No state requires marriage counseling before a standard divorce. The question of what states require marriage counseling before divorce has a narrow answer: only Arizona, Louisiana, and Arkansas impose a true counseling requirement, and only on couples who chose a covenant marriage when they got their license. Most of the “counseling” requirements people hear about are actually parent education courses for divorcing parents of minor children, which teach co-parenting rather than try to save the marriage. A smaller group of states lets a judge or spouse invoke conciliation services in specific circumstances, but these are conditional, not blanket mandates.
Which category applies to you depends on three things: the type of marriage license you signed, whether you have minor children, and the state you’re filing in.
Covenant Marriages in Arizona, Louisiana, and Arkansas
A covenant marriage is a separate, optional marriage contract that both spouses must affirmatively choose at the time they get their license. It requires premarital counseling and creates counseling obligations if the marriage later heads toward divorce. If you signed a standard marriage license in one of these three states, none of this applies to you.
Arizona
Arizona covenant spouses sign a declaration of intent that includes the pledge: “If we experience marital difficulties, we commit ourselves to take all reasonable efforts to preserve our marriage, including marital counseling.”1Arizona Legislature. Arizona Revised Statutes 25-901 – Covenant Marriage Declaration of Intent Filing Requirements Dissolving a covenant marriage requires proving specific grounds such as adultery, a felony conviction, or mutual agreement to dissolve after counseling.2Arizona Legislature. Arizona Revised Statutes 25-903 – Dissolution of a Covenant Marriage Grounds
Louisiana
Louisiana’s covenant marriage statute describes the arrangement as a lifelong relationship where “only when there has been a complete and total breach of the marital covenant commitment may the non-breaching party seek a declaration that the marriage is no longer legally recognized.”3Louisiana State Legislature. Louisiana Code 9:272 – Covenant Marriage Intent Conditions to Create Divorce is available only on exclusive statutory grounds, and the covenant cannot be dissolved by mutual consent alone.
Arkansas
Arkansas is the most explicit of the three. The statute states that a spouse may obtain a divorce or judicial separation from a covenant marriage only “subsequent to the parties’ obtaining authorized counseling.”4FindLaw. Arkansas Code 9-11-808 – Divorce or Separation Counseling is a formal prerequisite, not just a moral commitment. It can be provided by a member of the clergy or a licensed marriage counselor, and even after completing it the filing spouse still has to prove specific grounds such as adultery, abuse, or a lengthy separation.5Justia. Parent Education Courses Are Not Marriage Counseling
Roughly half the states require divorcing parents of minor children to attend an educational course, and these programs are what most online lists are referring to when they claim a state “requires counseling.” They are not designed to save the marriage. They cover how divorce affects children, co-parenting logistics, and family dynamics after the split. A 2022 national review found at least 28 states plus Washington, D.C. had some form of mandatory parent education for divorcing parents.
If you don’t have minor children, these requirements don’t touch your case. A few examples show the shape of the obligation.
Utah
Utah requires every party with minor children filing for divorce or temporary separation to complete a mandatory divorce orientation course under Utah Code 81-4-105.6Utah Legislature. Utah Code 81-4-105 – Mandatory Orientation Course for Divorce or Temporary Separation Actions The petitioner pays no more than $15 if they attend a live course within 30 days of filing; the respondent gets the same rate if they attend within 30 days of being served. Otherwise the fee can run up to $30. A party who cannot pay can ask the judge to waive the fee, and if granted, presents the signed order to the course provider. The court will not sign a final order until both parents have completed the course or obtained a waiver.7Utah State Judiciary. Mandatory Education in Divorce and Temporary Separation
Florida
Florida’s Parent Education and Family Stabilization Course runs at least four hours and covers the emotional impact of divorce on children, family dynamics, financial responsibilities, and co-parenting skills. All parties in a dissolution with minor children must complete it before the court enters a final judgment.8Florida Senate. Florida Code 61.21 – Parenting Course Authorized Fees Required Attendance Authorized Contempt At least one approved provider per circuit must offer a sliding fee scale for parents who cannot afford the standard rate.
Oklahoma
Oklahoma requires both parties in a divorce involving a child under 18 to attend an educational program about the impact of divorce on children. It must be completed before a temporary custody order is entered, or within 45 days of receiving one, and no final custody decision is issued until both parties finish.9Justia. Oklahoma Code 43-107.2 – Actions Where Minor Child Involved Court-Ordered Educational Program Courts can waive the requirement for good cause, though waivers are uncommon.
States Where a Judge or Spouse Can Invoke Counseling
Several states don’t require counseling for every divorce but let a judge or spouse trigger conciliation services in specific situations. These programs aim to preserve marriages where reconciliation looks realistic; they do not block divorce when it doesn’t.
Arizona has a dedicated conciliation court separate from its covenant marriage rules. Either spouse can file a petition before or after a divorce case opens, which triggers a temporary stay, typically lasting 60 days, while a conciliator works with the couple.10Arizona Legislature. Arizona Revised Statutes 25-381.09 – Petition Invoking Jurisdiction or for Transfer of Action to Conciliation Court This applies to any marriage.
Oregon allows circuit courts to establish conciliation services when local conditions warrant them. If a county has adopted conciliation jurisdiction, the court can require divorcing parties to participate at its discretion. Not every county offers these services.11Oregon State Legislature. Oregon Revised Statutes Chapter 107
Wisconsin uses a narrower trigger. When only one spouse says the marriage is irretrievably broken and the couple has not been living apart for at least 12 months, the court can continue the case for 30 to 60 days and suggest or order counseling if it finds a reasonable prospect of reconciliation.12Wisconsin State Legislature. Wisconsin Statutes 767.315 When both spouses agree the marriage is over, or they have already been separated for a year, the provision doesn’t come into play.
California and Ohio also offer conciliation programs, though structure varies by county. In every one of these states, conciliation is a tool, not a blanket requirement.
Domestic Violence Changes the Rules
Every state that mandates counseling, mediation, or conciliation has mechanisms to protect domestic violence victims from being forced into joint sessions with an abuser. States generally take one of three approaches: a total bar on mandatory mediation or joint counseling once domestic violence is established; a default requirement that a court can waive on a showing of good cause; or a prohibition on joint sessions unless both parties give written, informed consent.
If you have a protective order or a documented history of abuse, raise it with the court before any counseling or mediation is scheduled. Screening in many courts relies on parties self-reporting, so don’t assume the court will catch the issue on its own.
What Happens If You Skip a Required Course
Missing a required course or counseling deadline doesn’t dismiss your divorce, but it stalls it. In Utah, the court simply refuses to sign the final order until both parents have completed the orientation or obtained a waiver.7Utah State Judiciary. Mandatory Education in Divorce and Temporary Separation In Oklahoma, no final custody determination is issued until both parties finish the program.9Justia. Oklahoma Code 43-107.2 – Actions Where Minor Child Involved Court-Ordered Educational Program Florida’s statute authorizes the court to hold a non-compliant party in contempt.13Florida Senate. Florida Code 61.21 – Parenting Course Authorized Fees Required Attendance Authorized Contempt
The practical effect is the same across jurisdictions: the case sits in limbo until you complete the requirement. In custody cases, that limbo can leave temporary orders in place longer than necessary, which affects living arrangements and child support. If a course applies to you, finishing it early is the simplest way to avoid delay.
