What Is a Prayer for Judgment Continued (PJC)? License and Insurance Effects

A Prayer for Judgment Continued, often shortened to PJC, is a North Carolina option that lets a judge acknowledge your guilt without entering a formal judgment or imposing a sentence. The practical result: no fine, no jail, no license points for the violation, and in most situations nothing on your record for the purposes that matter day to day. You will usually still pay court costs. This option is specific to North Carolina and rarely available elsewhere.

How a PJC Works

Once you plead guilty or a court finds you guilty, a North Carolina judge has three choices: enter judgment and sentence you immediately, enter judgment and suspend the sentence, or continue prayer for judgment indefinitely. The third option is the PJC. The guilty plea or finding still exists in the court file, but no judgment is entered and no punishment is imposed.

Court costs are the usual exception. Almost every PJC comes with an order to pay them, and paying does not convert the PJC into a final judgment. North Carolina’s statute specifically provides that a PJC entered “on payment of court costs, without more” is not considered entry of judgment.1North Carolina General Assembly. North Carolina Code GS 58-36-65

A PJC is entirely at the judge’s discretion. You can ask; nothing entitles you to one. Judges weigh the offense, your record, and the circumstances. A first speeding ticket for someone with a clean history is an easy request. A repeat offender or a more serious charge is a much harder sell.

When a PJC Is Not Really a PJC

The benefit only holds when the judge imposes no punishment alongside the deferral. If the judge attaches a real penalty, North Carolina courts have treated the PJC as a final judgment, which means the case is fully resolved and the state cannot later ask for more. Conditions that have been found to cross into punishment include:

  • Any fine or restitution beyond court costs
  • Any jail time, even brief
  • Required community service
  • Curfews or mandatory drug testing
  • Behavioral mandates such as completing high school, enrolling in college, joining the military, maintaining employment, continuing psychiatric treatment, or writing a letter of apology

If the judge wants to add any of these, what you are getting is a sentence, not a true PJC. The distinction matters because a true PJC leaves the case open; a converted PJC closes it.2UNC School of Government. Prayer for Judgment Continued

Charges That Cannot Get a PJC

Two statutory bars come up most often:

  • Impaired driving offenses that carry mandatory punishment under G.S. 20-179 are ineligible. The judge has no authority to defer a sentence the statute requires.3UNC School of Government. NC PRO Manual 322.1 – Prayer for Judgment Continued
  • Speeding more than 25 mph over the posted limit is ineligible under G.S. 20-141(p).4North Carolina Criminal Law Blog. Limits on PJCs

Outside those bars, a judge technically has authority to grant a PJC in any criminal case. In practice, PJCs are almost entirely used for minor traffic violations.

How a PJC Affects Your License and Insurance

The main reason people seek a PJC for a traffic ticket is to keep points off their driving record. A true PJC with no judgment entered means the DMV does not assess license points for the violation. That is the biggest practical win for most defendants.

But the system draws a sharp line between DMV license points and insurance surcharge points, and the limits are different:

  • License points: up to two PJCs within a five-year period can keep points off your driving record.
  • Insurance points: the Safe Driver Incentive Plan allows one PJC every three years per household. A second PJC inside that window can trigger insurance surcharge points.

The insurance allowance is the trap. It is per household, not per person. If your spouse or a child on the same auto policy used a PJC last year, no one on that policy gets the insurance benefit of another PJC until three years have passed. People commonly burn the household’s allowance on a minor ticket and then find it unavailable when someone else on the policy needs it more.

It helps to understand what the statute actually says. North Carolina’s Safe Driver Incentive Plan provides that “convictions on a driving record shall include convictions for which a prayer for judgment continued was granted.”1North Carolina General Assembly. North Carolina Code GS 58-36-65 For insurance rating purposes, in other words, a PJC counts as a conviction. The relief is only the narrow allowance that lets insurers disregard one PJC every three years per household.

Commercial Driver’s Licenses

A PJC will not help a CDL holder. Federal regulations prohibit states from masking, deferring judgment on, or diverting traffic convictions in a way that would keep them off a CDL holder’s record. The rule covers any traffic violation in any vehicle, personal or commercial, in any state.5eCFR. 49 CFR 384.226 – Prohibition on Masking Convictions The only carve-outs are parking, vehicle weight, and vehicle defect violations. For a CDL holder, a guilty plea will reach the Commercial Driver’s License Information System regardless of any PJC.

Immigration Consequences for Non-Citizens

Whether a PJC counts as a “conviction” under federal immigration law turns on whether the judge imposed any punishment beyond court costs. The Immigration and Nationality Act treats a case as a conviction when adjudication has been withheld only if there was a guilty plea or finding and the judge ordered some form of punishment, penalty, or restraint on liberty.6Office of the Law Revision Counsel. 8 USC 1101 – Definitions

A true PJC with only court costs usually fails that second requirement. The Fourth Circuit held that $100 in court costs tied to a North Carolina PJC did not amount to “punishment” or “penalty” under the federal conviction definition.7FindLaw. Gonzalez v. Sessions III (2018) Any added condition that counts as punishment can flip the analysis, so a non-citizen should talk to an immigration attorney before accepting any plea.

The Case Stays Open

Because a true PJC is not a final judgment, the case technically remains open. The state can later ask the court to enter judgment and sentence you on the original charge. North Carolina’s Court of Appeals confirmed in a 2023 decision that the state could seek judgment on a PJC years later, finding the delay reasonable on the facts of that case.8UNC School of Government. Prayer for Judgment Continued PJC – May a Person Obtain an Expunction

For a routine traffic matter, the state rarely goes back to activate an old PJC. For more serious charges, a new arrest can prompt a prosecutor to revisit the earlier case. The open-ended structure is both the strength of a PJC and its risk.

How to Ask for One

You do not need a lawyer. After entering a guilty plea, you simply ask the judge to continue prayer for judgment. There is no form and no special motion.

An attorney still offers real advantages, even on a minor case. A lawyer who works in the local court will know whether the assigned judge is likely to grant a PJC and whether that is actually your best move. Sometimes a negotiated reduction to a non-moving violation beats a PJC, because it does not use up the household’s allowance. Counsel can also appear for you so you do not miss work.

If you handle it yourself, think about the household limits before you spend your PJC. Using it on a small ticket today can leave you or a family member on the same policy without the option when the stakes are higher.
