie’s family turned to civil court. In February 2022, on the fortieth anniversary of her disappearance, her relatives filed a wrongful death lawsuit in federal court against Durst’s estate and his second wife, Debrah Lee Charatan, seeking more than $100 million and alleging Charatan had helped Durst evade justice for years.²⁰ Charatan’s attorney called the claims “speculation” and an attempt to “extort money.” In May 2026, a federal judge dismissed that lawsuit in a 26-page decision, ruling that the plaintiffs had not shown Kathie’s mother suffered the financial harm required to survive summary judgment.²¹

A separate case is still alive. In 2015, Kathie’s mother Ann McCormack and her sisters Carol Bamonte, Mary Hughes, and Virginia McKeon sued Robert Durst for violating their right of sepulcher, the common-law right to bury a family member, along with intentional infliction of emotional distress, seeking $100 million.²² The suit was initially dismissed as untimely in 2020. In November 2025, the Appellate Division of the New York Supreme Court ruled the claims were not time-barred, since the family could not have known in 1982 that they were being deprived of Kathie’s remains. The court allowed the case to move forward against Robert Durst’s estate but dismissed the claims against Charatan and other Durst relatives as “speculative and conclusory.”²³ That sepulcher action against the estate is now the family’s last open avenue to hold anyone accountable for what happened to Kathie.
