If an officer stops you for something else, like speeding or a broken taillight, you can still be cited for the expired sticker. The four-month rule only limits when the sticker itself can be the reason for the stop.

What most drivers miss is that each day you drive or park the vehicle on a Virginia highway with an expired sticker counts as a separate offense.1Virginia Code Commission. There is a protection built into the citation itself. If an officer writes you up for an expired inspection, that same officer cannot also cite you for the underlying equipment defects the inspection would have caught, such as bad brakes, burned-out lights, or worn tires. Penalty for an Expired Emissions Inspection
Emissions violations are treated much more seriously. Under Virginia Code § 46.2-1187, a first emissions violation is a Class 3 misdemeanor carrying a fine of up to $500.4Virginia Code Commission. Unlike the safety inspection, this is a criminal misdemeanor.
Emissions inspections apply only if your vehicle is garaged in one of these Northern Virginia localities:6Virginia DMV. Emissions Inspections
- Counties: Arlington, Fairfax, Loudoun, Prince William, and Stafford
- Cities: Alexandria, Fairfax, Falls Church, Manassas, and Manassas Park
If your vehicle is garaged anywhere else in Virginia, the emissions rules and their misdemeanor penalty don’t apply to you. Only the safety inspection does.
How to Get the Ticket Dismissed
Virginia courts have discretion to dismiss an expired inspection summons if you show proof that the vehicle was brought into compliance after the citation was issued.2Virginia Code Commission. If You’re Military or Out of State
Virginia residents on active military duty stationed outside the state get a real exception. If your sticker expires while you’re temporarily out of state for another reason, like school or extended travel, Virginia does not grant an extension. What It Can Cost You With Your Insurer
An expired sticker won’t automatically void your insurance, but it can complicate a claim. If you’re in an accident and the vehicle had mechanical defects an inspection would have flagged, your insurer can argue those defects contributed to the crash and delay or reduce the payout. That’s especially true when the defect is directly tied to the accident, such as failed brakes or bald tires. A current inspection removes one argument an insurer could use against you.
