What the Case Was About

Named plaintiff Mandy Wilson filed suit on January 20, 2023, in the U.S. District Court for the Southern District of Indiana. The complaint targeted a TransUnion product called Triggers for Collection, or TFC, which monitors consumer credit files and alerts debt collectors when new credit activity suggests a consumer might be able to pay an old debt.6OpenClassActions. Wilson alleged that even after Portfolio Recovery Associates submitted deletion codes through TransUnion’s file transfer system to stop monitoring her account, TransUnion kept selling her credit file — including credit history, payment history, Social Security number, address, and date of birth — to PRA. Her underlying debts had already been discharged in bankruptcy, which the complaint said eliminated PRA’s legal basis for pulling her reports. The suit argued this violated Section 1681b of the Fair Credit Reporting Act, which limits when a credit bureau may share consumer information.7ClassAction.org. Wilson v. TransUnion denied the allegations and maintained it would have won at trial, saying it settled to avoid the cost and uncertainty of continued litigation.1Wilson FCRA Class Action. Wilson v. TransUnion Settlement FAQ
