Executive clemency is the discretionary power of the President, a state governor, or in some states a clemency board to grant relief from the penalties of a criminal conviction. It is not a single remedy but a family of them, and it is not a right. A petition is a request for mercy, and the regulations governing the federal process say so plainly: they are “advisory only” and “create no enforceable rights in persons applying for executive clemency.”1eCFR. 28 CFR Part 1 – Executive Clemency Clemency exists because rigid application of criminal law sometimes produces outcomes the system itself would not defend, and because rehabilitation, disparity, illness, and the public interest sometimes call for an answer the courts cannot give.
The Forms Clemency Takes
Which remedy you want depends on what you need.
A pardon is the broadest. It forgives the offense and restores civil rights lost on conviction, such as voting, serving on a jury, and in most cases possessing a firearm. The Supreme Court has described a full pardon as something that “releases the punishment and blots out of existence the guilt, so that in the eye of the law the offender is as innocent as if he had never committed the offence.”2Legal Information Institute. U.S. Constitution Annotated – Legal Effect of a Pardon A pardon does not, however, erase the conviction from the historical record. The Department of Justice’s Office of Legal Counsel has concluded that “a pardon does not erase the conviction as a historical fact” and does not by itself expunge judicial or executive branch records.3United States Department of Justice. Whether a Presidential Pardon Expunges Judicial Records
A commutation reduces a sentence already being served. Twenty years might become ten, or a death sentence might be converted to life imprisonment. It does not imply forgiveness and does not restore civil rights. The Department of Justice treats commutation as an “extraordinary remedy” reserved for severe sentencing disparity, critical illness, old age, or meritorious service to the government.4United States Department of Justice. Justice Manual – 9-140.000 – Pardon Attorney
A reprieve temporarily postpones a sentence, most often an execution, to allow time for further proceedings or review of new evidence. It pauses rather than reduces.
Remission targets financial penalties: fines and forfeitures. It leaves the prison sentence and conviction intact.
Amnesty works like a pardon but applies to groups rather than individuals. The Supreme Court has noted it is “essentially identical to pardon in ultimate effect,” with the difference that it is “extended to whole classes or communities, instead of individuals.”5Legal Information Institute. U.S. Constitution Annotated – Amnesties It has historically been used for political offenses.
Who Grants Clemency
The first practical question is who holds authority over your conviction.
For federal offenses, the President has exclusive power under Article II, Section 2 of the Constitution, which grants authority “to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.”1eCFR. 28 CFR Part 1 – Executive Clemency Congress cannot limit or modify it.6Library of Congress. Executive Clemency and Judicial Power – Legal Overview It reaches all federal crimes, including offenses under the Uniform Code of Military Justice and crimes prosecuted in the District of Columbia.
A governor cannot pardon a federal conviction, and the President cannot pardon a state conviction. State structures themselves vary. In some states the governor acts alone. In others the governor can act only on a recommendation from a clemency or parole board. A smaller group of states vests the power entirely in a board. Still others use an advisory model in which the board’s recommendation is not binding. Because the differences matter, contact your governor’s office or state parole board directly to confirm the correct process and forms.
Who Qualifies and When You Can Apply
Federal eligibility rules catch people who file too soon.
For a federal pardon, you must wait at least five years after release from confinement, or five years after the date of conviction if no prison sentence was imposed.7GovInfo. 28 CFR 1.2 – Eligibility for Filing Petition for Pardon You must also have fully completed probation, parole, and supervised release.8United States Department of Justice. Pardon Information and Instructions File while still under supervision and the petition will generally be returned.
Commutation works differently. A commutation petition should not be filed if other judicial or administrative relief is available, absent a showing of exceptional circumstances.9eCFR. 28 CFR 1.3 – Eligibility for Filing Petition for Commutation of Sentence Requests from people who have not yet begun their sentence, or who are still challenging their conviction on appeal, are generally not accepted.4United States Department of Justice. Justice Manual – 9-140.000 – Pardon Attorney
State waiting periods and eligibility rules vary. Some states have shorter waits, some have none, and a few allow petitions during incarceration. Check with the specific state’s clemency authority.
How Federal Petitions Are Weighed
The Department of Justice publishes what it looks for, and reading those criteria before you apply is time well spent.
For pardons, the review focuses on:4United States Department of Justice. Justice Manual – 9-140.000 – Pardon Attorney
- Post-conviction conduct, including financial stability, steady employment, family responsibility, community reputation, and charitable activities over a significant period after release.
- The seriousness and recency of the offense. Violent crimes, major drug trafficking, breaches of public trust, and large-scale fraud draw a longer expectation of clean living before favorable consideration. Victim impact is weighed.
- Acceptance of responsibility. Attempts to minimize or rationalize do not help; genuine acknowledgment and restitution do.
- The specific need for relief. A concrete reason, such as removing a barrier to professional licensing or bonding, strengthens the petition.
- The views of the original prosecutor and sentencing judge, which the Department considers carefully.
Commutation carries a higher bar. Traditional grounds are a sentence unusually severe compared to current sentencing practices, critical illness, old age, or exceptional service to the government. Time already served and the availability of other judicial remedies, such as a motion for sentence modification, are also considered.4United States Department of Justice. Justice Manual – 9-140.000 – Pardon Attorney Petitioners claiming innocence or a miscarriage of justice face what the Department calls a “formidable burden of persuasion.” Clemency is a tool for mercy, not a substitute for an appeal.
What a Petition Requires
The federal application is detailed, and inaccuracies cost petitions. Use the official forms available through the Office of the Pardon Attorney.10United States Department of Justice. Office of the Pardon Attorney – Apply for Clemency You will need full personal identifiers, including Social Security number, any aliases, and citizenship status, along with detailed conviction records: court, case number, sentencing date, length of sentence, and time served. The clerk of the sentencing court or the relevant corrections agency can produce documents you no longer have.
At least three character affidavits must accompany the petition. If you submit more than three, designate which three are primary. Blood or marriage relatives cannot serve as primary references. Each affidavit must include the reference’s full name, address, and phone number, show knowledge of the offense, and bear a notarized signature.8United States Department of Justice. Pardon Information and Instructions
A narrative explanation of the specific relief sought and why it is warranted is also required. Document restitution and fines as satisfied. Outstanding warrants or pending proceedings weigh against the petition. There is no filing fee.
After a petition is filed, the Office of the Pardon Attorney reviews it and may ask the FBI to investigate.11United States Department of Justice. Office of the Pardon Attorney – How Clemency Works The Pardon Attorney then prepares a report and recommendation for the President, who retains full discretion and can approve or deny without reason. Federal cases often take several years.
What Clemency Does and Does Not Do
Clemency’s limits are where most misunderstandings live.
Criminal Record
A pardon does not erase a criminal record. The conviction remains in judicial and law enforcement databases as a historical fact, and the Department of Justice has stated that a pardoned person “can be held accountable for the conduct underlying the offense by a governmental entity seeking to determine suitability for a position of confidence or trust.”3United States Department of Justice. Whether a Presidential Pardon Expunges Judicial Records Expungement, which seals or removes the record, is a separate legal process with its own rules. A pardon is not an expungement, and getting one does not guarantee the other.
Firearm Rights
Under federal law, a pardoned conviction is generally not treated as a conviction for purposes of federal firearms restrictions, so the right to possess firearms is typically restored. There is an exception: if the pardon itself expressly provides that the person may not possess firearms, the disability remains.12Office of the Law Revision Counsel. 18 USC 921 – Definitions State firearms laws may add restrictions a federal pardon does not override.
Immigration Consequences
For non-citizens, the interaction with immigration law is especially tricky. A full and unconditional pardon from the President or a governor eliminates deportability for certain categories: crimes involving moral turpitude, multiple criminal convictions, aggravated felonies, and high-speed flight from an immigration checkpoint.13Office of the Law Revision Counsel. 8 USC 1227 – Deportable Aliens It does not remove the consequences of other deportable offenses, including firearms violations, domestic violence convictions, and controlled substance offenses. On the inadmissibility side, which governs entry and visas, courts have generally held pardons have no effect. Consult an immigration attorney before assuming a pardon will solve an immigration problem.
Sex Offender Registration
Whether a pardon lifts a registration obligation depends on the state. Some explicitly relieve the obligation, others expressly maintain it regardless of a pardon, and some grant relief only if the pardon is based on a finding of innocence. Many state laws say nothing at all, leaving the question unresolved. Research the rules in the state where you are registered.
Reapplying After a Denial
A denial is not the end. If a federal pardon petition is denied, you may file again two years from the date of the denial.8United States Department of Justice. Pardon Information and Instructions Use the time. Additional community involvement, continued steady employment, and new references can strengthen a second petition. The executive is never required to explain a denial, and a third application faces no formal bar, though the odds of success without meaningful change in circumstances are low. State reapplication rules differ by jurisdiction.
