Almost any adult who knows you well enough to speak credibly about a relevant trait can be a character witness. Federal Rule of Evidence 601 presumes every person competent to testify, and there is no licensing requirement, minimum education, or formal relationship threshold for who can serve as a character witness.1Cornell Law School. Federal Rules of Evidence Rule 601 – Competency to Testify in General What matters is whether the witness has enough genuine experience with you to form an opinion or speak to your reputation, and whether a judge and jury will find them credible.
The Formal Bar Is Low
Any competent adult can take the stand. Before testifying, the witness must swear an oath or affirmation to tell the truth, and lying under that oath is perjury under 18 U.S.C. ยง 1621.2Legal Information Institute. Federal Rules of Evidence Rule 603 – Oath or Affirmation to Testify Truthfully Past that, the court and the opposing attorney will size up the witness’s credibility. A character witness who seems vague, evasive, or unable to explain how they know you will hurt more than they help.
Who Typically Makes a Good Character Witness
Long-Time Friends and Close Family
A sibling who has watched you raise your children or a friend who has stood by you through career changes can speak to your values and temperament over years. The weakness is obvious: judges and juries know these witnesses are likely biased. That does not disqualify them, but their testimony gets filtered through skepticism.
Employers, Supervisors, and Colleagues
Workplace witnesses often carry extra weight because the relationship is more arm’s-length. A supervisor can speak to reliability, honesty, and composure under pressure in a way a parent cannot. There is a catch worth knowing. If your employer vouches for your character, the opposing attorney can cross-examine them about specific conduct that undercuts that image. Rule 405(a) allows inquiry into relevant instances of your behavior on cross, which could include workplace disciplinary issues or complaints.3Cornell Law School. Federal Rules of Evidence Rule 405 – Methods of Proving Character An employer who does not know about a past workplace incident can be blindsided on the stand, which damages both their credibility and your case.
Coaches, Clergy, Teachers, and Mentors
Community figures are valuable because they appear neutral. A pastor or youth coach who has watched you in community settings can speak to your character without the obvious stake a family member has in the outcome. The strongest character witnesses combine two qualities: they know you well enough to be specific, and they do not have an obvious personal reason to shade their testimony.
Who You Should Not Ask
Anyone With Credibility Problems of Their Own
Federal Rule of Evidence 608(a) lets any witness’s character for truthfulness be attacked through reputation or opinion testimony.4Cornell Law School. Federal Rules of Evidence Rule 608 – A Witness’s Character for Truthfulness or Untruthfulness Prior criminal convictions are the most common landmine. Under Rule 609, convictions involving dishonest acts or false statements can be used to impeach any witness regardless of severity. If your witness has a fraud or perjury conviction, the opposing attorney will raise it, and the jury may discount everything that witness says.
People Who Barely Know You
A casual acquaintance or someone you met recently cannot give the substantive, observation-based testimony courts find useful. Rule 405 expects opinion testimony to be grounded in the nature and extent of the witness’s observation and acquaintance with you.3Cornell Law School. Federal Rules of Evidence Rule 405 – Methods of Proving Character A witness who cannot explain how they know you will be exposed quickly on cross.
Your Own Trial Lawyer
The attorney representing you generally cannot also testify in the same case. Model Rule of Professional Conduct 3.7 bars a lawyer from acting as advocate at a trial where the lawyer is likely to be a necessary witness, with narrow exceptions for uncontested issues, testimony about the value of legal services, or when disqualification would cause substantial hardship to the client.5American Bar Association. Model Rules of Professional Conduct Rule 3.7 – Lawyer as Witness Another lawyer in the same firm can usually testify, as long as no conflict of interest exists.
Whether Character Witnesses Are Even Allowed in Your Case
Before you line up witnesses, confirm that character evidence is admissible in the kind of proceeding you are facing. The rules are strict.
Federal Rule of Evidence 404(a)(1) says evidence of a person’s character is generally not admissible to prove the person acted in line with that character on a particular occasion.6Cornell Law School. Federal Rules of Evidence Rule 404 – Character Evidence; Other Crimes, Wrongs, or Acts In a civil lawsuit, character evidence is essentially off the table for that purpose. The 2006 amendment to Rule 404 made that explicit.
The main opening is in criminal cases. A defendant may introduce evidence of a pertinent character trait as part of their defense. If you are charged with assault, you can call a witness to testify about your reputation for peacefulness. If you are charged with fraud, a witness can speak to your reputation for honesty.6Cornell Law School. Federal Rules of Evidence Rule 404 – Character Evidence; Other Crimes, Wrongs, or Acts The trait must connect directly to the charge.
Family court is more flexible. Judges in custody disputes have broad discretion to hear testimony about a parent’s fitness, temperament, and involvement with children. Specific examples of parenting behavior tend to carry more weight than general praise.
Sentencing is where character testimony has its widest reach. Federal Rule of Criminal Procedure 32 requires the court to let the defendant speak and present information to mitigate the sentence.7Cornell Law School. Federal Rules of Criminal Procedure Rule 32 – Sentencing and Judgment Judges can consider personal history, family circumstances, community ties, and rehabilitation efforts. Live testimony is sometimes used, but written character letters are far more common. The letters that work are specific. A letter saying someone is “a wonderful person” carries almost no weight. A letter from a supervisor describing five years of mentoring younger employees, or from a neighbor explaining concrete community involvement, gives the judge something to weigh. Letters that acknowledge the seriousness of the offense rather than minimize it tend to land better.
What a Character Witness Can Actually Say
Once called, your witness is on a short leash. Rule 405(a) limits character testimony to two forms: the witness’s personal opinion of your character trait, or their knowledge of your reputation in the community for that trait.3Cornell Law School. Federal Rules of Evidence Rule 405 – Methods of Proving Character That is it on direct examination. The witness cannot catalog your good deeds. Saying “she returned a wallet full of cash she found in a parking lot” is not allowed as proof of honesty when your lawyer is questioning the witness.
On cross-examination, the rules loosen. The opposing attorney can ask the witness about specific instances of your conduct to test whether the witness really knows you or is just offering empty praise. Unprepared witnesses get caught by this constantly.
The Risk of Opening the Door
Calling a character witness in a criminal case is a strategic decision with real consequences. Under Rule 404(a)(2)(A), once a defendant introduces evidence of a good character trait, the prosecution can respond with evidence rebutting that same trait.6Cornell Law School. Federal Rules of Evidence Rule 404 – Character Evidence; Other Crimes, Wrongs, or Acts If you call a witness to praise your honesty, the prosecution can bring its own witnesses to testify about your reputation for dishonesty. Before you opened that door, the prosecution had no right to introduce that evidence. A character witness who paints too rosy a picture invites the prosecution to tear it apart.
Practical Points for the Witness
Prepare your witness for the possibility of being kept out of the courtroom until it is their turn. Under Rule 615, either party can ask the court to exclude witnesses during other testimony, and the judge must grant that request.8Office of the Law Revision Counsel. Federal Rules of Evidence Rule 615 – Exclusion of Witnesses The point is to stop witnesses from tailoring what they say to match what others have already said. Parties, designated organizational representatives, and people essential to a party’s case are the only exceptions. A standard character witness is not any of those, so expect to wait in the hall.
Most character witnesses appear voluntarily. If a witness is compelled through a subpoena instead, federal law entitles them to a $40 per day attendance fee plus mileage.9Office of the Law Revision Counsel. 28 USC 1821 – Per Diem and Mileage Generally Knowing subpoena power exists matters when a key witness is reluctant to get involved.
