When Will Exactech Lawsuits Settle? Bankruptcy, TPG, and Payouts

The Exactech lawsuits have not settled, and as of mid-2026 there is no global settlement, no completed bellwether trial, and no published framework for paying injured patients. The most optimistic legal projections put a possible settlement structure no earlier than late 2026, with individual payouts reaching claimants sometime in 2027.¹ Exactech’s Chapter 11 filing in October 2024 is the main reason the timeline has slipped, and the bankruptcy plan that emerged in late 2025 left a critical piece unresolved: how personal injury claimants will actually be compensated.

Where the Litigation Stands

The federal cases are consolidated as MDL 3044 in the U.S. District Court for the Eastern District of New York before Judge Nicholas G. Garaufis, with roughly 1,838 lawsuits pending there.²³⁴

Before the bankruptcy, the court had lined up four bellwether trials — test cases involving plaintiffs Gayle Tarloff, Geraldine Larson, Dana Kessler Kramer, and David Caputo — with jury selection for the first two set for mid-2025 and the remaining trials running through early 2026.⁵ None of them happened. When Exactech filed Chapter 11, an automatic stay froze every case in both federal and state court.⁶ Even after the company exited bankruptcy, proceedings have been slow to restart, and no bellwether has produced a verdict.

How the Bankruptcy Reshaped the Timeline

Exactech filed for Chapter 11 on October 29, 2024, in the U.S. Bankruptcy Court for the District of Delaware.⁷ U.S. Bankruptcy Judge Laurie Selber Silverstein approved a revised reorganization plan on September 15, 2025, and the plan took effect on October 31, 2025. Substantially all of the company’s operations and assets were sold to an investor group led by Strategic Value Partners, Stellex Capital Management, and Greywolf Capital Management; the purchase price was not publicly disclosed.⁸

One detail matters more than any other for people waiting on compensation. Judge Silverstein noted that the confirmed plan did not specify how personal injury and wrongful death claimants would actually be paid, calling it the first time she had confirmed a plan without that methodology in place.⁹ As of mid-2026, that gap has not been publicly filled. Legal observers have cautioned that whatever payouts emerge will likely be lower than they would have been if the company had stayed solvent.⁶

What Still Has to Happen Before Anyone Gets Paid

A few things need to fall into place before injured patients see money, and none of them are close to done.

The MDL has to fully resume. Now that Exactech is out of bankruptcy the stay should be liftable, but activity has been slow.
Bellwether trials need to produce results. Those verdicts are what give both sides a realistic basis to negotiate. None has taken place.
A global settlement framework has to be negotiated. Mediation could begin in mid-to-late 2026, with a framework possibly proposed by late 2026 at the earliest.¹
Individual claims have to be processed. Even after a framework is in place, claimants would need to submit documentation and wait for review and distribution. Payments have been projected for 2027 at the earliest.¹

Anyone quoting a firm settlement date right now is guessing. The bankruptcy court itself flagged that the compensation mechanism does not yet exist, which is the single biggest reason to distrust confident timelines.

The TPG Capital Lawsuit and the Money Pool

How much money is available to pay claimants depends partly on a separate case now moving through the Delaware Court of Chancery. Private equity firm TPG Capital acquired Exactech in February 2018 for approximately $737 million.¹⁰ An early version of the bankruptcy plan would have released TPG from all liability in exchange for a $10 million payment; creditors fought that provision and won, and the revised plan created a $2 million litigation trust to pursue TPG directly.⁹

On February 5, 2026, the Exactech Settlement Trust filed suit against TPG seeking at least $1 billion in damages. The complaint pursues alter ego and veil piercing theories, breach of fiduciary duty, fraudulent transfer, and aiding and abetting, and alleges that after taking over in 2018 TPG directed a strategy to conceal known product defects.¹¹ That case is in its early stages. If it succeeds, recoveries from TPG could supplement what the Exactech estate alone can pay. If it stalls or fails, the money available to injured patients is smaller. Either way, it adds another variable to the resolution timeline.

What Individual Payouts Might Look Like

Because there have been no verdicts and no approved settlements, every dollar figure being circulated is a projection drawn from comparable orthopedic device cases. A range commonly cited by plaintiff attorneys is $100,000 to $300,000 per plaintiff, based on prior knee replacement litigation.⁶ Other estimates run from $50,000 to more than $500,000 for serious injuries.

Several factors will drive what any individual receives:

Whether revision surgery was required. Cases with a second operation typically command significantly higher compensation.
The severity of complications, including bone loss, chronic pain, and joint instability.
Total medical expenses.
The plaintiff’s age and life expectancy.⁶

Wrongful death claims would sit at the top end of any eventual scale. Contingency fees, typically 33% to 40%, come out before a plaintiff sees the net figure. And any projection has to be discounted by the bankruptcy reality: the money pool is finite, the plan has no compensation methodology yet, and the amount actually available is not something anyone outside the negotiations can pin down.

A Note on Broadspire and Direct Offers

Broadspire is a third-party administrator Exactech hired to handle limited reimbursement claims. It covers out-of-pocket costs like mileage, insurance co-pays, and some lost wages tied to revision surgery, and it does not pay for pain and suffering. It is not the lawsuit resolution. Broadspire is an agent of Exactech and shares information, including medical records, with the company. Getting a Broadspire claim number does not by itself bar someone from suing, but attorneys have warned that communications with Broadspire are not protected by attorney-client privilege and can be used in litigation.¹² Exactech may also extend direct compensation offers to patients with recalled implants; accepting one can limit the ability to pursue a lawsuit later.⁶ Anyone waiting on the litigation should understand that these programs are separate from it and can affect their claim.
