Why Unified Lawsuit: Tracchi, Le, and BBB Complaints

A Why Unified lawsuit search turns up litigation running in both directions: a New Jersey customer, James Tracchi, sued the company for breach of contract and won a default in October 2025; another customer, Minh Le, is asking a Florida federal court to confirm an arbitration award against it; and Why Unified itself sued five people it accused of coordinating a smear campaign, a case that was dismissed after settlements. Around those cases sits a larger pattern: an F rating from the Better Business Bureau, 189 complaints in three years, and a consistent allegation that the company’s “done-for-you” Amazon stores never produced the income its sales pitch promised.¹

What Customers Say Went Wrong

The complaints on file describe a recognizable script. Customers paid startup fees ranging from roughly $7,100 to $15,500, sometimes with additional “fulfillment credits” of $500 to $2,000 on top. Sales pitches reportedly included revenue guarantees of about $10,000 per month and money-back promises tied to those projections.²

The reported results ran far below those numbers. Many customers cited total revenue under $300 to $400 after a full year. One customer who paid nearly $14,000 in June 2024 said the company attempted to sell only three products over twelve months, generated zero sales, and deactivated the store without notice by December 2024.³

Several customers also reported that their Amazon accounts were flagged or permanently suspended for counterfeit listings or deceptive supply-chain activity, problems they attributed to inventory sourced by Why Unified.² For anyone selling on Amazon, a suspension tied to counterfeit or deceptive conduct is not a small side effect.

Refunds, Non-Disparagement, and the BBB’s Concerns

The performance-based money-back language has not translated into easy refunds, according to BBB records. Customers describe a “Compliance Dashboard” that is supposed to process refunds but functions as a bottleneck. One customer reported that identity verification through the dashboard had been pending for more than a month against a stated one-to-two business day turnaround.³

The BBB has flagged additional practices. The company’s terms of service and non-disclosure agreements contain non-disparagement clauses prohibiting customers from publicly discussing the platform. The BBB says Why Unified has required customers to close their BBB complaints as a condition of internal resolution, and has asked customers to remove information from the BBB before giving them access to their compliance accounts.¹

Tracchi v. Why Unified Corp (New Jersey, 2025)

In March 2025, James Tracchi filed a breach-of-contract suit against Why Unified Corp in Mercer County Superior Court in New Jersey. The complaint alleges Tracchi entered into a contract with the company in or around November 2023. The case was assigned to Judge R. Brian McLaughlin.⁴

Why Unified did not respond. The court entered a default against the company on October 15, 2025, meaning it found the company had failed to appear or defend itself. The case remained open as of the most recent available records.⁴

Le v. Why Unified Corp (Federal Court, 2025–2026)

Minh Le, one of the individuals Why Unified had sued in Florida, filed his own case in federal court. In December 2025, Le petitioned the Middle District of Florida to confirm an arbitration award against Why Unified Corp.⁵

The case, before Judge Steven D. Merryday, has been slowed by difficulty serving Why Unified with legal papers. A magistrate judge denied Le’s motion for substitute service in March 2026, then granted a renewed motion in May 2026. Le filed proof of service later that month. As of June 2026, the case was still active with no ruling on whether the arbitration award would be confirmed.⁵

Why Unified’s Own Lawsuit Against Critics

Why Unified has also been a plaintiff. In May 2025, the company sued five individuals in Florida’s Sixth Judicial Circuit in Pinellas County: Brendan Conway Neal, Anthony Monte, Gaetano Gerace, Ki Von Drehle Bishop, and Minh Le. It sought compensatory damages exceeding $50,000.⁶

The complaint alleged the defendants ran a coordinated effort to damage the business by encouraging other customers to post negative reviews, file regulatory complaints, and initiate fraudulent credit card chargebacks. Why Unified also claimed the defendants fabricated and posted false information online, and harassed executives with threats that required law enforcement involvement.⁶ A companion press release described the action as an effort to “protect sellers from marketplace abuse,” alleging some defendants impersonated Amazon or claimed governmental authority in phishing-style emails aimed at getting sellers to disconnect Why Unified’s apps.⁷

The case did not reach a hearing. It was dismissed on October 15, 2025, with notices of voluntary dismissal filed and settlement notices recorded for at least two defendants, Ki Von Drehle Bishop and Anthony Monte.⁶

Which Entity You Are Actually Dealing With

The corporate name on customer contracts has changed. In February 2026, Why Unified Corp merged into Why Unified App LLC under Florida law, and the new entity took on responsibility for all prior obligations.⁸ A related entity, Why Unified Logistics LLC, was formed in Florida in December 2024 and became inactive after that merger.⁹ Anyone pursuing a claim tied to a pre-2026 contract is now dealing with Why Unified App LLC as the successor.
