The age of consent in Dubai is 18. The rule comes from UAE federal law and applies across all seven emirates, to residents, tourists, and every nationality. Anyone 18 or older who has sexual contact with a person under 18 commits a criminal offense carrying at least ten years in prison and a fine of at least AED 100,000, even if the younger person said yes.1Emirates News Agency. What the Law Actually Says
The rule sits in Article 409 of Federal Decree-Law No. 31 of 2021, the Crimes and Penalties Law. It draws a bright line at 18, and the line does not bend based on gender, nationality, or the relationship between the parties.2United Arab Emirates Legislations. Federal Law by Decree Promulgating the Crimes and Penalties Law Consent from a person under 18 is not a defense.
A 2025 amendment, Federal Decree-Law No. 13 of 2025, added a narrow nuance for minors aged 16 and 17: their consent can be legally recognized in limited circumstances. This does not lower the age of consent and does not reduce the minimum penalty. In practice, it is something a court may weigh at sentencing. The underlying offense remains the same.
For anyone under 16, consent is treated as legally impossible. Under 14, the law goes further and presumes coercion regardless of the circumstances. Those cases fall under the rape and sexual assault provisions, where penalties can reach life imprisonment, or the death penalty where force is involved.
Penalties for Sexual Activity With a Minor
The sentencing structure is steep and leaves judges little room to go easy.
- Victim under 18: at least ten years’ imprisonment and a fine of at least AED 100,000, even where the minor appeared to consent.1Emirates News Agency. UAE Government Issues Federal Decree-Law Amending Certain Provisions of Crimes and Penalties Law
- Victim under 14: coercion is presumed, which can escalate the penalty to life imprisonment, or the death penalty in cases involving force.
- Offender in a position of authority: when the offender is a guardian, relative, teacher, or other authority figure, enhanced penalties apply. Under the human trafficking statute, Federal Law No. 51 of 2006, exploitation by a guardian or authority figure carries a potential life sentence.
These penalties apply to anyone within UAE jurisdiction. A tourist who commits an offense during a short visit faces the same sentencing range as a long-term resident. Courts also have authority to seize electronic devices and other materials connected to the offense.
Deportation for Non-Citizens
A conviction has consequences beyond the prison sentence. Article 121 of the Crimes and Penalties Law requires mandatory deportation of any non-citizen convicted of a crime against honor or public morality after the sentence is served.3United Arab Emirates Legislations. The deportation is permanent. It applies regardless of employment status, length of residence, or family connections in the UAE.
Consent Between Adults
Before the 2021 reforms, all sexual activity outside marriage was criminal in the UAE. Article 409 of the Crimes and Penalties Law changed that by carving out legal space for private, consensual relations between adults who are both 18 or older. The act itself no longer triggers automatic prosecution.2United Arab Emirates Legislations. Federal Law by Decree Promulgating the Crimes and Penalties Law
Two things can still turn a legal relationship into a criminal one. First, if a parent, legal guardian, or spouse of either party files a formal complaint, the relationship becomes prosecutable, with a minimum of six months’ imprisonment. The complainant can withdraw the complaint at any time, which suspends the case or halts a sentence already in progress. Second, the relationship has to stay private; sexual conduct in any public or semi-public space is a separate offense under public decency provisions.
The guardian complaint provision is the one that catches most foreigners off guard. A relationship that is legal on Tuesday can become a criminal matter on Wednesday if a family member objects.
Same-Sex Relations
The 2021 reforms did not extend to same-sex relationships. Article 409 criminalizes consensual same-sex sexual contact between adults and carries a minimum sentence of six months’ imprisonment.2United Arab Emirates Legislations. Federal Law by Decree Promulgating the Crimes and Penalties Law No family complaint is needed to trigger prosecution. The law applies regardless of nationality or the law in a person’s home country.
How These Cases Reach Authorities
Federal Law No. 3 of 2016, known as Wadeema’s Law, puts a reporting duty on anyone who becomes aware that a child is being harmed or exploited. The duty is strongest for professionals: physicians, teachers, social workers, and anyone entrusted with a child’s care or education must report suspected abuse to child protection authorities. Failing to report carries imprisonment or a fine of at least AED 5,000.5UAE Legislation. Federal Law on Child Rights Law (Wadeema)
Deliberately providing false information about a child’s situation, or obstructing a child protection specialist, carries fines between AED 5,000 and AED 50,000.5UAE Legislation. Federal Law on Child Rights Law (Wadeema) In practice, this means school administrators, doctors, and hotel staff who encounter evidence of sexual activity involving a minor are legally required to contact authorities, and ignoring it is itself a crime.
Marriage Age Is Separate
The age of consent and the legal age for marriage are different numbers under different laws. Readers sometimes assume marriage removes the consent problem, so the boundary is worth stating.
For Muslims, marriage is governed by the Personal Status Law, most recently updated as Federal Decree-Law No. 41 of 2024. The standard minimum age is 18. A judge may approve a marriage involving someone under 18 in exceptional circumstances, but only after assessing the maturity of the parties and determining the marriage serves their best interests. Without explicit judicial authorization, a marriage contract involving a minor is unenforceable.
For non-Muslims, the UAE introduced a civil marriage framework under Federal Decree-Law No. 41 of 2022. The age requirement is higher: both parties must be at least 21.6UAE Legislation. Federal Decree-Law No 41 of 2022 On the Civil Personal Status Both must appear before an authentication judge and expressly consent.
Neither framework rescues sexual activity with a person under 18 from the ten-year minimum under Article 409. The consent threshold stands on its own.
