The difference between a pardon and commutation comes down to what each one touches. A pardon forgives the conviction itself and lifts the legal disabilities that came with it. A commutation only shortens or replaces the sentence; the conviction stays on your record. Everything else, from voting rights to whether you can own a firearm, follows from that single split.
What a Pardon Changes
A pardon is an act of executive forgiveness aimed at the conviction. A full pardon releases the punishment and lifts the civil disabilities that followed from it, including the loss of the right to vote, hold public office, or sit on a jury.1Office of Justice Programs. Presidential Clemency and the Restoration of Civil Rights The Supreme Court in Ex parte Garland (1866) said a full pardon “releases the punishment and blots out of existence the guilt.”2Cornell Law School Legal Information Institute. Legal Effect of a Pardon
Later cases trimmed that language. In Knote v. United States, the Court said that while a pardon “blots out the offence” in a legal sense, “it does not make amends for the past.” Punishments already served and money already paid cannot be reclaimed.2Cornell Law School Legal Information Institute. Legal Effect of a Pardon A pardon looks forward.
A Pardon Is Not a Declaration of Innocence
In Burdick v. United States (1915), the Supreme Court said a pardon “carries an imputation of guilt and acceptance of a confession of it.”3Justia US Supreme Court. Burdick v United States, 236 US 79 (1915) Accepting a pardon can be read as acknowledging that the offense happened. That is why a pardon is closer to forgiveness than to exoneration.
The same case established that a pardon can be refused. No court can force one on the recipient.3Justia US Supreme Court. Burdick v United States, 236 US 79 (1915) Someone pursuing exoneration on an innocence claim may prefer to fight the conviction rather than accept forgiveness for an act they deny.
What a Commutation Changes
A commutation reduces or replaces a criminal sentence and leaves the conviction untouched. The person remains legally guilty. What shifts is the punishment: a death sentence may become life imprisonment, or a 30-year prison term may be cut to 15.4Legal Information Institute. Commutation Commutations typically address sentences that look disproportionate, deteriorating health, or other circumstances that make continued confinement unjust.
Because the conviction survives, a commutation does not automatically restore civil rights.5National Governors Association. The Governors Clemency Authority – An Overview of State Pardon and Commutation Processes The person released through a commutation still carries a felony record and still faces the collateral consequences that attach to the conviction rather than to the length of the sentence.
Commutations Can Come With Strings
A commutation is not always an unconditional release. It can require community supervision, drug testing, or geographic restrictions, and violating those conditions can mean reinstatement of the original sentence.5National Governors Association. The Governors Clemency Authority – An Overview of State Pardon and Commutation Processes In practice this can look like parole, though parole comes from a parole board applying correctional criteria while a commutation is an executive act by the president or a governor.
Side by Side
Most of the confusion between the two comes down to a short list of practical questions.
- Effect on the conviction: a pardon forgives it; a commutation leaves it on your record.
- Effect on the sentence: a pardon makes the sentence irrelevant because the conviction is forgiven; a commutation directly reduces or replaces the sentence.
- Timing: pardons are typically granted after the sentence has been completed; commutations are granted while someone is still serving.
- Civil rights: a full pardon restores rights like voting and jury service; a commutation generally does not, because the conviction persists.
- Criminal record: neither erases the historical fact of the conviction, but a pardon lifts the legal disabilities that flow from it.
Who Can Grant Each One
The U.S. Constitution gives the president the “Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.”6Library of Congress. Article II Section 2, US Constitution Two limits sit inside that sentence. Presidential clemency reaches only federal offenses, so a president cannot pardon or commute a state crime.7Cornell Law Institute. US Constitution Annotated – Article II, Section 2, Clause 1 – Overview of Pardon Power And it cannot be used in impeachment proceedings.
For state offenses, every state constitution hands clemency authority to the governor, a board of pardons, or some mix of the two. Procedures vary widely. Some states give the governor sole discretion; others require a clemency board recommendation before the governor can act. Eligibility rules often set a minimum portion of the sentence that must be served before an application will be considered.5National Governors Association. Once granted and accepted, a pardon cannot be revoked by a later president. The Constitution provides no mechanism for undoing it.
What a Pardon Still Won’t Do
People tend to overestimate what a pardon accomplishes in everyday life. It restores civil rights and removes legal penalties, but several real-world consequences of a conviction can outlast it.
Background Checks
A pardon does not erase the conviction from existence. The historical fact that you were convicted, and then pardoned, generally remains visible in criminal databases and can show up on background checks. Federal law does not bar employers from considering a pardoned conviction in hiring, though some state and local laws limit how criminal history can be used.
Restitution and Fines
The relationship between a pardon and court-ordered restitution is less clean than most people expect. The Supreme Court’s reasoning in Knote suggested that a pardon does not undo financial consequences already imposed, particularly where money has already been paid into the Treasury.2Cornell Law School Legal Information Institute. Legal Effect of a Pardon A pardon warrant can be written to remit outstanding fines and restitution, and recent presidential clemency actions have done so. Whether restitution survives a pardon depends heavily on the pardon’s own language.
Firearms
Federal law prohibits anyone convicted of a felony from possessing firearms.8Office of the Law Revision Counsel. 18 US Code 922 – Unlawful Acts For state convictions, a pardon that restores civil rights generally lifts the firearms bar, though courts examine the law of the state where the conviction occurred to decide whether the restoration was complete enough to qualify.9Department of Justice Archives. Criminal Resource Manual 1435 – Post-Conviction Restoration of Civil Rights For federal convictions, the Supreme Court held in Beecham v. United States (1994) that only federal law can remove the federal firearms disability, and no general federal procedure does so apart from a presidential pardon or a petition for relief under 18 U.S.C. ยง 925(c).10Office of the Law Revision Counsel. 18 USC 925 – Exceptions, Relief From Disabilities
Immigration
For non-citizens, a full and unconditional pardon from the president or a governor eliminates certain deportation grounds, including those tied to crimes involving moral turpitude, multiple convictions, aggravated felonies, and high-speed flight from checkpoints. The pardon exception does not cover every removable offense. Drug convictions, for instance, fall outside it. The effect of a pardon on inadmissibility, as opposed to deportation, is less settled, with conflicting court decisions.
Related Forms People Mix Up With These Two
Executive clemency includes a few other tools that get confused with pardons and commutations.
- A reprieve is a temporary postponement of a sentence, most often used to delay an execution. It pauses the clock without reducing or forgiving anything.
- Amnesty has the same legal effect as a pardon but is granted to a group rather than an individual, often for political offenses where prosecution is deemed less useful than reconciliation.11Library of Congress. Amnesties – Constitution Annotated
- Expungement seals or destroys the record so that it no longer appears in most public searches. It is a judicial process, not an executive one, and availability varies by jurisdiction and offense.
The pardon-versus-expungement mix-up is the one that trips people up most. A pardoned person has been forgiven but still has a record. An expunged record has been sealed as if it never happened. A genuinely clean slate may require both, depending on where you live.
