What Was Jessica Mann’s Settlement With Weinstein?

Jessica Mann did not receive a settlement from Harvey Weinstein. She was not a named plaintiff or listed beneficiary of the roughly $17 million civil fund that compensated other Weinstein accusers, because her case moved through the criminal courts on a separate track. Her testimony was the basis for a criminal prosecution, not a civil claim for damages.¹

Why Mann Wasn’t Part of the Civil Fund

The civil settlement grew out of a class-action lawsuit brought by nine women against Weinstein and the Weinstein Company. It was designed to compensate women who had experienced sexual harassment, a hostile work environment, or sexual abuse connected to Weinstein or his company. Mann was not among the named plaintiffs.¹

Instead, Mann was the complaining witness in the Manhattan District Attorney’s criminal prosecution. That case produced Weinstein’s February 2020 conviction and his 23-year sentence handed down on March 11, 2020. A criminal conviction does not pay the victim; it puts the defendant in prison. Any money paid to accusers came out of the parallel civil and bankruptcy proceedings, which Mann did not join.²

The Civil Settlement She Wasn’t Part Of

A proposed $18.875 million settlement was announced in June 2020. Individual claimants could receive between $7,500 and $750,000 depending on the severity of their claims, with a Special Master overseeing distribution. The deal also released accusers from confidentiality and non-disparagement agreements tied to Weinstein’s misconduct.³⁴

The proposal drew sharp objections. Attorney Douglas Wigdor, representing six women who opposed it, called it “the worst settlement I’ve seen in my entire career.” Objectors noted that the fund was entirely insurance-backed, meaning Weinstein personally paid nothing while receiving a release from liability, and that millions were allocated toward his legal defense costs from the same pool meant for victims.⁵

In July 2020, U.S. District Judge Alvin Hellerstein rejected the settlement, calling it “unfair” for treating rape victims the same as women who had “merely met” Weinstein. He singled out the defense-cost provision as “obnoxious.”⁶

After the rejection, the claims process moved to U.S. Bankruptcy Court in Delaware, where the Weinstein Company had filed Chapter 11 in 2018. A reorganization plan including a survivors’ fund was confirmed on January 25, 2021. It was funded through the company’s liquidation and insurance contributions totaling $35 million. Of that, $17 million went to accusers and $9.7 million covered legal expenses for former company officers and directors. Accusers voted 39 to 8 in favor. Those who accepted payment gave up the right to pursue further litigation against the company; anyone who wanted to keep suing individually could opt out. The bankruptcy judge observed that without the plan, plaintiffs would likely see “minimal, if any, recovery.”⁷

Mann is not listed as a claimant in any of these accounts of the fund.¹

Mann’s Path Through the Criminal Courts

Mann’s allegations centered on a March 2013 incident at a DoubleTree hotel in Midtown Manhattan, where she testified Weinstein raped her after preventing her from leaving a room he had booked without her knowledge. Weinstein has denied the allegation, maintaining that all sexual contact between them was consensual.⁸⁹

Her testimony helped secure Weinstein’s February 2020 conviction and 23-year sentence. That conviction was later overturned on appeal, sending the case back for a new trial.²

At the 2025 retrial, which addressed charges involving Mann, Miriam Haley, and Kaja Sokola, the jury returned a split result on June 11, 2025. Weinstein was convicted of criminal sexual act in the first degree for the assault of Haley and acquitted on the count involving Sokola. On the third-degree rape charge involving Mann, the jury could not agree, and the court declared a mistrial on that count.¹⁰

Prosecutors tried Mann’s charge again in 2026. On May 15, 2026, Manhattan Justice Curtis Farber declared a second mistrial after three days of deadlocked deliberations. Defense attorneys said the final vote was nine to three in favor of acquittal.¹¹

Manhattan District Attorney Alvin Bragg said his office was “consulting with Mann about whether to retry the case,” with a decision expected by late June 2026.¹²

Where Things Stand

Weinstein, 74, remains incarcerated at Rikers Island awaiting sentencing on the June 2025 Haley conviction. He also has a 16-year California sentence from a 2022 rape and sexual assault conviction, ordered to run consecutively after his New York term, which he is appealing.¹³¹⁴

Whether Mann’s rape charge goes to a fourth trial is still open. What has not changed is her position on the money: she was not part of the civil settlement in 2020, not part of the bankruptcy fund confirmed in 2021, and no reporting since has placed her among the accusers who received a payout.¹⁵
