Britney Spears was placed under a conservatorship in February 2008 because a Los Angeles judge found, by clear and convincing evidence, that she could not care for her own personal needs or manage her finances. The immediate trigger was two involuntary psychiatric holds within a single month in January 2008. The broader context was a year of public crisis, a bitter custody battle with ex-husband Kevin Federline, and a pattern of behavior that her father, Jamie Spears, cited when he petitioned the court to be appointed as her conservator.
The 2007 Crisis and the Two Psychiatric Holds
Throughout 2007, Britney Spears went through a highly public unraveling while the tabloid press documented every moment. She was fighting Federline for custody of their two sons. A series of incidents drew intense coverage, including the night she shaved her head at a hair salon and an episode in which she struck a photographer’s car with an umbrella.
By January 2008, the situation had escalated into a medical emergency. Britney was placed on two separate involuntary psychiatric holds under California’s Section 5150 within weeks of each other. A 5150 hold allows a peace officer or mental health professional to detain someone for up to 72 hours if they believe the person is a danger to themselves or others, or is gravely disabled as the result of a mental health disorder.1California Legislative Information. California Code Welfare and Institutions Code 5150 – Detention of Persons with a Mental Health Condition for Evaluation and Treatment The first hold took her to Cedars-Sinai Medical Center. The second, later that month, took her to UCLA Medical Center.
Those back-to-back hospitalizations are what gave the court contemporaneous medical documentation of a serious crisis. Without them, the petition that followed would have had far less to stand on.
The Legal Standard Her Father Used
On February 1, 2008, Jamie Spears filed a petition in Los Angeles Superior Court asking to be appointed his daughter’s conservator. The authority for that kind of arrangement comes from California Probate Code Section 1801, which allows a court to appoint a conservator of the person for someone who cannot properly provide for their own physical health, food, clothing, or shelter.2California Legislative Information. California Code PROB 1801 – Persons for Whom Conservator May Be Appointed The same statute allows a conservator of the estate for someone who is substantially unable to manage their own financial resources or resist fraud or undue influence.
The standard of proof is clear and convincing evidence, which is higher than the typical civil standard but lower than what a criminal case requires.2California Legislative Information. California Code PROB 1801 – Persons for Whom Conservator May Be Appointed Jamie Spears’s petition argued that the two psychiatric holds, combined with the surrounding chaos, met that bar.
The court agreed, and a temporary conservatorship was granted the same day. Temporary conservatorships are emergency measures used when a situation cannot wait the standard 30 days for a full hearing on a general conservatorship.3California Courts. Petition For Appointment of Temporary Conservator GC-111 By the end of 2008, court-appointed investigators had reviewed the situation and the judge converted the temporary order into a general conservatorship with no set end date. Formal Letters of Conservatorship were issued, serving as official proof that a conservator had been legally appointed.4California Courts. Letters of Conservatorship GC-350
What the Court Actually Granted
The court set up a dual structure. Jamie Spears was appointed conservator of the person. Jamie Spears and attorney Andrew Wallet served as co-conservators of the estate. A conservatorship of the person covers someone’s care and protection; a conservatorship of the estate handles their finances, and a judge can assign both roles to one individual or split them.5California Courts. Conservatorships
As conservator of the person, Jamie Spears had care, custody, and control over his daughter’s daily life. Under California law, a conservator of the person holds broad authority unless the court specifically limits it, though the conservatee keeps certain personal rights, such as receiving visitors, phone calls, and mail, unless a court order says otherwise.6California Legislative Information. California Code PROB 2351 – Powers and Duties of Guardian or Conservator of the Person In practice, decisions about her medical treatment, housing, security, and visitors were made for her.
On the financial side, the co-conservators managed an estate estimated at $60 million. They could sign contracts, negotiate business deals, control her bank accounts, and manage investments. One of the most commercially successful entertainers in the world did not control the money she earned.
The Contradiction That Would Later Draw Scrutiny
Conservatorships are generally designed for people too impaired to function independently. Britney kept working at an extraordinary pace. She judged “The X Factor,” reportedly earning $15 million for one season. She launched a Las Vegas residency at Planet Hollywood, performing 48 shows a year under a contract worth roughly $15 million annually. She released albums and toured.
The law accommodates that contradiction. A person can be functional enough to perform professional work and still, in a court’s view, lack the legal capacity to manage their own affairs. A 2014 court order reportedly found that Britney was incapable of consenting to medical treatment, even as she was performing demanding live shows multiple nights a week. The distance between her professional output and her legal status was the central tension that eventually fueled public outrage and a reexamination of the original rationale.
How the Original Justification Was Later Challenged
The reasoning that put Britney under the conservatorship in 2008 did not hold up forever. On June 23, 2021, she addressed the court directly for about 20 minutes and described conditions people had assumed did not exist. She said she had been forced to tour in 2018 under threat of lawsuit from her own management. She described being abruptly switched from a medication she had taken for five years to lithium, with six nurses stationed in her home around the clock. She said she wanted her IUD removed so she could try to have another baby, and her conservators would not allow her to visit a doctor to have it taken out.
Under California law, a conservatee, the conservator, or any relative or friend can petition the court to end a conservatorship by showing it is no longer required.7California Public Law. California Probate Code Section 1861 On September 29, 2021, Judge Brenda Penny suspended Jamie Spears as conservator of the estate, calling the arrangement “untenable” and saying it “reflects a toxic environment which requires the suspension of James Spears.” On November 12, 2021, Judge Penny terminated the conservatorship entirely, stating it was “no longer required, effective immediately.” After 13 years and 9 months, the legal findings that had placed Britney Spears under her father’s control in 2008 no longer governed her life.
