Where Is Ryan Duke Now? Sentence, Parole Denial, and 2026 Appeal

Ryan Duke is currently in Georgia state prison, serving a 10-year sentence for concealing the death of Ocilla teacher Tara Grinstead. He was denied parole in June 2023, and his maximum release date is February 12, 2027.¹ At the time of that parole denial, he was being held at Georgia Diagnostic and Classification State Prison in Jackson. In March 2026, the Georgia Court of Appeals affirmed his conviction, closing off his most recent challenge.²

Why the Sentence Is Only Ten Years

Duke was originally indicted in April 2017 on malice murder, felony murder, aggravated assault, burglary, and concealing a death. Prosecutors alleged he strangled Grinstead during a botched burglary of her home in October 2005. He gave a recorded confession to Georgia Bureau of Investigation agents after his February 23, 2017 arrest, describing the killing and saying he had helped his former roommate Bo Dukes burn Grinstead’s body at a pecan orchard.³

At trial in May 2022, Duke took the stand and recanted the confession. He testified he had been passed out at a mobile home the night Grinstead disappeared, and that Bo Dukes woke him the next morning and took him to the orchard, where Grinstead’s body already lay. Duke said he helped burn the body out of fear. His attorneys argued the 2017 confession was false, given while he was sleep-deprived and on pain medication.⁴ Bo Dukes was called to testify but invoked his Fifth Amendment right.

On May 20, 2022, the jury acquitted Duke of murder, aggravated assault, and burglary. It convicted him only of concealing the death of another.⁵ Three days later, Chief Superior Court Judge Bill Reinhardt imposed the maximum penalty available under Georgia law for that single count: 10 years. Duke received credit for the five years and two months he had already spent in jail since his 2017 arrest.

Parole Denial and Release Date

Duke was declared immediately eligible for parole at sentencing.⁶ In June 2023, the Georgia State Board of Pardons and Paroles denied his request for early release, stating it “would not be compatible with the welfare of society.”¹ Absent a successful appeal or a later parole grant, he is set to complete his sentence and be released on February 12, 2027.

The 2026 Appeal

On March 12, 2026, the Georgia Court of Appeals affirmed Duke’s Irwin County conviction in Duke v. State, Case No. A25A1714. The court rejected each of his four arguments.²

On sufficiency, the court found the recorded confession, DNA from a latex glove, and a palm print were enough for a jury to conclude the crime of concealing a death occurred in Irwin County.
On the statute of limitations, the court held the four-year clock was tolled because the crime was “unknown” to the state until Duke’s 2017 confession. Tolling requires actual, not constructive, knowledge by the state.
On the removal of a juror observed sleeping, the court found no abuse of discretion. The juror admitted falling asleep after working a night shift.
On the admission of a certified copy of Bo Dukes’ 2019 Wilcox County convictions, the court held it came in for impeachment, not for the truth of the underlying facts, and did not violate the Confrontation Clause.

Ashleigh Merchant, one of Duke’s attorneys, said in early 2025 that she planned to appeal the Irwin County conviction further, noting he had roughly 18 months left on his sentence at that point.⁷

Additional Charges Have Been Dismissed

Shortly after his 2022 trial, prosecutors filed a second set of charges against Duke in Ben Hill County: concealing a death, hindering apprehension, concealment of facts, and evidence tampering, all tied to the burning of Grinstead’s body at a pecan orchard in that county.⁷ Those charges had the potential to extend his time in custody.

In February 2025, the Georgia Court of Appeals dismissed them on statute-of-limitations grounds. The court ruled that law enforcement had probable cause to arrest Duke and Bo Dukes by late November 2005, when a witness reported to the sheriff’s office that both men had confessed at a party to killing Grinstead and burning her body. Because charges were not filed until 2017 and later, the four-year limitations period had long expired.⁸ The Georgia Supreme Court denied certiorari in a related interlocutory appeal on May 28, 2025.²

“We have a statute of limitations for a reason,” Merchant said. “Waiting 19 something years to arrest people when you have probable cause back in 2005 is not OK.”⁷

Where Bo Dukes Is

Bo Dukes, the former roommate Duke blamed at trial, was tried separately in 2019 in Wilcox County and convicted of making false statements, concealing a death, and hindering the apprehension of a criminal. He received a 25-year prison sentence.⁹ The Ben Hill County charges against him were dismissed in the same February 2025 ruling that tossed Duke’s.

In November 2023, Dukes pleaded guilty in Houston County to two counts of aggravated assault with intent to rape and one count of possession of a firearm by a convicted felon, arising from two unrelated 2017 and 2019 cases. More than a dozen other counts were dismissed in the plea.¹⁰ Those sentences run concurrently with his 25-year term, so no additional prison time was added. He is housed at Central State Prison and is scheduled for release in 2044, at which point he must register as a sex offender.¹¹

No one has been convicted of Tara Grinstead’s killing. Duke maintains Bo Dukes was responsible for her death; Bo Dukes has never been charged with her murder and invoked the Fifth Amendment when called at Duke’s trial. The available reporting does not indicate that authorities are pursuing new charges against anyone in connection with the killing itself.
