What Is a Home Pass From Jail and How Does It Work?

A home pass from jail, known in the federal system as a furlough, is a temporary authorized release that lets an incarcerated person leave the facility for a limited time and return on a set date. Under federal law, a single furlough can last up to 30 calendar days, though most run from a few hours to about a week. You remain in legal custody the entire time. The federal Bureau of Prisons (BOP) runs the most detailed program, and state and county jail systems have their own versions with different names and rules; the framework below is federal, but the shape of it (application, approval, strict conditions, serious penalties for violations) tends to carry across.

What a Home Pass Actually Is

A furlough is not a change to your sentence and not a transfer to a new facility. You are released briefly, you follow a defined set of conditions, and you come back. Throughout the pass, you remain in the legal custody of the U.S. Attorney General and are subject to prosecution for escape if you fail to return on time.1eCFR. 28 CFR 570.38 – Conditions of Furlough

Federal regulations divide furloughs into transfer furloughs (unescorted travel from one facility to another, or to a halfway house) and non-transfer furloughs. Non-transfer furloughs break down further:

  • Emergency furlough, for a death, serious illness, or other urgent family situation. This is the only type available to someone who has been at the facility fewer than 90 days or who has more than two years left on their sentence.
  • Routine day furlough, limited to the commuting area around the facility, 16 hours or less, ending before midnight.
  • Routine overnight furlough, typically three to seven days, extendable for medical, educational, or vocational reasons.

The 30-day ceiling applies to any single furlough but is mostly relevant to transfer furloughs; routine passes almost never approach it.2eCFR. 28 CFR 570.33 – Justification for Furlough

Reasons a Home Pass Can Be Granted

Federal statute authorizes temporary release to visit a dying relative, attend a funeral, obtain medical treatment the facility cannot provide, contact a prospective employer, and reestablish family or community ties. It also includes a catch-all for “any other significant activity consistent with the public interest.”3Office of the Law Revision Counsel. 18 USC 3622 – Temporary Release of a Prisoner

The implementing regulations add appearances in civil court, compliance with grand jury or legislative requests, training programs or work assignments where daily commuting is impractical, and participation in educational, social, civic, or religious activities that support reentry.2eCFR. 28 CFR 570.33 – Justification for Furlough Every approved purpose either addresses an emergency or supports the person’s transition back to the community.

Who Qualifies

How close you are to release controls which types of furlough you can be considered for. The federal regulations work on a sliding scale:

  • More than two years until release: emergency furloughs only.
  • Two years or less: emergency or routine day furloughs.
  • 18 months or less: emergency, routine day, or routine overnight furloughs within the facility’s commuting area.
  • One year or less: all non-transfer furloughs, including overnights outside the commuting area.

Anyone at their assigned facility fewer than 90 days is limited to emergency furloughs regardless of time left on sentence.4eCFR. 28 CFR 570.36 – Non-Transfer Furlough Eligibility Requirements That is the source of the common idea that home passes are a “last year” privilege; the full menu only opens up near release.

Wardens ordinarily will not grant a furlough if the person was convicted of a serious crime against another person, if their presence in the community would attract undue public attention or diminish the seriousness of the offense, or if they received a furlough within the past 90 days. The word “ordinarily” leaves room for exceptions, but in practice a violent conviction is close to disqualifying. Inmates must also be physically and mentally capable of completing the furlough and must have shown enough responsibility for staff to trust them with the conditions.4eCFR. 28 CFR 570.36 – Non-Transfer Furlough Eligibility Requirements Inmates housed in contract facilities are not eligible for the BOP program, though they may apply under the terms of that facility’s agreement with the Bureau.5eCFR. 28 CFR 570.31 – Inmate Eligibility for Furloughs

How to Apply

An inmate submits a furlough application to facility staff, who review it against the regulations and BOP policy.6eCFR. 28 CFR 570.37 – Procedures to Apply for a Furlough The unit team, typically a case manager and unit manager, handles the first look and helps build the file.

If the unit team sees a clear reason to recommend denial, they can send a memo to the warden asking for rejection without completing the full process. If the warden agrees, that ends it. If not, the application moves forward.7Federal Bureau of Prisons. Inmate Furloughs – Program Statement 5280.09 This shortcut exists because many requests are plainly ineligible under the time-remaining or offense rules.

For applications that proceed, staff verify that the person being visited actually welcomes the visit. A furlough questionnaire is sent to the supervising probation agency in the district being visited. The application is routed through the facility’s intelligence and security office to check for detainers and legal holds. Only then does it reach the warden for signature. Approval authority stops at the warden and cannot be delegated further down, though regional directors can authorize camp administrators to approve furloughs at satellite camps.7Federal Bureau of Prisons. If the request is denied, the inmate gets written notice of the reasons and can appeal through the BOP’s Administrative Remedy Program.6eCFR. 28 CFR 570.37 – Procedures to Apply for a Furlough

Rules You Must Follow While Out

Approval comes with non-negotiable conditions. The geographic restriction is tight: you cannot leave the area of your furlough without permission, except to travel directly to the approved destination and back to the facility. Detours, side trips, and unplanned stops are all violations.1eCFR. 28 CFR 570.38 – Conditions of Furlough Depending on the facility, a GPS ankle monitor may track your location in real time, and some programs use scheduled or random phone check-ins to verify you are at the approved address.8United States Courts. How Location Monitoring Works

Alcohol, marijuana, narcotics, and any non-prescribed medication are entirely off-limits. You can be searched and given a urinalysis, breathalyzer, or comparable test at any point during the furlough or when you return. If you or your family is paying other furlough costs, you must pre-authorize testing fees to be withdrawn from your inmate deposit fund account. Any new law violation or possession of unauthorized items also breaches the furlough.1eCFR. 28 CFR 570.38 – Conditions of Furlough

Who Pays

Transportation, food, lodging, and incidentals fall on the inmate, the inmate’s family, or another source the warden has approved. The government does not cover the cost of getting you home and back or supporting you while you are out. The exception is when the furlough is primarily for the government’s benefit, such as a transfer furlough or a court appearance the government requested; the BOP may cover those.9eCFR. 28 CFR 570.34 – Expenses of Furlough Payment arrangements are settled before approval, not after.

What Happens if You Break the Rules

A violation triggers two separate problems: criminal exposure and administrative discipline. The regulations are blunt. A person who violates furlough conditions can be treated as an escapee under 18 U.S.C. ยง 751 and prosecuted on top of internal sanctions.1eCFR. 28 CFR 570.38 – Conditions of Furlough

The escape statute carries weight. Someone who escapes or fails to return from custody after a felony conviction faces up to five additional years in prison. That is a new, separate sentence, not an extension of the existing one.10Office of the Law Revision Counsel. 18 USC 751 – Prisoners in Custody of Institution or Officer For someone months from release, a missed curfew reclassified as escape can add years.

On the administrative side, a violation typically means revocation of the furlough, immediate return to custody, a higher security classification, loss of privileges, and disqualification from future furloughs or community programs. Those consequences ripple into good-time and parole decisions. A furlough violation is about as damaging as institutional conduct gets.

How a Home Pass Differs From Other Release Programs

A furlough is temporary, and you return to the same (or another) facility afterward. Work release involves daily employment in the community while the person is still housed in the correctional facility each night. Halfway house placement, which the BOP calls community confinement, is a longer-term step-down where someone lives in a residential reentry center for the final months of their sentence. Compassionate release is a different mechanism entirely, where a court reduces or ends the sentence based on extraordinary circumstances such as terminal illness. A home pass does not change your sentence length or your facility assignment. It is a brief, supervised trip with a firm return date.
