President Donald Trump has not pardoned Ghislaine Maxwell, and as of mid-2026 the White House maintains that “no leniency is being given or discussed.”1BBC News. Ghislaine Maxwell Offers to Speak if Granted Clemency Whether Trump will pardon Ghislaine Maxwell remains an open question he has repeatedly declined to answer definitively, and his public comments have shifted between ruling it out, saying he would “take a look,” and insisting he has not thought about it. Maxwell is serving a 20-year federal sentence for sex trafficking a minor and related offenses, and her legal appeals are exhausted. Clemency is the only remaining path to her release before her sentence ends.
What Trump Has Said About a Maxwell Pardon
Trump’s statements have moved in three directions over roughly four months in 2025, and none of them amounts to a commitment.
On July 25, 2025, with Maxwell’s Justice Department interviews in the news, Trump told reporters: “Obviously, this is no time to be talking about pardons.”2The Guardian. Ghislaine Maxwell Meets Justice Department Official
On October 6, 2025, the day the Supreme Court declined to hear Maxwell’s appeal, Trump softened. Asked in the Oval Office whether he would set Maxwell free, he said: “I haven’t heard the name in so long. I can say this, that I’d have to take a look at it. I would have to take a look… I’ll speak to the DOJ.”3The Hill. Maxwell Pardon Trump Review
On November 12, 2025, White House Press Secretary Karoline Leavitt told reporters Trump had “no plans to pardon” Maxwell.4Axios. Maybe I haven’t thought about it at all.” Pressed on why he would not rule it out, he said: “I don’t rule it in or out. I don’t even think about it.”5GovInfo. Why the Pardon Question Keeps Coming Up
Maxwell herself has kept the possibility alive. On February 9, 2026, she appeared by video for a closed-door deposition before the House Oversight and Government Reform Committee, which is investigating how Jeffrey Epstein was able to sexually abuse underage girls for years. She invoked her Fifth Amendment right and refused to answer the committee’s questions.6NPR. Ghislaine Maxwell Refuses to Answer House Committee’s Questions, Appeals for Clemency
Immediately afterward, her attorney David Oscar Markus made a conditional offer: Maxwell would “speak fully and honestly” about the Epstein case if Trump granted her clemency. Markus also claimed Maxwell could “clear Trump and former President Bill Clinton of any wrongdoing” and that “Ms. Maxwell alone can explain why.”7Los Angeles Times. Ghislaine Maxwell Declined to Answer Questions From House Committee
Democratic Representative Melanie Stansbury characterized the offer as “an effort to essentially try to secure her pardon by keeping her mouth shut.” Committee Chairman James Comer said he was “disappointed” and did not believe Maxwell deserved any form of immunity or clemency.6NPR. Maxwell had already spoken to the Justice Department. On July 24 and 25, 2025, Deputy Attorney General Todd Blanche interviewed her at a federal courthouse in Tallahassee, Florida, in a proffer session rather than a cooperation agreement. Blanche stated on the record that he was “not promising to do anything” regarding her case.8U.S. Department of Justice. Blanche Breaks Silence on Meeting Ghislaine Maxwell
Days after those meetings, Maxwell was moved from FCI Tallahassee to the Federal Prison Camp in Bryan, Texas, a minimum-security facility that primarily houses nonviolent and white-collar offenders. Convicted sex offenders typically require at least a low-security facility, meaning the move would have required a special waiver that the Bureau of Prisons did not publicly explain.11NBC News. Ghislaine Maxwell Moved to Federal Prison in Texas The family of Epstein accuser Virginia Giuffre called the transfer “preferential treatment.”12BBC News. Ghislaine Maxwell Moved to Texas Prison The move intensified suspicion that some form of deal was under discussion, even as the White House denied it.
Where Congress Stands
The pardon question has split the House Oversight Committee. In late April 2026, Comer acknowledged publicly that the committee was “split” on whether to support a clemency-for-testimony trade. “A lot of people” thought it was worthwhile, he said, but gave his own view: “I think it looks bad. Honestly, other than Epstein, the worst person in this whole investigation is Maxwell.”13Politico. To Pardon Maxwell or Not Comer said the internal division had, in his estimation, reduced the likelihood of any deal.14U.S. News & World Report. US House Oversight Chair Says Some Panel Members Open to Ghislaine Maxwell Pardon
Representative Thomas Massie, a Republican pushing for release of Epstein-related files, said he is “adamantly opposed” to a pardon, pointing to what he viewed as unjustified leniency in Maxwell’s prison transfer.15The Guardian. Epstein-Ghislaine Maxwell Clemency An earlier July 2025 report quoted Massie as being open to “whatever they need to do to compel her testimony, as long as it’s truthful.”16NBC News. Democrats have been uniformly against. Representative Robert Garcia, the panel’s ranking Democrat, called the consideration “outrageous” and said Maxwell “is a sexual abuser who facilitated the rape of women and children.” A pardon, he said, would be “a huge step backwards” and part of “a massive cover up.”13Politico. To Pardon Maxwell or Not Representative Raja Krishnamoorthi wrote to acting Attorney General Blanche in April 2026, calling any pardon discussions “unacceptable.”17Politico. Dem Pushes DOJ on Possible Pardon
Democrats have introduced at least two non-binding resolutions opposing clemency, neither of which has been brought to a vote. In August 2025, Krishnamoorthi introduced H.Res.635, declaring Maxwell “should not receive a pardon, commutation, or other form of clemency.”18U.S. Congress. H.Res.635 – Expressing the Sense of the House of Representatives In November 2025, Representative Jamie Raskin filed H.Res.913 to the same effect.19U.S. Congress. Survivors Are Pressing the Other Way
Virginia Giuffre, one of Epstein’s most prominent accusers, died by suicide on April 25, 2025, at her farm in Western Australia at age 41. Her brother Danny Wilson said the “mental pain” of her lifelong abuse had become “unbearable.”21NBC News. Virginia Giuffre, One of Jeffrey Epstein’s Prominent Abuse Survivors, Dies
Her brother Sky Roberts said in a television interview that Trump’s refusal to rule out a pardon was “disgraceful” and “hurtful for a lot of survivors out there.” He said he and his sister had believed, based on Trump’s campaign rhetoric, that “he would do the right thing.”22The Hill. No Clemency Petition Has Been Filed
Markus, Maxwell’s attorney, has described her as a “scapegoat” who “would never have been prosecuted had Jeffrey Epstein not committed suicide.” But he has acknowledged that he has not formally submitted a clemency petition. He told Politico in April 2026 that given the political climate around the release of Epstein files, “I don’t think now is the best time to do it.” He added that there is a “good chance and for good reason that she would get a pardon.”24Politico. The bipartisan push for broader accountability in the Epstein case has, as Politico noted, made it politically harder for the administration to offer Maxwell any deal.25Politico. Will Trump Pardon Ghislaine Maxwell
Where Maxwell’s Case Stands
A jury convicted Maxwell on December 29, 2021, in the Southern District of New York, on three counts: conspiracy to transport minors with intent to engage in criminal sexual activity, transportation of a minor with intent to engage in criminal sexual activity, and sex trafficking of a minor. The court imposed concurrent prison terms totaling 20 years and $750,000 in fines, with judgment entered June 29, 2022.26Justia Law. United States v. Maxwell, No. 22-1426
Her direct appeals are over. The Second Circuit upheld her conviction in September 2024, and on October 6, 2025, the U.S. Supreme Court declined to hear her case.27BBC News. US Supreme Court Declines Ghislaine Maxwell Appeal In December 2025, Maxwell filed a habeas corpus petition seeking to vacate her conviction or reduce her sentence. Federal prosecutors have urged the court to reject the petition, calling her claims “speculative, factually erroneous and procedurally barred.”28ABC News. Ghislaine Maxwell Challenges Conviction After Release of Epstein Files That petition is pending before U.S. District Judge Paul Engelmayer.
Short of success on the habeas petition, a presidential pardon or commutation is the only mechanism that would release Maxwell before her sentence ends. That decision belongs to Trump alone, and he has not made it.
