What Is the Age of Consent in Iran? Marriage, Zina, and Penalties

There is no age of consent in Iran in the way most legal systems use that phrase. Sex outside marriage is a crime for everyone, at every age, and sex inside marriage is lawful as soon as the marriage itself is lawful. The closest functional thresholds are the statutory marriage ages set by Article 1041 of the Civil Code: 13 for girls and 15 for boys, with court-approved exceptions that permit marriage even younger.1Office of the United Nations High Commissioner for Human Rights. Marriage Is the Only Lawful Path to Sex

Iranian law treats a valid marriage contract, not a person’s age, as the thing that makes sexual activity legal. A married 13-year-old girl can lawfully have sex with her husband. An unmarried adult cannot lawfully have sex with anyone. That is the structure the rest of the rules sit on.

Above the statutory ages of 13 and 15, marriage proceeds through normal registration without extra judicial steps.1Office of the United Nations High Commissioner for Human Rights. Marriage Below 13 or 15

Article 1041 is not an absolute floor. A child under the statutory age can still be married if three conditions are met together: the father or paternal grandfather consents, a court finds the marriage to be in the child’s best interests, and the court grants formal permission.1Office of the United Nations High Commissioner for Human Rights. Submission – HC Report – Child Marriage – Islamic Republic of Iran The judicial standard turns on physical readiness and family circumstances, and legal observers describe it as giving wide discretion to individual judges.

Guardian Consent for Unmarried Women

The guardian rule does not expire at adulthood. Article 1043 requires any woman who has never been married to obtain her father’s or paternal grandfather’s permission before marrying, regardless of her age.2GOV.UK. Country Policy and Information Note – Women – Early and Forced Marriage, Iran A woman marrying for the first time at 35 still needs that approval. If the guardian refuses without justification, she can petition a court, which may grant permission after a 15-day waiting period. Previously married women, whether widowed or divorced, are exempt.

Temporary Marriage

Shia legal tradition recognizes a fixed-term marriage called sigheh, or mut’ah, in which a man and woman agree to be married for a defined period that can range from hours to years. The age rules are the same: the floor is 13 for girls, and an unmarried woman still needs her father’s consent. Widowed or divorced women can enter a temporary marriage on their own.

Temporary marriage matters for the consent question because it supplies a legally valid framework for very short sexual relationships. A sigheh can technically last a single day, and the man can end it earlier by waiving his remaining time. The wife does not automatically gain the maintenance rights she would have in a permanent marriage, but the marriage itself is treated as valid for purposes of sexual conduct.

Sex Outside Marriage: Zina

The Islamic Penal Code classifies all extramarital intercourse between a man and a woman as zina.3UNODC. Islamic Penal Code of the Islamic Republic of Iran Consent is not a defense. Age is not a defense. There is no age at which two unmarried people acquire a right to have sex with each other.

Penalties turn on the offender’s marital status and the circumstances of the act:

Rape

The code treats forced intercourse, “zina by coercion,” separately. Under Article 224, the rapist faces the death penalty regardless of marital status.4Refworld. Iran – Islamic Penal Code Coercion is defined broadly. Sex with a woman who is unconscious, asleep, or intoxicated qualifies, as does sex with a girl who has not reached puberty obtained through deception, or sex obtained through abduction or intimidation even where the victim ultimately submitted.

Same-Sex Conduct

Same-sex sexual activity is criminalized separately from zina, and consent is not a defense here either. For men, penetrative intercourse (livat) carries the death penalty. Other sexual contact between men that falls short of penetration carries 100 lashes, or death if the receptive partner is Muslim and the other party is not. Non-penetrative intimate contact such as kissing driven by sexual desire carries 31 to 74 lashes. Sexual contact between women (musaheqeh) is punishable by 100 lashes. Age plays no role in any of these offenses.

Why “Age of Consent” Doesn’t Map Cleanly

Most legal systems set a single age that works in both directions: below it, sex is illegal regardless of context; above it, sex is legal between willing adults. Iran uses neither half of that structure. Permission is never granted on the basis of age alone, and permission is granted at ages well below what most countries would allow, because the legal question is whether a marriage exists rather than how old the parties are. For a reader asking when sex becomes legal in Iran, the honest answer is that it becomes legal when a lawful marriage begins, which can be at 13 for a girl and 15 for a boy, and younger with court approval.
