ZRS Management Lawsuits: RealPage Rent-Fixing, Mold Verdict, and More

ZRS Management lawsuits currently span three main fronts: a federal antitrust class action over algorithmic rent pricing, a negligent security case in Tampa tied to a 2025 shooting, and an older Florida mold injury case the Orlando-based apartment manager settled before a jury awarded $48 million against a remaining defendant. A few smaller cases round out the docket.

The RealPage Rent-Fixing Class Action

The biggest case against ZRS is the federal multidistrict litigation In re RealPage Inc. Rental Software Antitrust Litigation (No. II), Case No. 3:23-md-03071, before Judge Waverly D. Crenshaw Jr. in the U.S. District Court for the Middle District of Tennessee.1Hausfeld LLP. RealPage Federal Antitrust Class Action ZRS is one of roughly 50 property management companies named alongside RealPage, the software maker at the center of the case.

Plaintiffs allege that RealPage and its property-management clients used AI-driven “revenue management” software to coordinate rental prices across competing apartment complexes. The complaint says the software ingested nonpublic, competitively sensitive data from participating landlords and then recommended prices designed to push rents above what a competitive market would produce.2Robins Kaplan LLP. RealPage Federal Antitrust Class Action The claims rest on Section 1 of the Sherman Act, which prohibits agreements that restrain competition.

ZRS was also named directly in an earlier complaint in the Southern District of Florida (Case No. 1:23-cv-20165). Plaintiffs Zachary Miller Corradino and Samantha Taylor Reyes alleged they paid inflated rent at The Residences at the Village of Merrick Park in Coral Gables, a property managed by ZRS using RealPage’s pricing tool. The complaint sought treble damages and injunctive relief under the Clayton Act for the Miami, Orlando, Jacksonville, and Tampa rental markets.3Inman. Settlement Status and When Renters Can File Claims

On November 21, 2025, Judge Crenshaw granted preliminary approval of 26 settlements covering 27 defendants, totaling $141.8 million.1Hausfeld LLP. RealPage Federal Antitrust Class Action The class covers people who paid rent at apartments owned or managed by settling companies between October 18, 2018, and November 21, 2025. The claims process has not yet opened, and the official settlement website lists important dates as “TBD.”4RealPage Rental Settlement. More deals have followed. In January 2026, Mid-America Apartment Communities disclosed a $53 million settlement. In April 2026, a Texas-based REIT disclosed a separate $53 million settlement, and Equity Residential reached a $56 million agreement. By May 2026, plaintiffs petitioned the court for preliminary approval of additional settlements exceeding $218 million.5Law360. Tampa Negligent Security Lawsuit

In December 2025, the family of Erinique Moore, a 26-year-old Tampa woman, sued Rivertree Landing Apartment Homes and ZRS Management, alleging that negligent security at the complex led to Moore being shot in the head during a birthday party on September 19, 2025.6Fox 13 News Tampa Bay. According to the complaint, three people were initially removed from the property by police after banging on an apartment door. One of them, Lamonte Scott, later returned, retrieved a firearm from his car in the complex parking lot, and fired through a unit window.7WFLA. The Florida Mold Case and $48 Million Verdict

ZRS was originally a defendant in a personal injury case arising from mold exposure at the Mar Lago Village condominium in Plantation, Florida. Lynette Jividen, 56, moved into the complex in early 2016 and alleged she developed chronic inflammatory response syndrome, a permanent condition affecting her nervous system, digestive system, muscles, joints, and immune system, after prolonged mold exposure in her unit.10Fox 13 Memphis. Jividen sued the building owner, ML Casa V LP, and ZRS Management in May 2018. Both settled with Jividen for an undisclosed amount and were dismissed from the case with prejudice in June 2020.11Trellis Law. Lynette R. Jividen v. Eds Advisors Inc The remaining portion of the case, a default judgment against Florida Contractors Inc. over failed roof repairs, went to a virtual jury trial in Broward County. In April 2021, the jury awarded Jividen $48 million, including $35 million for loss of capacity to enjoy life and $10 million for future medical costs.10Fox 13 Memphis. The headline verdict was not entered against ZRS, which had already exited the case.

Three smaller matters have surfaced in court records:

  • Shean v. ZRS Management (Fla. Supreme Court, Case No. SC2022-1604): petitioners sought review based on a claimed conflict between lower court decisions. One boundary worth noting: the Department of Justice’s separate antitrust case against RealPage, filed in August 2024 in the Middle District of North Carolina, names RealPage and seven large landlord companies but does not name ZRS as a defendant.15U.S. Department of Justice. Justice Department Requires RealPage To End Sharing Competitively Sensitive Information ZRS’s exposure to the rent-pricing allegations runs through the private class action in Tennessee, not the government’s case.
