R. Kelly was charged with federal racketeering and sex trafficking in Brooklyn and with federal child pornography production, enticement of minors, and obstruction of justice in Chicago. He was convicted in both cases, in September 2021 and September 2022, and received an effective 31-year federal prison sentence. Separate state charges in Cook County, Illinois, and Hennepin County, Minnesota, were later dropped after prosecutors concluded the federal sentences were enough.
The New York Federal Case: Racketeering and Sex Trafficking
The Eastern District of New York indictment was the larger of the two federal cases. Prosecutors charged Kelly under the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. § 1962, alleging that he ran a criminal enterprise of managers, bodyguards, drivers, and personal assistants who helped him recruit and exploit victims for more than two decades.1Office of the Law Revision Counsel. 18 U.S. Code 1962 – Prohibited Activities The racketeering count rested on predicate acts that included bribery, sexual exploitation of a minor to produce recordings, kidnapping, and forced labor.
The indictment also brought eight Mann Act counts. Under 18 U.S.C. § 2421, it is a federal crime to knowingly transport someone across state lines with the intent that they engage in illegal sexual activity.2Office of the Law Revision Counsel. 18 USC 2421 – Transportation Generally A related statute, 18 U.S.C. § 2422, targets the use of phones, mail, or the internet to persuade or coerce a minor into sexual activity, and it carries a mandatory minimum of 10 years and a maximum of life.3Office of the Law Revision Counsel. 18 U.S. Code 2422 – Coercion and Enticement Evidence at trial showed members of the enterprise arranged travel, booked hotels, and paid for flights to bring women and girls to Kelly in different states.
In September 2021, a Brooklyn jury convicted Kelly on all nine counts: one count of racketeering and eight Mann Act violations.4U.S. Immigration and Customs Enforcement. “R. The Chicago Federal Case: Child Pornography, Enticement, and Obstruction
The Northern District of Illinois case involved different conduct and different victims. The lead charges were for child pornography production under 18 U.S.C. § 2251, which makes it a federal crime to employ, persuade, or coerce a minor to engage in sexually explicit conduct for the purpose of producing visual recordings. A first offense carries a mandatory minimum of 15 years and a maximum of 30.6Office of the Law Revision Counsel. 18 USC 2251 – Sexual Exploitation of Children
The Chicago indictment added enticement counts under § 2422 and obstruction and witness tampering counts under 18 U.S.C. § 1512.7Office of the Law Revision Counsel. 18 U.S. Code 1512 – Tampering With a Witness, Victim, or an Informant The obstruction theory was that Kelly and associates paid hundreds of thousands of dollars to recover incriminating video recordings and pressured witnesses to stay quiet before his 2008 state child pornography trial, which ended in acquittal.
In September 2022, a Chicago jury convicted Kelly on three counts of producing child pornography and three counts of enticing a minor. The jury acquitted him on seven other counts, including all of the obstruction and conspiracy charges tied to the 2008 cover-up allegations.8U.S. Immigration and Customs Enforcement. R. Kelly Sentenced to 20 Years Following HSI Chicago Investigation Judge Harry Leinenweber imposed a 20-year sentence, with 19 years running concurrent to the New York term. The practical effect was one additional year.
State Charges That Were Dropped
Kelly also faced state charges in two jurisdictions, both dropped after his federal convictions.
In Cook County, Illinois, prosecutors had charged him under the state’s aggravated criminal sexual abuse statute, 720 ILCS 5/11-1.60, which applies when a person at least five years older than the victim has sexual contact with someone between 13 and 16.9Illinois General Assembly. Illinois Code 730 ILCS 5/5-4.5-35 – Class 2 Felony In January 2023, State’s Attorney Kim Foxx announced her office was dropping the charges, saying the federal convictions in New York and Chicago meant justice had been served and that resources needed to be redirected to other cases and survivors.
In Hennepin County, Minnesota, prosecutors had charged Kelly in 2019 over a 2001 incident at a Minneapolis hotel, alleging he invited a 17-year-old girl to his room before a concert, paid her $200 to undress and dance, and engaged in sexual contact with her. In May 2023, the county attorney’s office dropped the case, stating that while it believed the survivor and expected a conviction, the federal sentences already ensured Kelly would spend most of his remaining life in prison.
Sentence, Restitution, and Release Date
Kelly’s two federal sentences combine to an effective 31 years. The New York sentence supplies 30 of those years, and the Chicago sentence adds one on top.4U.S. Immigration and Customs Enforcement. “R. The New York court also ordered roughly $300,000 in restitution to a victim identified in court records as “Jane,” a minor whom Kelly infected with herpes. About $270,000 covered a lifetime supply of brand-name antiviral medication, with the remainder for psychotherapy.
Appeals Are Exhausted
Both federal convictions have been affirmed. The Second Circuit upheld the New York conviction and 30-year sentence on February 12, 2025, rejecting Kelly’s arguments about sufficiency of the evidence, juror bias, ineffective assistance of counsel, and the constitutionality of the state laws underlying his federal charges.11Justia. United States v. Kelly The panel also upheld the restitution order, though one judge dissented in part on how the medication was valued.
The Seventh Circuit affirmed the Chicago conviction, and in October 2024 the U.S. Supreme Court declined to hear Kelly’s appeal without giving a reason. Kelly had argued that the federal statute of limitations for the sex offenses expired in 2009 and that later amendments extending the limitations period to the victim’s lifetime could not apply retroactively. Neither court accepted that argument. With appellate avenues closed, the convictions and sentences are final.
